HomeMy WebLinkAbout321751 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 i Agreement No.15-244 AGREEMENT THIS AGREEMENT is made and entered into this 16th day of June, 2015, by and between the COUNTY OF FRESNO, a political subdivision of the State of California, hereinafter referred to as "COUNTY'', and Alliant International University, a Private Non-Profit Corporation, whose address is 5130 East Clinton Way, Fresno, CA, 93727, hereinafter referred to as .. CONTRACTOR". WIT N E S S E T H: WHEREAS, COUNTY is a recipient of one-time State of California Community Recidivism Reduction Grant (CRRG) monies to fund community recidivism and crime reduction services as defined in California Penal Code Section 1233.10 and that include, but are not limited to, delinquency prevention, homelessness prevention, and reentry services; and WHEREAS, CONTRACTOR is qualified and willing to provide such services pursuant to the terms and conditions of this Agreement. NOW, THEREFORE, in consideration of their mutual promises, covenants and conditions, hereinafter set forth, the sufficiency of which is acknowledged, the parties agree as follows: 1. SERVICES A. CONTRACTOR shall perform all services and fulfill all responsibilities as specified in Exhibit "A", COUNTY'S Request for Proposal No. 952-5330 and Addendum No. One (1) thereto, (collectively, the "Revised RFP") and Exhibt "B", CONTRACTOR'S Response to said Revised RFP dated February 25, 2015 ("Response"}, both of which are attached hereto and incorporated herein by reference. B. CONTRACTOR shall provide COUNTY monthly service activity reports in a format agreed upon by COUNTY and CONTRACTOR. 2. TERM This Agreement shall become effective on July 1, 2015 and shall terminate on June 30, 2016. -1- 1 2 3. TERMINATION A Non-Allocation of Funds -The terms of this Agreement, and the services to 3 be provided thereunder, are contingent on the approval of funds by the appropriating government 4 agency. Should sufficient funds not be allocated, the services provided may be modified, or this 5 Agreement terminated, at any time by giving the CONTRACTOR thirty (30) days advance written 6 notice. 7 B. Breach of Contract -The COUNTY may immediately suspend or terminate 8 this Agreement in whole or in part, where in the determination of the COUNTY there is: 9 10 11 12 COUNTY; 1) An illegal or improper use of funds; 2) A failure to comply with any term of this Agreement; 3) A substantially incorrect or incomplete report submitted to the 13 4) Improperly performed service. 14 In no event shall any payment by the COUNTY constitute a waiver by the COUNTY 15 of any breach of this Agreement or any default which may then exist on the part of the 16 CONTRACTOR. Neither shall such payment impair or prejudice any remedy available to the 17 COUNTY with respect to the breach or default. The COUNTY shall have the right to demand of 18 the CONTRACTOR the repayment to the COUNTY of any funds disbursed to the CONTRACTOR 19 under this Agreement, which in the judgment of the COUNTY were not expended in accordance 20 with the terms of this Agreement. The CONTRACTOR shall promptly refund any such funds upon 21 demand. 22 C. Without Cause -Under circumstances other than those set forth above, 23 this Agreement may be terminated by COUNTY upon the giving of thirty (30) days advance written 24 notice of an intention to terminate to CONTRACTOR. 25 4. COMPENSATION/INVOICING: COUNTY agrees to pay CONTRACTOR and 26 CONTRACTOR agrees to receive compensation as follows: $556 for each participant evaluation 27 as described in Exhibit A CONTRACTOR shall submit monthly invoices for all evaluations to the 28 County of Fresno Administrative Office at 2280 Tulare Street, Room 304, Fresno, CA 93721 or -2- 1 designee COUNTY Department. 2 In no event shall services performed under this Agreement be in excess of 3 Thirty-Seven Thousand Four Hundred Ninety-Eight Dollars ($37,498) during the term of this 4 Agreement. It is understood that all expenses incidental to CONTRACTOR'S performance of 5 services under this Agreement shall be borne by CONTRACTOR. COUNTY shall remit payment 6 for services within forty-five (45) days of receipt of service activity report as described in Exhibit B 7 and service invoice. 8 5. INDEPENDENT CONTRACTOR: In performance of the work, duties and 9 obligations assumed by CONTRACTOR under this Agreement, it is mutually understood and 10 agreed that CONTRACTOR, including any and all of the CONTRACTOR'S officers, agents, and 11 employees will at all times be acting and performing as an independent contractor, and shall act in 12 an independent capacity and not as an officer, agent, servant, employee, joint venturer, partner, or 13 associate of the COUNTY. Furthermore, COUNTY shall have no right to control or supervise or 14 direct the manner or method by which CONTRACTOR shall perform its work and function. 15 However, COUNTY shall retain the right to administer this Agreement so as to verify that 16 CONTRACTOR is performing its obligations in accordance with the terms and conditions thereof. 17 CONTRACTOR and COUNTY shall comply with all applicable provisions of 18 law and the rules and regulations, if any, of governmental authorities having jurisdiction over 19 matters the subject thereof. 20 Because of its status as an independent contractor, CONTRACTOR shall have 21 absolutely no right to employment rights and benefits available to COUNTY employees. 22 CONTRACTOR shall be solely liable and responsible for providing to, or on behalf of, its 23 employees all legally-required employee benefits. In addition, CONTRACTOR shall be solely 24 responsible and save COUNTY harmless from all matters relating to payment of 25 CONTRACTOR'S employees, including compliance with Social Security withholding and all other 26 regulations governing such matters. It is acknowledged that during the term of this Agreement, 27 CONTRACTOR may be providing services to others unrelated to the COUNTY or to this 28 Agreement. -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 6. MODIFICATION: Any matters of this Agreement may be modified from time to time by the written consent of all the parties without, in any way, affecting the remainder. 