3 THIS AMENDMENT I TO AGREEMENT No. 05-513, hereinafter referred to as
4 Amendment I, made this - � 0 day of Jcic�( , 2005, by and between the
5 COUNTY OF FRESNO, a political subdivision of the State of California, hereinafter
6 referred to as the "County", and the CITY OF SANGER, hereinafter referred to as the
7 "City"
8 WITNESSETH
9 WHEREAS, the County has been designated as the sponsoring agency to
10 administer and implement the Community Development Block Grant (CDBG) Program
11 activities of the County and its participating cities, in accordance with the provisions of
12 Title I of the Housing and Community Development Act of 1974, as amended, and the
13 laws of the State of California; and
14 WHEREAS, on October 11, 2005, the County and the City entered into an
15 Agreement, hereinafter referred to as the "Agreement", whereby CDBG funds were
16 made available to the City for the Sanger Community Center Improvements Phase ill
17 Project No. 05066, located in the City of Sanger; and
18 WHEREAS, additional funds are needed to offset anticipated increases in
19 construction costs; and
20 WHEREAS, the City has requested that the project budget be increased from
21 $316,346 to $350,765; and
22 WHEREAS, the City now has $34,419 of unprogrammed funds available from
23 completed projects, which can be made available to the Sanger Community Center
24 Improvements Phase III Project No. 05066, and the City desires to utilize these funds
25 for this project.
26 NOW THEREFORE, in consideration of their mutual promises as hereinafter set
27 forth,)the County and the City agree to amend the Agreement as follows:
28 1 . That the sum of $316,346 set forth on Page 1, line 18; Page 3, line 21;

` I and Page 4, Line 12, be amended to read "$350,765".
2 2. That the sum of $332,000 set forth on Page 1, line 17 be amended to
3 read "$350,765".
4 3. That the project budget summary set forth on Page 3, Lines 3 through 6
5 be amended to read:

7 "Construction $284,765
Design & Construction Engineering 45,000
8 Contingency & Permits 21,000
TOTAL $350,765"

10 4. That the funding source summary set forth on Page 3, Lines 12 through
11 14 be amended to read:

"CDBG $350,765
13 Local -0-
14 Total $350,765"
15 County and City agree that this Amendment 1 is sufficient to amend the
16 Agreement and, that upon execution of this Amendment I, the Agreement and this
17 Amendment I together shall be considered the Agreement.
18 The Agreement, as hereby amended, is ratified and continued. All provisions,
19 terms, covenants, conditions and promises contained in the Agreement and not
20 amended herein shall remain in full force and effect.
