1 AMENDMENT I TO AGREEMENT
2 THIS AMENDMENT I TO AGREEMENT, ("Amendment I"), is made this 1011 day of
3 September , 2024 ("Effective Date"), by and between the COUNTY OF FRESNO, a political
4 subdivision of the State of California ("County"), and the CITY OF MENDOTA ("City").
5 WITNESSETH
6 WHEREAS, the County has been designated as the sponsoring agency to administer and
7 implement the Community Development Block Grant (CDBG) Program activities of the County,
8 and its participating cities, in accordance with the provisions of Title I of the Housing and
9 Community Development Act of 1974, as amended, and the laws of the State of California; and
10 WHEREAS, on January 23, 2024, the County and the City entered into Agreement 24-053
11 ("Agreement"), whereby$286,872 in CDBG funds were made available to the City for the Mendota
12 Rojas Pierce Park, Phase 11, Project No. 23471 ("Project"); and
13 WHEREAS, the City now has an additional $240,963 from its allocation of CDBG funds
14 that may be made available to the Project to reduce its local fund contribution under the
15 Agreement; and
16 WHEREAS, the City has requested these additional CDBG funds in the amount of
17 $240,963 be made available to the Project for the purposes of this Agreement.
18 NOW THEREFORE, in consideration of their mutual promises as hereinafter set forth, the
19 County and City agree to amend the Agreement as follows:
20 1. Page 1, Lines 14-21, is amended to read:
21 "WHEREAS, the City has estimated that the total cost of the Project is $563,250, and the
22 City has committed local and other funds to the Project in the amount of $35,415, and is in need
23 of$527,835 in CDBG funding to complete the Project; and
24 WHEREAS, the County can provide $527,835 in CDBG funds needed for the Project from
25 the City's 2023-2024 CDBG allocation ($259,712), and 2024-2025 CDBG allocation ($240,963),
26 and from the City's remaining balance of CDBG funds ($27,160), and
27 WHEREAS, the Project is consistent with the objectives of the Fresno County Consolidated
28 Plan, including the 2023-2024 and 2024-2025 Annual Action Plans."

1 2. The proposed funding summary for the Project on Page 2, Lines 27-28, is amended
2 to read:
3 "CDBG $527,835
Local Financial Contribution 35,415
4 Total $563,250"

6 4. That the dollar figure set forth on Page 2, Line 23, Page 3, Line 12, and Page 4,
7 Line 26, is amended in each such place to read "$527,835".
8 County and City agree that this Amendment I is sufficient to amend the Agreement, and
9 that upon execution of this Amendment I, the Agreement and this Amendment I together shall be
10 considered the Agreement.
11 The Agreement, as hereby amended, is ratified and continued. All remaining provisions,
12 terms, covenants, conditions, and promises contained in the Agreement shall remain in full force
13 and effect.
