We, the above signed contractor, have given careful consideration to the change proposed and hereby agree, if
this proposal is approved, that we will provide all equipment, furnish all materials, except as may otherwise be
noted above, and perform all services necessary for the work above specified, and will accept as full payment
therefor the prices shown above.
If the Contractor does not sign acceptance of this order, his attention is directed to the requirements of the
specifications as to proceeding with the ordered work and filing a written protest within the time therein
specified.

Make the following changes to the plans and specifications for this contract. Because of the change(s), ZERO
WORKING DAYS will be added to the contract time. The completion date remains November 25, 2020.
PART I: CHANGE THE GRADE OF ASPHALT BINDER USED FOR TYPE A HMA:
Replace Section 39-2.02B(3) in the Special Provisions with:
The grade of asphalt binder for Type A HMA must be PG 64-28.
TOTAL COST PART I: $0.00 (NO COST)
TOTAL TIME EXTENSION PART I: ZERO WORKING DAYS
PART II: ADJUST THE UNIT PRICE OF HMA BECAUSE OF THE CHANGE IN ASPHALT BINDER
Because of the change to the asphalt binder grade in Part I of this change order, the unit cost of the changed
item differs from the cost of the item in the original specifications as shown in the invoice from Vulcan that you
provided. Section 4-1.05B, “Work-Character Changes,” of the Standard Specifications says that the
Department adjusts the unit price for this condition.
The unit price is adjusted based on the difference between the cost to perform the work as planned and the
cost to perform the work as changed according to Section 9-1.15, “Work-Character Changes,” of the Standard
Specifications. The costs of the asphalt concrete with PG 64-10 binder is $60.00/ton in the invoice you
provided, while the cost of asphalt concrete with PG 64-28 binder is $80.00/ton regardless of the aggregate
size. There are no changes to the cost of the labor, trucking, or equipment necessary to construct the asphalt
concrete. Section 9-1-15, “Work-Character Changes,” says that the payment adjustment is calculated under
Section 9-1.04, “Force Account.”
Because your markup for the costs to perform the work as planned was included in your bid, additional markup
is only included on the difference in the material costs. The difference with additional markup is $23.00/ton
($80.00/ton - $60.00/ton with 15% markup). The estimated quantity of asphalt concrete on the project is 1,000
tons. The total adjustment to the payment is $23,000.
This work did not impact the critical path for the project, therefore, granting additional contract time was not
warranted.
