4 AMENDMENT NO. 2 TO AGREEMENT
5 Under that certain Agreement dated January 11, 2005, and as amended on August 23, 2005, by
6 and between the County of Fresno, a political subdivision of the State of California, hereinafter referred
to as "COUNTY" and GOLDEN BY PRODUCTS, DBA SCRAP TIRE COMPANY, whose address is
7
P.O. Box 1, 13000 Newport Road, Ballico, CA 95303, hereinafter referred to as "CONTRACTOR", the
8
CONTRACTOR agreed to provide waste tire hauling services as needed per the terms set forth in said
9
Agreement; and
10 WHEREAS, the CONTRACTOR has made a written request to increase the rates shown on
11 pages 22 and 23 of Attachment 'A' to the Agreement, Quotation No.988-4010; and
12 WHEREAS, it is desired to increase the annual maximum compensation amount from
13 $135,000.00 to $143,000.00; and
14 WHEREAS, the CONTRACTOR has kept his prices firm for the past year and the COUNTY
15 realizes that fuel and other operating costs have increased since the execution of the agreement; and
16 WHEREAS, the COUNTY is satisfied with the service provided by Contractor and does not feel
17 that it would be beneficial to the County to re-bid for these services; and
18 WHEREAS, an Amendment to the Agreement is necessary to provide for the proposed change.
NOW, THEREFORE, in consideration of their mutual promises, the parties hereto agree to

amend the Agreement as follows:

Page 1, line 15 add: "4) Caruthers (Area 5) Marks & Elkhorn Storage Site."
21 Page 4, lines 1 through 6: Revise for Maintenance & Operations maximum service from
22 $35,000.00 to $41,500.00, add Sheriffs Department maximum service $6,500.00, and amend total
23 maximum service from $130,000.00 to $143,000.00.
24 Page 4, lines 7 and 8 are deleted and replaced with "In no event shall the total maximum
25 service amount exceed $143,000 in any single year".

1 Pages 22 and 23 of Quotation No. 988-4010, schedules "A" and "B", are deleted and replaced
2 with pages 22-A and 23-A attached hereto as Attachment 'B-1' and 'B-2'.
3 It is the intent of the parties that this amendment is effective January 10, 2006, and that all other
4 provisions of the Agreement remain unchanged.
