1 AMENDMENT I TO AGREEMENT
2 THIS AMENDMENT, hereinafter referred to as "Amendment 1", is made and entered into this
3 24th day of _ _:M..:.:..a::::..y'----' 20.1§., by and between the COUNTY OF FRESNO, a Political Subdivision
4 ofthe State of California, hereinafter referred to as "COUNTY", and TURNING POINT OF
5 CENTRAL CALIFORNIA, INC., a California Non-Profit Corporation, whose remit to address is
6 P.O. Box 7447, Visalia, CA 93290, and service address is 1475 E . Bulldog Lane, Fresno, CA 93710,
7 hereinafter referred to as "CONTRACTOR."
8 WHEREAS the parties entered into that certain Agreement, identified as COUNTY Agreement
9 No . 14-262, effective July 1, 2014, hereinafter referred to as the "Agreement",
10 WHEREAS, CONTRACTOR agreed to provide permanent housing and supportive services for
11 Fresno County residents with substance use disorders and co-occurring mental health disorders; and
12 WHEREAS the parties now desire to amend the Agreement regarding changes as stated below
13 and restate the Agreement in its entirety.
14 NOW, THEREFORE, in consideration oftheir mutual promises, covenants and conditions,
15 hereinafter set forth, the sufficiency of which is hereby acknowledged, the parties agree as follows:
16 I. That the existing COUNTY Agreement No. 14-262, Page Nineteen (19), beginning with
17 Paragraph Twenty (20), Line Fourteen (14) with the word "SINGLE" and ending on Page Twenty
18 (20), Line Eighteen (18) with the word "later." be deleted and the following inserted in its place:
19 "20 . SINGLE AUDIT CLAUSE
20 A. If CONTRACTOR expends Seven Hundred Fifty Thousand Dollars ($750,000.00) or more in
21 Federal and Federal flow-through monies, CONTRACTOR agrees to conduct an annual audit in
22 accordance with the requirements ofthe Single Audit Standards as set forth in Office ofManagement
2 3 and Budget (OMB) Circular A-133. CONTRACTOR shall submit said audit and management letter
24 to COUNTY . The audit must include a statement of findings or a statement that there were no
2 5 findings. If there were negative findings, CONTRACTOR must include a corrective action plan
2 6 signed by an authorized individual. CONTRACTOR agrees to take action to correct any material non-
2 7 compliance or weakness found as a result of such audit. Such audit shall be delivered to COUNTY 's
2 8 Human Services Finance for review within nine (9) months of the end of any fiscal year in which
