1 AMENDMENT I TO AGREEMENT
2 THIS AMENDMENT I TO AGREEMENT, ("Amendment I"), is made this 21s' day of
3 October, 2025 , ("Effective Date"), by and between the COUNTY OF FRESNO, a political
4 subdivision of the State of California ("County"), and the RIVERDALE MEMORIAL DISTRICT
5 ("District").
6 WITNESSETH
7 WHEREAS, the County has been designated as the sponsoring agency to administer and
8 implement the Community Development Block Grant (CDBG) Program activities of the County,
9 and its participating cities, in accordance with the provisions of Title I of the Housing and
10 Community Development Act of 1974, as amended, and the laws of the State of California; and
11 WHEREAS, on July 13, 2021, the County and the District entered into Agreement 21-266
12 ("Agreement"), whereby $250,000 in CDBG funds were made available to the District for the
13 Riverdale Memorial Hall Improvements, Project No. 20591 ("Project"); and
14 WHEREAS, the District informed the County that the total estimated cost of the Project has
15 increased from $250,000 to $450,000 due to increased construction costs; and
16 WHEREAS, the District is in need of $200,000 in CDBG funding to complete the Project;
17 and
18 WHEREAS, there is $200,000 in CDBG funds that can be made available to the District for
19 the Project this fiscal year; and
20 WHEREAS, the District has requested a modification to the Time of Performance for the
21 Project, due to delays experienced in preparation of the Project plans and specifications.
22 NOW THEREFORE, in consideration of their mutual promises as hereinafter set forth, the
23 County and District agree to amend the Agreement as follows:
24 1. Page 1, Lines 15-21, are amended to read:
25 "WHEREAS, the District has estimated that the total cost of the Project is$450,000,
26 and the District has requested the sum of$450,000 from the County's allocation of CDBG
27 funds; and
28 WHEREAS, the County Board of Supervisors, at a public hearing conducted on

1 April 28, 2020, approved as part of the County's 2020-2021 Annual Action Plan, the usage
2 of$250,000 in CDBG funds for the Project, as requested by the District; and
3 WHEREAS, the County Board of Supervisors, at a public hearing conducted on
4 August 5, 2025, approved as part of the County's 2025-2026 Annual Action Plan, the
5 inclusion of an additional $200,000 in CDBG funds for the Project on the Unincorporated
6 Area Projects List; and
7 WHEREAS, there is an additional $200,000 in CDBG funds that may be made
8 available to the District for the Project in Fiscal Year 2025-2026;"
9 2. The proposed Project budget on Page 2, Lines 24 through 26, is amended to read:
10 "Construction $299,915
Design & Construction Engineering 117,600
11 Contingency, Permits & Misc. 32,485
Total $450,000"

13 3. The proposed funding summary for the Project on Page 3, Lines 4 and 5, is
14 amended to read:
15 "CDBG $450,000
Total $450,000"

17 4. That the dollar figure set forth on Page 3, Lines 1 and 18, and Page 4, Line 24, is
18 amended in each such place to read "$450,000".
19 5. The Time of Performance set forth on Page 13, Lines 24 through 28, and Page 14,
20 Lines 1 and 2, is amended to read:
21 "4. Begin Advertising for Bids — June 18, 2025
22 5. Award Construction Contract— October 31, 2025.
23 B. The Project shall be completed, and Notice of Completion shall be
24 filed with the Fresno County Recorder's Office, no later than April 16, 2026.
25 C. The final POM Report, written summary of all work completed,
26 documentation demonstrating compliance with the Section 3 clause, and request for final
27 payment shall be submitted to the County no later than July 13, 2026."

1 County and District agree that this Amendment I is sufficient to amend the Agreement, and
2 that upon execution of this Amendment I, the Agreement and this Amendment I together shall be
3 considered the Agreement.
4 The Agreement, as hereby amended, is ratified and continued. All remaining provisions,
5 terms, covenants, conditions, and promises contained in the Agreement shall remain in full force
6 and effect.