7. NON-ASSIGNMENT: Neither party shall assign, transfer or sub-contract this Agreement nor their rights or duties under this Agreement without the prior written consent of the other party. 8. HOLD HARMLESS: CONTRACTOR agrees to indemnify, save, hold harmless, and at COUNTY'S request, defend the COUNTY, its officers, agents, and employees from any and all costs and expenses, damages, liabilities, claims, and losses occurring or resulting to COUNTY in connection with the performance, or failure to perform, by CONTRACTOR, its officers, agents, or employees under this Agreement, and from any and all costs and expenses, damages, liabilities, claims, and losses occurring or resulting to any person, firm, or corporation who may be injured or damaged by the performance, or failure to perform, of CONTRACTOR, its officers, agents, or employees under this Agreement. 9. INSURANCE Without limiting the COUNTY's right to obtain indemnification from CONTRACTOR or any third parties, CONTRACTOR, at its sole expense, shall maintain in full 17 force and effect, the following insurance policies or a program of self-insurance, including but not 18 limited to, an insurance pooling arrangement or Joint Powers Agreement (JPA) throughout the 19 term of the Agreement: 20 A. Commercial General Liability 21 Commercial General Liability Insurance with limits of not less than One 22 Million Dollars ($1 ,000,000) per occurrence and an annual aggregate of Two Million Dollars 23 ($2,000,000). This policy shall be issued on a per occurrence basis. COUNTY may require 24 specific coverages including completed operations, products liability, contractual liability, 25 Explosion-Collapse-Underground, fire legal liability or any other liability insurance deemed 26 necessary because of the nature of this contract. 27 B. Automobile Liability 28 Comprehensive Automobile Liability Insurance with limits for bodily injury of -4- 1 not less than Two Hundred Fifty Thousand Dollars ($250,000.00) per person, Five Hundred 2 Thousand Dollars ($500,000.00) per accident and for property damages of not less than Fifty 3 Thousand Dollars ($50,000.00), or such coverage with a combined single limit of Five Hundred 4 Thousand Dollars ($500,000.00). Coverage should include owned and non-owned vehicles used 5 in connection with this Agreement. 6 C. Professional Liability 7 If CONTRACTOR employs licensed professional staff, (e.g., Ph.D., R.N., 8 L.C.S.W., M.F.C.C.) in providing services, Professional Liability Insurance with limits of not less 9 than One Million Dollars ($1 ,000,000.00) per occurrence, Three Million Dollars ($3,000,000.00) 10 annual aggregate. 11 D. Worker's Compensation 12 A policy of Worker's Compensation insurance as may be required by the 13 California Labor Code. 14 CONTRACTOR shall obtain endorsements to the Commercial General Liability 15 insurance naming the County of Fresno, its officers, agents, and employees, individually and 16 collectively, as additional insured, but only insofar as the operations under this Agreement are 17 concerned. Such coverage for additional insured shall apply as primary insurance and any other 18 insurance, or self-insurance, maintained by COUNTY, its officers, agents and employees shall be 19 excess only and not contributing with insurance provided under CONTRACTOR's policies herein. 20 This insurance shall not be cancelled or changed without a minimum of thirty (30) days advance 21 written notice given to COUNTY. 22 Within Thirty (30) days from the date CONTRACTOR signs and executes this 23 Agreement, CONTRACTOR shall provide certificates of insurance and endorsement as stated 24 above for all of the foregoing policies, as required herein, to the County of Fresno, (Name and 25 Address of the official who will administer this contract), stating that such insurance coverage have 26 been obtained and are in full force; that the County of Fresno, its officers, agents and employees 27 will not be responsible for any premiums on the policies; that such Commercial General Liability 28 insurance names the County of Fresno, its officers, agents and employees, individually and -5- 1 collectively, as additional insured, but only insofar as the operations under this Agreement are 2 concerned; that such coverage for additional insured shall apply as primary insurance and any 3 other insurance, or self-insurance, maintained by COUNTY, its officers, agents and employees, 4 shall be excess only and not contributing with insurance provided under CONTRACTOR's policies 5 herein; and that this insurance shall not be cancelled or changed without a minimum of thirty (30) 6 days advance, written notice given to COUNTY. 7 In the event CONTRACTOR fails to keep in effect at all times insurance 8 coverage as herein provided, the COUNTY may, in addition to other remedies it may have, 9 suspend or terminate this Agreement upon the occurrence of such event. 10 All policies shall be issued by admitted insurers licensed to do business in the 11 State of California, and such insurance shall be purchased from companies possessing a current 12 A.M. Best, Inc. rating of A FSC VII or better. 13 10. AUDITS AND INSPECTIONS: The CONTRACTOR shall at any time during 14 business hours, and as often as the COUNTY may deem necessary, make available to the 15 COUNTY for examination all of its records and data with respect to the matters covered by this 16 Agreement. The CONTRACTOR shall, upon request by the COUNTY, permit the COUNTY to 17 audit and inspect all of such records and data necessary to ensure CONTRACTOR'S compliance 18 with the terms of this Agreement. 19 If this Agreement exceeds ten thousand dollars ($1 0,000.00), CONTRACTOR 20 shall be subject to the examination and audit of the Auditor General for a period of three (3) years 21 after final payment under contract (Government Code Section 8546.7). 