1 Resolution of the Board of Supervisors of the County of Fresno Deciding Claims for and
2 Ordering the Disposition of Excess Proceeds from the County's 2016 Sale of Tax-Defaulted
3 Property
4 WHEREAS , on March 4 through 7, 2016, under Revenue and Taxation Code, Division 1, Part 6,
5 Chapter 7 (beginning with section 3691 ), the County sold 55 properties to satisfy the taxes ,
6 assessments , penalties, and costs then delinquent on those properties ("Tax Sale"); and
7 WHEREAS, on April 26, 2016 , the County Auditor-Controller/Treasurer-Tax Collector ("Tax
8 Collector") recorded deeds to all purchasers of property at the Tax Sale ; and
9 WHEREAS, there are excess proceeds in the total amount of $1 ,225 ,530 .10 from the Tax Sale ;
10 and
11 WHEREAS, under Revenue and Taxation Code section 4675, each party of interest , as defined
12 in that section , may file with the County a claim for excess proceeds from the Tax Sale within one year
13 after the recordation of the Tax Collector's deed to the purchaser; and
14 WHEREAS , within one year after the recordation of the Tax Collector's deeds to purchasers of
15 property at the Tax Sale , the Tax Collector received 55 claims for excess proceeds from the Tax Sale ;
16 and
17 WHEREAS, each of the claims identified in exhibit A to this resolution contained sufficient
18 information and proof to establish , to the satisfaction of the Board of Supervisors ("Board"), the
19 claimant's right to excess proceeds from the Tax Sale , in the amounts identified in exhibit A to this
20 resolution , for the total amount of $836 ,190 .69 ; and
21 WHEREAS, each of the claims identified in exhibit B to this resolution did not contain sufficient
22 information and proof to establish, to the satisfaction of the Board, the claimant's right to any of the
23 excess proceeds from the Tax Sale; and
24 WHEREAS, for the claims identified in exhibit C to this resolution , there are not sufficient excess
25 proceeds from the sales of the relevant parcels for the Board to grant those claims , or those claims
26 have already been satisfied by other means ; and

1 WHEREAS , after receiving public comment on November 5, 2019, the Board continued its
2 hearing on tax sale items 144 and 396 , involving nine claims , to be heard on December 1 O, 2019,
3 leaving 46 claims to be decided by this resolution ;
4 WHEREAS , a description of the supporting documentation submitted with each claim for excess
5 proceeds , and a statement of the reason for the determination on each claim , is on file with the Clerk of
6 the Board, and the Board now acts in reliance upon that information ; and
7 WHEREAS , on November 1, 2019, the Tax Collector mailed letters to all claimants , at the
8 addresses provided in their respective claims, providing notice the date , time, and place of the meeting
9 of the Board at which their claims were to be determined , and including information about how to obtain
1 O more information about the Tax Collector's recommendation to the Board; and
11 WHEREAS , all claimants wishing to address the Board on this matter received an opportunity to
12 do so during the meeting at which the Board adopted this resolution;
13 NOW, THEREFORE , THE BOARD FINDS , RESOLVES , AND ORDERS as follows :
14 1. All of the recitals above are true and correct.
15 2 . The claims for excess proceeds identified in exhibit A are granted . For each claim
16 identified in exhibit A , the Tax Collector shall, after waiting for the 90-day period described in
17 subdivision (g) of Revenue and Taxation Code section 4675 , issue a check to the claimant as listed in
18 exhibit A in the amount stated in exhibit A.
19 3. The claims for excess proceeds identified in exhibits B and C are denied .
20 4. The balance of excess proceeds not distributed from the items heard on November 5 ,
21 2019, in the total amount of $319,016.03 shall be distributed to the County , as provided in Revenue and
22 Taxation Code section 4674, after waiting for the 90-day period described in subdivision (g) of Revenue
23 and Taxation Code section 4675.
