Make the following changes to the plans and specifications or do work not included in the plans and
specifications for this contract. Because of the change(s), ZERO (0) -WORKING DAYS will be added to the
contract time.
ASSESS PENALTY (PARTIAL) IMPOSED BY ARMY CORPS OF ENGINEERS
This compensation adjustment (penalty assessment) was proposed by the engineer.
In accordance with Section 7-1.02A, "General," of the Standard Specifications, adjust compensation to
assess penalty (partial) imposed by the Army Corps of Engineers (Army Corps) due to the additional
rocks placed in the creek at the project site. Total penalty assessed by the Army Corps was $271,785,
for an additional 7,024 square feet of areas of impact. However, the rock slope limits were not clearly
identified on the plans, therefore, the contractor is being held responsible only for a portion of the total
penalty, for areas of impact outside the right-of-way, totaling 1,265 square feet. The contractor's portion
of the penalty resulted in $48,963.82, see attached Exhibit A for details. This amount will be deducted
from the retention amount.
This extra work did not impact the critical path for the project, therefore, granting additional contract time was
not warranted.