22 11. NOTICES: The persons and their addresses having authority to give and 23 receive notices under this Agreement include the following: 24 25 26 27 28 COUNTY COUNTY OF FRESNO County Administrative Office 2280 Tulare Street, Room 304 Fresno, CA 93721 CONTRACTOR ALLIANT INERNATIONAL UNIVERSITY Psychological Services Center 5130 East Clinton Way Fresno, CA 93727 Any and all notices between the COUNTY and the CONTRACTOR provided -6- 1 for or permitted under this Agreement or by law shall be in writing and shall be deemed duly 2 served when personally delivered to one of the parties, or in lieu of such personal services, when 3 deposited in the United States Mail, postage prepaid, addressed to such party. 4 12. GOVERNING LAW: Venue for any action arising out of or related to this 5 Agreement shall only be in Fresno County, California. 6 The rights and obligations of the parties and all interpretation and performance 7 of this Agreement shall be governed in all respects by the laws of the State of California. 8 13. DISCLOSURE OF SELF-DEALING TRANSACTIONS 9 This provision is only applicable if the CONTRACTOR is operating as a 10 corporation (a for-profit or non-profit corporation) or if during the term of the agreement, the 11 CONTRACTOR changes its status to operate as a corporation. 12 Members of the CONTRACTOR's Board of Directors shall disclose any self- 13 dealing transactions that they are a party to while CONTRACTOR is providing goods or 14 performing services under this agreement. A self-dealing transaction shall mean a transaction 15 to which the CONTRACTOR is a party and in which one or more of its directors has a material 16 financial interest. Members of the Board of Directors shall disclose any self-dealing 17 transactions that they are a party to by completing and signing a Self-Dealing Transaction 18 Disclosure Form, attached hereto as Exhibit C and incorporated herein by reference, and 19 submitting it to the COUNTY prior to commencing with the self-dealing transaction or 20 immediately thereafter. 21 14. ENTIRE AGREEMENT: This Agreement constitutes the entire agreement 22 between the CONTRACTOR and COUNTY with respect to the subject matter hereof and 23 supersedes all previous Agreement negotiations, proposals, commitments, writings, 24 advertisements, publications, and understandings of any nature whatsoever unless expressly 25 included in this Agreement. In the event of any inconsistency in interpreting the documents 26 comprising this Agreement, the inconsistency shall be resolved by giving precedence in the 27 following order of priority: (1) the text of this Agreement (excluding COUNTY's Revised RFP and 28 CONTRACTOR's Response); (2) COUNTY's Revised RFP; and (3) CONTRACTOR's Response. -7- 1 2 IN WITNESS WHEREOF, the parties hereto have executed this Agreement as 3 of the day and year first hereinabove written. 4 . These condttions will apply to all subsequent purchases based on this bid. 1. BID PREPARATION: A) All prices and notations must be typed or written in ink. No erasures permitted. SUBMITTING BIDS: A) Each bid must be submitted on forms provided in a sealed envelope/package with bid number and closing date and time on the outside of the envelope/package. B) Interpretation: Should any discrepancies or omissions be found in the bid specifications or doubt as to their meaning, the bidder shall notify the Buyer in writing at once. The County shall not be held responsible for verbal interpretations. Questions regarding the bid must be received by Purchasing stated within this document. C) ISSUING AGENT/AUTHORIZED CONTACT: This RFP/RFQ has been issued by County of Fresno, Purchasing. Purchasing shall be the vendor's sole point of contact with regard to the RFP/RFQ, its content, and all issues concerning it. All communication regarding this RFPIRFQ shall be directed to an authorized representative of County Purchasing. The specific buyer managing this RFP/RFQ is identified on the cover page, along with his or her telephone number, and he or she should be the primary point of contact for discussions or information pertaining to the RFPIRFQ. Contact with any other County representative, including elected officials, for the purpose of discussing this RFPIRFQ, its content, or any other issue concerning it, is prohibited unless authorized by Purchasing. Violation of this clause, by the vendor having unauthorized contact {verbally or in writing) with such other County representatives, may constitute grounds for rejection by Purchasing of the vendor's quotation. The above stated restriction on vendor contact with County representatives shall apply until the County has awarded a purchase order or contract to a vendor or vendors, except as follows. First, in the event that a vendor initiates a formal protest against the RFPIRFQ, such vendor may contact the appropriate individual, or individuals who are managing that protest as outlined in the County's established protest procedures. All such contact must be in accordance with the sequence set forth under the protest procedures. Second, in the event a public hearing is scheduled before the Board of Supervisors to hear testimony prior to its approval of a purchase order or contract, any vendor may address the Board. D) Bids received after the closing time will NOT be considered. E) Bidders are to bid what is specified or requested first. If unable to or unwilling to, bidder may bid alternative or option, indicating all advantages, disadvantages and their associated cost 3. W-9-REQUEST FOR TAXPAYER IDENTIFICATION NUMBER AND CERTIFICATION & CALIFORNIA FORM 590 WITHHOLDING EXEMPTION CERTIFICATE: Upon award of bid, the vendor shall submit to County Purchasing, a completed IRS Form W-9-Request for Taxpayer Identification Number and Certification and a California Form 590 Withholding Exemption Certificate if not currenUy a County of Fresno approved vendor. 