1 AMENDMENT II TO AGREEMENT
2 THIS AMENDMENT II TO AGREEMENT 15-090, hereinafter referred to as
3 Amendment II, is made this 1.2.~ day of \li.nuA~ , 2016, by and between the
4 COUNTY OF FRESNO, a political subdivision of the State of California, hereinafter
5 referred to as the "County", and the DEL REY COMMUNITY SERVICES DISTRICT,
6 hereinafter referred to as the "District".
7 WITNESSETH
8 WHEREAS, the County has been designated as the sponsoring agency to
9 administer and implement the Community Development Block Grant (CDBG) Program
10 activities of the County, and its participating cities, in accordance with the provisions of
11 Title I of the Housing and Community Development Act of 197 4, as amended, and the
12 laws of the State of California; and
13 WHEREAS, on March 10, 2015, the County and the District entered into
14 Agreement No. 15-090, hereinafter referred to as the "Agreement", whereby $270,000 in
15 CDBG funds were made available to the District for the Del Rey Water and Wastewater
16 System Improvements (Phase II), Project No. 14151, hereinafter referred to as the
17 "Project"; and
18 WHEREAS, on November 3, 2015, the County and the District entered into
19 Amendment I to the Agreement (hereinafter "Amendment 1"), whereby the project
20 payment process for this project was modified to comply with current payment
21 processing procedures affecting tax liability accounting at the Auditor-
22 ControllerfTreasurer-Tax Collector's office; and
23 WHEREAS, the total estimated cost of the Project has increased from $270,000
24 to$ 462,510 due to increased construction costs; and
25 WHEREAS, the County now has an additional $192,510 of CDBG funds that can
26 be made available to the Project to accommodate the increased construction costs; and
27 WHEREAS, the District has requested these additional CDBG funds in the
28 amount of $192,510 be made available to the Project.

1 IN WITNESS WHEREOF, the parties have executed this Amendment II on the date set
2 forth above.
