(hereinafter "ARAMARK") RECITALS WHEREAS, the County and ARAMARK entered into County Agreement Number A-02-118 dated April 9, 2002; and WHEREAS, the Agreement allows for an adjustment in the scale price Inmate Meal on an annual basis effective July 1 of each year based on the National Consumer Price Index (hereinafter "NCPI"} for the twelve preceding months, not to exceed a cap o 3%; and WHEREAS, the NCPI for the Consumer Price Index Unit for Food away from home has increased 5.1 units between the April2003 level of 181.1 and the April2004 level of 186.2, the difference being 2.8% change from the April20031evel. NOW. THEREFORE, in consideration of their mutual promises, the parties hereto agree to amend the Agreement as follows: 1. Effective July 1, 2004, the agreed upon price per meal of $1.165, as set forth on Amendment I of the Agreement, shall be revised to $1 .188 per meaL 2. Except as amended by this Third Amendment, all other terms of the Agreement remain in full force and effect.