6. AWARDS: A) Award(s) will be made to the most responsive responsible bidder; however, the Fresno County Local Vendor Preference and/or the Disabled Veteran Business Enterprise Preference shall take precedence when applicable. Said Preferences apply only to Request for Quotations for materials, equipment and/or supplies only (no services); the preference do not apply to Request for Proposals. RFQ evaluations will include such things as life-cycle cost, availability, delivery costs and whose product and/or service is deemed to be in the best interest of the County. The County shall be the sole judge in making such determination. B) Unless bidder gives notice of all-or-none award in bid, County may accept any item, group of items or on the basis of total bid. C) The County reserves the right to reject any and all bids and to waive informalities or irregularities in bids. D) Award Notices are tentative: Acceptance of an offer made in response to this RFP/RFQ shall occur only upon execution of an agreement by both parties or issuance of a valid written Purchase Order by Fresno County Purchasing. E) After award, all bids shall be open to public inspection. The County assumes no responsibility for the confidentiality of information offered in a bid. 7. TIEBIDS: All other factors being equal, the contract shall be awarded to the Fresno County vendor or, if neither or both are Fresno County vendors, it may be awarded by the flip of a coin in the presence of witnesses or the entire bid may be rejected and re-bid.lf the General Requirements of the RFQ state that they are applicable, the provisions of the Fresno County Local Vendor Preference shall take priority over this paragraph. 8. PATENT INDEMNITY: The vendor shall hold the County, its officers, agents and employees, harmless from liability of any nature or kind, including costs and expenses, for infringement or use of any copyrighted or un-copyrighted composition, secret process, patented or unpatented invention, article or appliance furnished or used in connection with this bid. 9. SAMPLES: Samples, when required, must be furnished and delivered free and, if not destroyed by tests, will upon written request (within thirty (30) days of bid closing date) be returned at the bidde~s expense. In the absence of such notification, County shall have the right to dispose of the samples in whatever manner it deems appropriate. 10. RIGHTS AND REMEDIES OF COUNTY FOR DEFAULT: A) In case of default by vendor, the County may procure the articles or service from another source and may recover the cost difference and related expenses occasioned thereby from any unpaid balance due the vendor or by proceeding against performance bond of the vendor, if any, or by suit against the vendor. The prices paid by the County shall be considered the prevailing market price at the time such purchase is made. B) Articles or services, which upon delivery inspection do not meet specifications, will be rejected and the vendor will be considered in default. Vendor shall reimburse County for expenses related to delivery of non-specified goods or services. C) Regardless of F.O.B. point, vendor agrees to bear all risks of loss, injury or destruction to goods and materials ordered herein which occur prior to delivery and such loss, injury or destruction shall not release vendor from any obligation hereunder. 11. DISCOUNTS: Terms ofless than fifteen (15) days for cash payment will be considered as net in evaluating this bid. A discount for payment within fifteen (15) days or more will be considered in determining the award of bid. Discount period will commence either the later of delivery or receipt of invoice by the County. Standard terms are Net forty-five (45) days. 12. SPECIAL CONDITIONS IN BID SCHEDULE SUPERSEDE GENERAL CONDITIONS: The "General Conditions' provisions of this RFP/RFQ shall be superseded if in conflict with any other section of this bid, to the extent of any such conflict 13. SPECIAL REQUIREMENT: With the invoice or within twenty-five (25) days of delivery, the seller must provide to the County a Material Safety Data Sheet for each product, which contains any substance on "The List of 800 Hazardous Substances', published by the State Director of Industrial Relations. (See Hazardous Substances Information and Training Act, California State Labor Code Sections 6360 through 6399.7.) 14. RECYCLED PRODUCTS/MATERIALS: Vendors are encouraged to provide and quote (with documentation) recycled or recyclable products/materials which meet stated specifications. 15. YEAR COMPLIANCE WARRANTY: Vendor warrants that any product furnished pursuant to this AgreemenUorder shall support a four -digit year format and be able to accurately process date and time data from, into and between the twentieth and twenty-first centuries, as well as leap year calculations. 'Product' shall include, withoutlimitation,anypieceor component of equipment, hardware, firmware, middleware, custom or commercial software, or internal components or subroutines therein. This warranty shall survive termination or expiration of this Agreement. In the event of any decrease in product functionality or accuracy related to time and/or date data related codes and/or internal subroutines that impede the product from operating correcUy using dates beyond December 31, 1999, vendor shall restore or repair the product to the same level of functionality as warranted herein, so as to minimize interruption to County's ongoing business process, time being of the essence. In the event that such warranty compliance requires the acquisition of additional programs, the expense for any such associated or additional acquisitions, which may be required, including, without limitation, data conversion tools, shall be borne exclusively by vendor. Nothing in this warranty shall be construed to limit any rights or remedies the County may otherwise have under this Agreement with respect to defects other than year performance. 18 Proposal No. 952-5330 16. PARTICIPATION: Bidder may agree to extend the terms of the resulting contract to other political subdivision, municipalities and tax-supported agencies. Such participating Governmental bodies shall make purchases in their own name, make payment directly to bidder, and be liable directly to the bidder, holding the County of Fresno harmless. 