CALIFORNIA STATE UNIVERSITY, FRESNO
FACILITY LEASE
This First Amendment to Facility Lease ("Amendment") amends and modifies that certain
Facility Lease Agreement Effective April l, 202A, by and between County of Fresno
("Lessee") and California State University, Fresno ("Lessor").
Recitals
WHEREAS, Lessee and Lessor entered into the Facility Lease on or about April 1,207A,
whereby Lessee leased the premises (as that term is defined in the Facility Lease) from
Lessor for Lessee's purpose of COVID-I9 laboratory testing during the COVID-I9
pandemic; and
WHEREAS, Lessee and Lessor currently desire to further extend the Facility Lease for an
additional period through December 31,2020
NOW, THEREFORE, it is mutually agreed between the parties hereto as follows:
Terms and Conditions
l. The Facility Lease is amended as follows:
A. The text of DATES OF TERM of the Facility Lease is replaced in its entirety with
the following:
DATES OF TERM from 41112020 to l2l3l/2020 inclusive
CHANGE: Delivery of samples to JARC section, to read: "The delivery of sample
material by LESSEE will be done using the loading area on the east end of JARC.
Samples will be packaged in alignment with UN3373 Category B as specified in the
'ol-aboratory Biosafety Guidance Related to the Novel Coronavirus (2019-nCoV)."
Samples will be transported directly to one of the labs operated by LESSEE using
the service elevator on the eastern end of the building. Samples transported between
labs within JARC, whether neutralized or not, will also be triple packaged by
LESSEE according to UN3373 Category B and will be transported via the eastern
service elevator.
2. The Facility Lease shall continue in full force and effect, subject to the modification
contained in sections 1A and 1B above. This First Amendment shall be effective upon its
complete execution.
