1 AMENDMENT I TO AGREEMENT
2 THIS AMENDMENT I TO AGREEMENT 14-607, hereinafter referred to as
3 Amendment I, is made this~r~ day of fJifUt rYLhc:C , 2015, by and between the
4 COUNTY OF FRESNO, a political subdivision of the State of California, hereinafter
5 referred to as the "County", and the BIOLA COMMUNITY SERVICES DISTRICT,
6 hereinafter referred to as the "District".
7 WITNESSETH
8 WHEREAS, the County has been designated as the sponsoring agency to
9 administer and implement the Community Development Block Grant (CDBG) Program
10 activities of the County, and its participating cities, in accordance with the provisions of
11 Title I of the Housing and Community Development Act of 1974, as amended, and the
12 laws of the State of California; and
13 WHEREAS, on October 7, 2014, the County and the District entered into
14 Agreement No. 14-607, hereinafter referred to as the "Agreement", whereby $300,000 in
15 CDBG funds were made available to the District for the Biola E and G Street Water
16 Lines, Project No. 14032, hereinafter referred to as the "Project"; and
17 WHEREAS, the County has changed its policies and procedures regarding the
18 issuance of payments and will no longer issue checks payable to more than one party,
19 necessitating changes to the payment provisions of the Agreement.
20 NOW THEREFORE, in consideration of their mutual promises as hereinafter set
21 forth, the District and the County agree to amend the Agreement as follows:
22 1. Subsections A. and B. of Section V. PAYMENT FOR THE PROJECT,
23 located on Pages 1 0 and 11 are deleted in their entirety and replaced with the following
24 new Subsection A:
25 "A. At monthly intervals, the District shall submit a written request to the
26 County for payment of specified costs incurred in the performance of this Agreement.
27 The request for the County to make such a payment shall be in accordance with the
28 exemplar Project Pay Request Form attached hereto as Exhibit 2-A and incorporated

1 IN WITNESS WHEREOF, the parties have executed this Amendment I on the
2 date set forth above.