17. CONFIDENTIALITY: All services performed by vendor shall be in strict conformance with all applicable Federal, State of California and/or local laws and regulations relating to confidentiality, including but not limited to, California Civil Code, California Welfare and Institutions Code, Health and Safety Code, California Code of Regulations, Code of Federal Regulations. Vendor shall submit to County's monitoring of said compliance. Vendor may be a business associate of County, as that term is defined in the 'Privacy Rule' enacted by the Health Insurance Portability and Accountability Act of 1996 {HIPAA). As a HIPAA Business Associate, vendor may use or disclose protected health information {'PHI"} to perform functions, activities or services for or on behalf of County as specified by the County, provided that such use or disclosure shall not violate HIPAA and its implementing regulations. The uses and disclosures if PHI may not be more expansive than those applicable to County, as the 'Covered Entity" under HIPAA's Privacy Rule, except as authorized for management, administrative or legal responsibilities of the Business Associate. Vendor shall not use or further disclose PHI other than as permitted or required by the County, or as required by law without written notice to the County. Vendor shall ensure that any agent, including any subcontractor, to which vendor provides PHI received from, or created or received by the vendor on behalf of County, shall comply with the same restrictions and conditions with respect to such information. 18. APPEALS: Appeals must be submitted in writing within seven (7} working days after notification of proposed recommendations for award. A 'Notice of Award" is not an indication of County's acceptance of an offer made in response to this RFPIRFQ. Appeals should be submitted to County of Fresno Purchasing, 4525 E. Hamilton Avenue, Fresno, California 93702-4599. Appeals should address only areas regarding RFP contradictions, procurement errors, quotation rating discrepancies, legality of procurement context, conflict of interest, and inappropriate or unfair competitive procurement grievance regarding the RFPIRFQ process. Purchasing will provide a written response to the complainant within seven (7} working days unless the complainant is notified more time is required. If the protesting bidder is not satisfied with the decision of Purchasing, he/she shall have the right to appeal to the Purchasing AgenVCAO within seven (7) working days after Purchasing's notification; except if, notified to appeal directly to the Board of Supervisors at the scheduled date and time. If the protesting bidder is not satisfied with Purchasing AgenVCAO's decision, the final appeal is with the Board of Supervisors. 19. OBLIGATIONS OF CONTRACTOR: A) CONTRACTOR shall perform as required by the ensuing contract. CONTRACTOR also warrants on behalf of itself and all subcontractors engaged for the performance of the ensuing contract that only persons authorized to work in the United States pursuant to the Immigration Reform and Control Act of 1986 and other applicable laws shall be employed in the performance of the work hereunder. B) CONTRACTOR shall obey all Federal, State, local and special district laws, ordinances and regulations. 20. AUDITS & RETENTION: The Contractor shall maintain in good and legible condition all books, documents, papers, data files and other records related to its performance under this contract. Such records shall be complete and available to Fresno County, the State of California, the federal government or their duly authorized representatives for the purpose of audit, examination, or copying during the term of the contract and for a period of at least three (3} years following the County's final payment under the contract or until conclusion of any pending matter {e.g., litigation or audit), whichever is later. Such records must be retained in the manner described above until all pending matters are closed. 21. Page3 The Budget Act of 2014 (Chapter 25, Statutes of 2014) allocates $8 million to California counties to fund a local Community Recidivism Reduction Grant as defined in Penal Code Section 1233.10 (Attachment A). As one of the recipient counties of this one-time funding, the County of Fresno is offering a competitive grant process to fund community recidivism and crime reduction services, including, but not limited to, delinquency prevention, homelessness prevention, and reentry services. The County of Fresno has established the following guidelines as a focal point of local efforts within the statutory requirements with the goal of meeting the needs in Fresno County. Proposed projects must be designed to enable persons to whom the services are provided refrain from engaging in crime, reconnect with their family members, and contribute to their communities. As defined in the statute the following type's program/service activities are examples of eligible services: • Self-help groups • Individual or group assistance with basic life skills • Mentoring programs • Academic and educational services • Job training skills and employment • Truancy prevention programs • Literacy programs • Service referral Award must be used to create a new service, such as those listed above, or to expand an existing effort. Program/service expansion includes, but is not limited, providing services in the rural communities in Fresno County. Grant Period All grant awards will be made on a competitive bid basis. The anticipated contract periods are one-year or two-year, depending upon services proposed, from July 1, 2015 through June 30, 2016 or June 30, 2017. Available Funding This is a one-time grant award opportunity and is not intended to fund ongoing expenditures. Community recidivism and crime reduction services may include all of the following: (A) Self-help groups. (B) Individual