THE USE OF THE FRESNO COUNTY
FAIRGROUNDS.
) TO EXECUTE AGREEMENT

WHEREAS, the County of Fresno is the owner in fee of all
of the real property situate in the County of Fresno, State of
California, more particularly described as follows:
and
Commencing at a point at the Northeast corner
of the Northwest Quarter of Section 12, Township 14
South of Range 20 East, M.D.B. & M., and running
thence South 160 rods to the Southeast corner of
said Northwest quarter of said Section 12; thence
West along the half section line 100 rods; thence
North 160 rods to the North line of said section;
thence East 100 rods to the place of beginning,
the same being the easterly 100 acres of the
Northwest quarter of Section 12, Township 14 South,
Range 20 East, M.D.B.& M., together with all water
rights appurtenant to or in any way belonging to said
above-described land with all and singular the other
appurtenances thereunto belonging. EXCEPTING THERE-
FROM and RESERVING UNTO the County of Fresno that
portion thereof described as follows:
Commencing at a point where the East line of Chance
Avenue intersects the southerly line of Ventura
Avenue, thence southerly along the East line of
Chance Avenue 332.12 feet; thence North 89°38 1 30~r
East 200.33 feet; thence at right angles northerly
331.35 feet to the South line of Ventura Avenue,
thence westerly along Ventura Avenue approximately
201.46 feet to the point of beginning;
WHEREAS, by lease dated March 16, 1948, as modified by
that certain document entitled "Modification of Lease'r, executed
April 23, 1957, the County has leased to the 21st District Agri-

said hereinabove-described real property, for use in connection
with the purposes of said lease; and
WHEREAS, the Fresno Metropolitan Flood Control District
desires to excavate and use a portion of the infield of said race
track, designated as "Retention Basin11 on that certain diagram
attached to the Agreement approved by this Resolution, containing
25 acres, more or less, for the purpose of transporting to and
impounding therein flood, storm, drainage and waste waters, all
under the terms and conditions hereinafter set forth; and
WHEREAS, the County and the Association desire to have
said retention basin area excavated and to use the same as an
automobile parking area and for other purposes when it is not in
use for the retention of flood, storm, drainage and waste waters
by the District; and

WHEREAS, it is to the best interests of the parties hereto!

that such multiple use be made of said retention basin area; !
NOW, THEREFORE, BE IT RESOLVED that the Agreement between I
County of Fresno, the Fresno Metropolitan Flood Control Distri~t the
and the 21st District Agricultural Association, dated the 6th day
of April, 1971, setting forth the terms and conditions for which
such property can be used by each of the parties hereto and the
consideration therefor, be and it is hereby approved.

BE I~ FURTHER RESOLVED that the Chairman of this Board is I
hereby authorized to execute said Agreement on behalf of the Countt
of Fresno.
THE FOREGOING RESOLUTION was passed and adopted this 6th
day of April, 1971, by the following vote of the Board of Super-
visors of the County of Fresno, to wit:
