SPECIAL INSTRUCTIONS: Needs to be signed off prior to event DISTRIBUTION: Completed By: Date: Completed By: Date DEPARTMENT: _s_he_rif_f __________ _ REQUISITIONER: _s_tev_e_F_or_ke_r ______ _ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 AGREEMENT FOR POLICE PROTECTION SERVICES AT PUBLIC EVENT THIS AGREEMENT is made between the County of Fresno; a Charter County of the State of California, hereinafter referred to as "COUNTY" and the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA hereinafter referred to as "SCOTTISH SOCIETY OF CENTRAL CALIFORNIA." WHEREAS, the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA desires to contract with the COUNTY for the performance of law enforcement functions by the COUNTY through its Sheriffs Office; and WHEREAS, the COUNTY agrees, through its Sheriffs Office, to render such seNice, on the terms and conditions set forth, and the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA agrees to pay to the COUNTY the costs of performing such seNices within the boundaries at the rate and under the terms and conditions hereinafter set forth. NOW, THEREFORE, the parties agree as follows: 1. The COUNTY agrees, through its Sheriff's Office, to provide law enforcement seNices at activities and events sponsored the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA as requested in writing by the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA and agreed to by the COUNTY, through its Sheriff's Office. Such seNices shall only encompass duties and functions of the type coming within the jurisdiction and customarily rendered by the Sheriff under the charter of said County and statutes of this State. 2. The SCOTTISH SOCIETY OF CENTRAL CALIFORNIA shall pay for a total of sixteen (16) hours of seNice on Saturday September 201h, 2014, which will be provided by two (2) deputies during this event. The event will be held at 6725 W. Kearney Boulevard, (Kearney Park) in Fresno. Deputies will be assigned to work the event for the durations as follows: two deputies on site Saturday (09/20/2014) from 10:00 A.M. to 6:00P.M., with one half hour of driving time allotted to and from the event Deputies will be in attendance at the event from 10:30 A.M. to 5:30P.M. The financial obligation that the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA is responsible for during the event is for the minimum contracted hours as listed for two (2) deputies in the total amount of (16 total hours* $53.21 an hour= $851.36) $851.36. The COUNTY expressly reseNes the right, 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 through its Sheriff's Office, to assign more personnel at the sole discretion of the Sheriff's Office, at the expense of the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA, with notice. Upon such notification, the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA may, at its election, cancel the request for service for that particular event or activity. 3. Nothing within this Agreement and/or law enforcement services rendered by the COUNTY at said special events or activities is intended to limit or eliminate the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA'S use of private security for general event security and crowd monitoring. 4. Term of Agreement-This Agreement shall become effective when executed by both parties, and shall continue in full force and effect, unless and until terminated by either party upon the giving of thirty (30) days advance written notice. 5. COUNTY shall invoice the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA in a lump sum for the number of hour's service rendered. Invoices shall be addressed to the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA as follows: SCOTTISH SOCIETY OF CENTRAL CALIFORNIA P.O. Payment shall be addressed to the COUNTY as follows: Fresno County Sheriffs Office P.O. Box 1788 Fresno, CA 93717 Attn: Business Office 6. Law Enforcement Service Rate-The SCOTTISH SOCIETY OF CENTRAL CALIFORNIA agrees to pay the current hourly overtime rate per deputy as applied to policing 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 contracts on date of event or activity agreed to. This rate will be provided to The SCOTTISH SOCIETY OF CENTRAL CALIFORNIA at the current overtime rates of $53.21 an hour. The minimum contracted event hours shall be total of (16) hours for both deputies and additional staffing shall be at least three (3) hours compensated per additional deputy assigned. Minimum contracted event hours shall include 1/2 hour driving time each way for each event. 7. Each party to this Agreement, and its officers and employees, shall not assume any liability for the negligent or wrongful acts or omissions of the other party, nor of any officer or employee of the other party. Each party shall hold the other party, and its officers and employees, harmless and defend the other party, its officers and employees, against any liability for injury to person or property arising out of any negligent or wrongful acts of the party, or its officers and employees. The SCOTTISH SOCIETY OF CENTRAL CALIFORNIA shall hold the COUNTY harmless for a reduction in law enforcement services resulting from labor relations actions and obligation to pay the COUNTY shall be reduced for services not performed for that reason. 8. The rendition of contract services, the standards of performance, the discipline of officers, and other matters incident to the performance of such services and the control of personnel so employed, shall remain in the COUNTY. In the event of dispute between the parties as to the extent and duties and functions to be rendered under this Agreement, or the minimum level or manner of such performance of such services, the determination made by the Sheriff's Office shall be final and conclusive. 9. This Agreement supersedes any prior agreement between the COUNTY and the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA for the performance of law enforcement services by the COUNTY within the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA'S boundaries. 3 2 3 4 5 6 7 8 9 10 11 12 13 IN WITNESS WHEREOF the COUNTY, by order of its Board of Supervisors, by the Sheriff on behalf of the Board of Supervisors, and the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA has, by order of its governing body, caused these documents to be subscribed by the designated official of the SCOTTISH SOCIETY OF CENTRAL CALIFORNIA on the date hereinafter written.