or group assistance with basic life skills. (C) Mentoring programs. (D) Academic and educational services, including, but not limited to, services to enable the recipient to earn his or her high school diploma. (E) Job training skills and employment. (F) Truancy prevention programs. (G) Literacy programs. (H) Any other service that advances community recidivism and crime reduction efforts, as identified by the county board of supervisors and the Community Corrections Partnership. (I) Individual or group assistance with referrals for any of the following: (i) Mental and physical health assessments. (ii) Counseling services. (iii) Education and vocational programs. (iv) Employment opportunities. (v) Alcohol and drug treatment. (vi) Health, wellness, fitness, and nutrition programs and services. (vii) Personal finance and consumer skills programs and services. (viii) Other personal growth and development programs to reduce recidivism. (ix) Housing assistance. (d) Pursuant to this section and upon agreement to accept funding from the Recidivism Reduction Fund, the board of supervisors, in collaboration with the county's Community Corrections Partnership, shall grant funds allocated to the county, as described in subdivision (a), to community recidivism and crime reduction service providers based on the needs of their community. (e) (1) The amount awarded to each community recidivism and crime reduction service provider by a county shall be based on the population of the county, as projected by the Department of Finance, and shall not exceed the following: (A) One hundred thousand dollars ($1 00,000) in a county with a population of over 4,000,000 people. The approval comes after 11 months of work by a committee of public safety officials and subject-matter experts to craft the definition mandated by AB 1050. The statute calls for the definition to be used to help counties evaluate and implement evidence-based practices and programs in local corrections systems. The definition reads as follows: Adult Recidivism Definition Recidivism is defined as conviction of a new felony or misdemeanor committed within three years of release from custody or committed within three years of placement on supervision for a previous criminal conviction. 1 Supplemental Measures This definition does not preclude other measures of offender outcomes. Such measures may include new arrest, return to custody, criminal filing, violation of supervision, and level of offense (felony or misdemeanor). Recidivism Rates While the definition adopts a three-year standard measurement period, rates may also be measured over other time intervals such as one, two, or five years. 1 "Committed" refers to the date of offense, not the date of conviction. The committee continues to work on other definitions as required by the legislation. AB 1050 amended Section 6027 of the Penal Code to require the Board to: "Develop definitions of key terms, including, but not limited to, 'recidivism,' 'average daily population,' 'treatment program completion rates,' and any other terms deemed relevant in order to facilitate consistency in local data collection, evaluation, and implementation of evidence-based practices, promising evidence-based practices, and evidence-based programs." It is hoped that counties and law enforcement agencies will use the standard definitions for these key terms once all are developed and approved by the BSCC. Since Public Safety Realignment launched in 2011 California has been investing hundreds of millions of dollars at the local level so that low-level, non-violent offenders and parole violators would serve their terms in county jails, closer to support systems and the rehabilitative programming that officials of the 58 counties determine work best for their communities. A central goal of Realignment is reducing recidivism. The BSCC is mandated by AB 1 09 to collect and maintain data about state and community correction policies, practices and needs. Having standard definitions will promote consistent statewide reporting. In the coming weeks the BSCC will publish the definition on its website and alert counties that a definition has been adopted. SCOPE OF WORK Project Narrative -Community Recidivism Reduction Grant The Psychological Services Center (PSC) on the Fresno Campus of Alliant International University has been a mental health service provider for residents of Fresno and surrounding counties for the past 30 years. The PSC has partnered in numerous ways with Fresno County Probation (Adult and Juvenile Divisions) and with local educational and social service agencies to address crime- related recidivism. Some examples of the PSC's work with the Fresno County criminal justice system include: • The PSC's Batterers' Intervention Program (BJP) has been in existence for the past 21 years. The PSC retains annual certification from the Fresno County Probation Department. The BIP participants, as part of their terms and conditions imposed by the court following conviction of a domestic violence charge [pursuant to Penal Code (PC) § 273.5], are required to complete a 52-week BIP program to reduce violence-related crimes including but not limited to PC § 273.5. • Our Sex Offender Treatment Program (SOTP) has been in existence for 25 years; assessment and treatment provisions to adult and juvenile offenders convicted of sex-related crimes with the overall focus being a reduction of reoffending. Services are for individuals referred by Fresno County Probation or the Parole Division of the California Department of Corrections & Rehabilitation (CDCR). • Juvenile Court Evaluations: We have provided psychological evaluations to the Fresno County Superior Court, Juvenile Division, for the past 20 years for the purpose of dispositional proceedings. The psychological evaluations have included the provision of mental health diagnostic impressions and associated rehabilitation/treatment recommendations, placement recommendations, violence and sex offenders-specific risk