AMENDMENT I TO AGREEMENT
THIS AMENDMENT I TO AGREEMENT, (“Amendment I”), is made this ____ day of
______________, 2020, by and between the COUNTY OF FRESNO, a political subdivision of the
State of California, ("County"), and the BIOLA COMMUNITY SERVICES DISTRICT, (the
"District").
WITNESSETH
WHEREAS, the County has been designated as the sponsoring agency to administer and
implement the Community Development Block Grant (CDBG) Program activities of the County and
its participating cities, in accordance with the provisions of Title I of the Housing and Community
Development Act of 1974, as amended, and the laws of the State of California; and
WHEREAS, on April 17, 2018, the County and the District entered into Agreement 18-187
("Agreement"), whereby $250,000 in CDBG funds were made available to the District for the Biola
5th Street Sidewalk and Storm Drain Improvements, Project No. 17031 (the "Project"); and
WHEREAS, the District applied for funding for a second phase of the Project (“Phase II”),
and was designated in the 2018-2019 Annual Action Plan to be the fourth unincorporated area
public facility and infrastructure improvement project to receive funding; and
WHEREAS, sufficient CDBG funds were available during the 2018-2019 program year to
fund the Project; and
WHEREAS, in order to ensure efficiency, the parties desire to amend the existing Project
to include the scope and cost of Phase II.
NOW THEREFORE, in consideration of their mutual promises as hereinafter set forth, the
District and the County agree to amend the Agreement as follows:
1.That the dollar figure set forth on Page 1, Line 16, be amended to read "$550,000."
2.That the proposed Project budget on Page 2, Lines 21 through 23, be amended to
read:
"Construction $450,000
Design & Construction Engineering 60,000
Contingency, Permits & Misc. 40,000
Total $550,000"

3. That the proposed funding summary on Page 3, Lines 3 and 4, be amended to read:
"CDBG $500,000
Local Financial Contribution $ 50,000
Total $550,000"
4. That the dollar figure set forth on Page 1, Line 18, Page 2, Line 26, Page 3, Line
17, and Page 4, Line 20, be amended in each such place to read "$500,000".
County and District agree that this Amendment I is sufficient to amend the Agreement,
and that upon execution of this Amendment I, the Agreement and this Amendment I together
shall be considered the Agreement.
The Agreement, as hereby amended, is ratified and continued. All provisions, terms,
covenants, conditions and promises contained in the Agreement and not amended herein shall
remain in full force and effect.