determination, psychoeducational evaluation, and associated academic/employment recommendations. • Child Custody Evaluations: For twelve years, we provided child custody evaluations to the Fresno County Family Courts. • Child Protective Service (CPS)Psychological Evaluations and Treatment: We provide psychological evaluations and treatment to parents and children referred by Fresno County CPS. • Patients' Rights Advocacy (PRA): Until July 2014, we provided PRA-related services to Fresno County residents afflicted by severe mental illness in partnership with Fresno County Behavioral Health. • Public Defender's Office: We currently provide psychological evaluations for the Law Offices of the Public Defender. • Behavioral Health Court: We currently provide evaluations for the Behavioral Health Court of Fresno County. • Students Targeted for Opportunities at Prevention (STOP) Program: In partnership with Fresno County Juvenile Probation, we served four Fresno County middle schools with psychological evaluations, mental health treatment [individual, group and family therapy], academic tutoring and recreation services. STOP was in existence for ten years and greatly reduced juveniles and adults from perpetrating crimes. In addition, we currently provide psychological evaluation services for the following agencies: • Department of Rehabilitation: Psychological Evaluations • California State University-Fresno: Disability Services Office-Psychological Evaluations l_ • Mendota Unified School District: Psychological Evaluations The PSC's proposed contribution to the community recidivism and crime reduction process will Proposal No. 952-5330 Page 12 ,, through the provision of H1 mental health assessments (comprehensive psychological evaluations) as detailed below. Statewide prison and county jail recidivism rates have significantly increased over the past 1 0 to 15 years .. More recently, California's state prison system (CDCR) has shown recidivism rates as high as 82% with associated costs of incarceration spiraling out of control. Individuals who are released from county jail or state prison are commonly returned to the community in which they committed their crimes without adequate planning or identification of rehabilitative resources. Many of these individuals have undiagnosed mental health disorders, substance abuse problems, learning disabilities or inadequate understanding or knowledge with respect to how to apply for a job, places to live or how/where to seek services. Instead, they find themselves returning to a criminal lifestyle and the associated at-risk behaviors, thus perpetuating the cycle of criminal recidivism. At the crux of the proverbial criminal justice "revolving door'' is inadequate evaluation/assessment for those going back and forth from the community to jail or prison, as well as the lack of a clear and realistic plan for community re-entry. ..----\ At the heart of creating a re-entry plan for any offender is a comprehensive psychological , evaluation including empirically-supported and evidence-based assessment tools in order to: \,\ o Comprehensively identify risk for re-offense and interventions designed to mitigate these j risks o Connect him/her to needed community resources to develop skills and address barriers to employment and self-sufficiency. o To identify and refer clients to address existing mental health treatment needs. Each participant Will undergo an extensive psychological evaluation that Will mclude an assessment of his/her psychiatric status, substance use/abuse potential, cognitive and academic skills, vocational interests, independent living skills, and risk for re-offense, using well-validated, contemporary psychological measures which are research-supported and evidence-based. Evaluations will be offered to English and Spanish-speaking participants with a planned total of 90 participants being served(.'Ea.ch.pa'itidpanfwillbe referred by FresrioCounty Probation or CDCR Parole to undergo a comprehensive psychological evaluation which would be conducted with the participant over the course of six to twelve hours. A final evaluation report will be completed within 15 calendar days from the last day the participant is seen. Participants would not be eligible for psychological evaluation if they are psychiatrically decompensated [actively/floridly psychotic requiring a higher level of care akin to inpatient psychiatric care] or who are actively under the influence of alcohol and/or other drugs. Participants will be required to cooperative with scheduled appointments and evaluation procedures and be of "sound mind" [not psychotic or under the influence]. Participants could also be found ineligible if they refused to cooperate at any stage of the psychological evaluation [psychological testing or clinical interview] or failed to show for more than one scheduled appointment. In all instances of program termination, participants would be referred back to the original referral source [Fresno County Probation or Parole Department] within 24 hours. Should participants, for whatever reason, be remanded into custody subsequent to a referral to the PSC, the PSC would be able to evaluate the participant and complete the psychological evaluation so long as the participant is incarcerated within Fresno County. The PSC would consult on a case- by-case basis with the referral source (Probation or Parole) for participants who experience status ( ( \.__ Proposal No. 952-5330 Page 13 changes (either released from or remanded back into custody) from the point of original referral to the submission of the final psychological evaluation report. Short-term goals of the program are: 1. To better understand the barriers to each participant's success in community re-entry. 2. To identify factors associated with a risk of recidivism and detailed recommendations to reduce this risk. 3. To devise a plan of re-entry that is realistic and grounded in evidence-based findings by use of psychometric assessment tools with long-term goal of overall crime reduction. Evaluations of participants will be provided Monday to Thursday, 9am to 8pm and Fridays 9am to 4pm at the PSC clinic. The PSC staff are willing and able to conduct the evaluations within the community (county jails, Juvenile Justice Campus (JJC) and the like) on the weekends as well as weekdays 9am to 8pm. Each psychological evaluation will include: • An Assessment of Vocational Competencies including: o A comprehensive assessment of cognitive functioning and academic skills including identifying cognitive deficits, attention disorders and learning disabilities that might interfere with sustaining gainful employment and independent living o An objective assessment of the client's vocational interests and a detailed interview of his/her vocational history in order to link identify appropriate career options given the client's cognitive and academic skills. o An objective assessment of independent living skills and recommendations for intervention to enhance the client's ability to function independently. o Identification of factors that might interfere with clients seeking and maintaining gainful employment • Risk Factors for Re-Offense Assessment: A detailed assessment of the client's criminal offense history and factors associated with a risk of re-offense • Current psychiatric status: A comprehensive assessment of the client's current psychiatric symptoms including: o Current DSM-V diagnosis o Treatment needs and recommended interventions to address those needs. • A feedback session with the client and referring professional, detailing our findings and recommendations including specific referrals to partner community agencies. A copy of the completed psychological evaluation will be provided to the referral source [Fresno County Probation (case-assigned Deputy Probation Officer) or CDCR Parole Office (Agent of Record)]. • Each participant's psychological evaluation will include recommendations for supportive services associated with each finding/outcome. The current proposal for psychological evaluations will remain cost-effective as they will be completed by a clinical psychology interns and psychological trainees under the direct supervision of a licensed psychologist. Typical evaluations within the Fresno community range from $2,500 to $7,500 per evaluation. Given the current proposed fee per evaluation ($556), this cost is greatly reduced. In this regard, the proposed model is significantly more cost-effective and beneficial to the criminal justice system in better understanding the needs, resources, barriers and associated recommendations for each participant. Given the increased level of understanding of the aforementioned, the current proposal is predicated on the belief that each participant's level of recidivating will be greatly reduced as many of the individual barriers become identified and understood. From this, probation and parole planning with respect to participant re-entry will be greatly enhanced, especially for those who are identified as being at greatest risk of recidivating. Proposal No. 952-5330 Page 14 On the first of each month, a summative "Reporting and Performance Activities" (PRA) will be generated for both the preceding month and cumulative total per fiscal year [annual tabulating/reporting of data will be by fiscal year, not calendar year, unless otherwise requested by Fresno County). Within each PRA, the following will be identified and tracked: • Total number of referrals. • Total number of completed psychological evaluations. • Number of psychological evaluations in process. • Number of days from receipt of referral until the evaluation report is provided to Fresno County. • Demographic data of each participant (age, gender, race/ethnicity, domestic living status, employment status, substance abuse, criminal history identifiers including gang activity, date of release from most recent incarceration, including probation or parole supervision or recent release from either, categorical level of risk for becoming involved in criminal activities, and ex- offenders with children). With respect to categorical level of recidivating, the following levels will be reported based on extensive risk assessment: low, moderately-low, moderate, moderately-high, and high. NOTE: demographic data will be coded for each participant at the time of the psychological evaluation. • Detailed reasoning for inability to complete evaluation (few expected). • Detailed compliance of Probation/Parole Supervision at the time the participant was seen for psychological evaluation and/or date psychological evaluation report completed (left to the discretion of Fresno County on how to track). At the request of Fresno County, the PSC will track and report, within reason, all requested expenditures and service provisions above and beyond what is noted above. They will be functioning under the supervision of the licensed psychologists on our staff who will typically provide four hours of supervision for each assessment. Interns: Interns receive an annual stipend of $18,000/year. $3,158 each will be charged to this project. Practicum Students: Practicum Students are paid at a rate of $12.00/hour. Licensed Psychologists: The licensed psychologists are paid at a rate of $50/hour. All staff are FICA but not otherwise benefit eligible, with the exception of the practicum students. The FICA rate is 7.65%. Total: $39,211 Consumables As the budget details, we are proposing to provide 90 comprehensive psychological evaluations at a cost of $50,000, for an effective rate of $555.55 per evaluation. As noted in the project narrative, evaluation rates for private practitioners in the community often range from $2,500 to $7,500 per evaluation. We hope to contribute to a targeted effort to reduce recidivism in our community by providing comprehensive assessments that will help to focus intervention efforts. ( Test supplies related to the assessments are $93.39 per evaluation. This includes the cost of test protocols, computer scoring, and related office supplies.
