SUBJECT: Record Consistency - Agreement with Cal OES - County Victim Services (XC),
Legistar File ID 23-1076
On January 9, 2024, the Board of Supervisors approved a grant agreement with California
Governor's Office of Emergency Services (Cal OES) for the County Victim Services
Program of the Fresno County Probation Department. This grant agreement is noted in
the County's records by the County-assigned agreement number A-24-027 and is
referenced as Grant Subaward # XC23 06 0100 by Cal OES. Due to the fact that this is a
grant agreement with the State of California, the Chairman provided the initial authorized
County signature to the agreement, which was then sent it to the State to be fully
executed.
On April 15, 2024, the Probation Department received the fully executed grant Agreement
from Cal OES and promptly forwarded it to the Office of the Clerk of the Board of
Supervisors. Subsequently, on April 17, 2024, the Office of the Clerk contacted Probation
regarding apparent discrepancies between the original grant agreement signed by the
Chairman, and the executed agreement received from the State. In discussion between
Probation and the Office of the Clerk, Probation clarified that the differences made to the
grant agreement were due to standard changes made by the State during the finalization
process of Cal OES.
At the request of the Office of the Clerk, a memorandum addressed to the Clerk of the
Board of Supervisors is being submitted, to ensure that any discrepancies between the
agreement approved by the Board and the fully executed agreement received from the
grantor are identified. This memorandum will be uploaded to the Granicus file as part of
the grant agreement record.
Please see the identified differences below:

no longer an application it has become an agreement.

Additionally, this memo serves to memorialize the processes being implemented by both
the Office of the Clerk of the Board of Supervisors and the Probation Department to
ensure Board document consistency and transparency.

1. Required Audits and Financial Statements (SRH Section 14.005)
Subrecipients expending $750,000 or more in federal funds annually must comply
with the single audit requirement established by the Federal Office of
Management and Budget (OMB) Uniform Guidance 2 C.F.R. Part 200, Subpart F

scope of an appropriations or law restriction, Subrecipients are to contact Cal OES

for guidance, and may not proceed without the express prior written approval of
Cal OES.
3. Applicability of Part 200 Uniform Requirements
The Uniform Administrative Requirements, Cost Principles, and Audit Requirements in
2 C.F.R. Part 200, as adopted and supplemented by the DOJ in 2 C.F.R. Part 2800
(together, the "Part 200 Uniform Requirements") apply to this Grant Subaward.
The Part 200 Uniform Requirements were first adopted by DOJ on December 26,
2014. If this FY 2022 Grant Subaward supplements funds previously awarded by OJP
under the same Grant Subaward number (e.g., funds awarded during or before
December 2014), the Part 200 Uniform Requirements apply with respect to all funds
under that award number (regardless of the award date, and regardless of whether
derived from the initial Grant Subaward or a supplemental Grant Subaward) that are
obligated on or after the acceptance date of this FY 2022 award.

relate to OJP awards and subawards ("subgrants"), see the OJP website at

Record retention and access: Records pertinent to the Grant Subaward that the
Subrecipient (and any Second-Tier Subrecipients) must be retained for a period of
seven years after the Subrecipient makes final payments and all other pending
matters are closed, unless a different retention period applies. Subrecipients (and
any Second-Tier Subrecipients) must provide access to performance measurement
information, financial records, supporting documents, statistical records, and other
pertinent records indicated at 2 C.F.R. 200.334.
In the event that an Grant Subaward-related question arises from documents or
other materials prepared or distributed by OJP that may appear to conflict with, or
differ in some way from, the provisions of the Part 200 Uniform Requirements, the
Subrecipient is to contact Cal OES promptly for clarification.
4. Requirement to Report Actual or Imminent Breach of Personally Identifiable
Information
Subrecipients (and any Second-Tier Subrecipients) must have written procedures in
place to respond in the event of an actual or imminent "breach" (OMB M-17-12) if
they:
• Create, collect, use, process, store, maintain, disseminate, disclose, or dispose of
"Personally Identifiable Information (PII)" (2 C.F.R. 200.1 ) within the scope of an
OJP grant-funded program or activity, or
• Use or operate a "Federal information system" (OMB Circular A-130).

Subrecipients (and any Second-Tier Subrecipients) must have breach procedures
that must include a requirement to report actual or imminent breach of PH to
Cal OES no later than 24 hours after an occurrence of an actual breach, or the
detection of an imminent breach.
5. OJP Training Guiding Principles
Subrecipients (and any Second-Tier Subrecipients) understand and agree that any
training or training materials developed or delivered with funding under this Grant
Subaward must adhere to the OJP Training Guiding Principle for Grantee and
Subgrantees, available at https://www.ojp.gov/funding/implement/training-guiding-
principles-grantees-and-subgrantees.
6. Compliance with DOJ Regulations Pertaining to Civil Rights and Nondiscrimination -
28 C.F.R. Part 38
Subrecipients (and any Second-Tier Subrecipients) must comply with all applicable
requirements of 28 C.F.R. Part 38 (as may be applicable from time to time),
specifically including any applicable requirements regarding written notice to
program beneficiaries and prospective program beneficiaries.
Among other things, 28 C.F.R. Part 38 includes rules that prohibit specific forms of
discrimination on the basis of religion, a religious belief, a refusal to hold a religious
belief, or refusal to attend or participate in a religious practice. Part 38 also sets out
rules and requirements that pertain to Subrecipient organizations (and any Second-
Tier Subrecipient organizations) that engage in or conduct explicitly religious
activities, as well as rules and requirements that pertain to Subrecipients (and any
Second-Tier Subrecipients) that are faith-based or religious organizations.

requirements of 28 C.F.R. Part 54, which relates to nondiscrimination on the basis of
sex in certain "educational programs."
9. Compliance with 41 U.S.C. 4712 (including prohibitions on reprisal; notice to
employees)
Subrecipients (and any Second-Tier Subrecipients) must comply with, and are
subject to, all applicable provisions of 41 U.S.C. 4712, including all applicable
provisions that prohibit, under specified circumstances, discrimination against an
employee as reprisal for the employee's disclosure of information related to gross
mismanagement of a federal grant, a gross waste of federal funds, an abuse of
authority relating to a federal grant, a substantial and specific danger to public
health or safety, or a violation of law, rule, or regulation related to a federal grant.
Subrecipients (and any Second-Tier Subrecipients) also must inform their employees,
in writing (and in the predominant native language of the workforce), of employee
rights and remedies under 41 U.S.C. 4712.
10. Compliance with Applicable Rules Regarding Approval, Planning, and Reporting of
Conferences, Meetings, Trainings, and Other Events
Subrecipients (and any Second-Tier Subrecipients) must comply with all applicable
laws, regulations, policies, and official DOJ guidance (including specific cost limits,
prior approval and reporting requirements, where applicable) governing the use of
federal funds for expenses related to conferences (as that term is defined by DOJ),
including the provision of food and/or beverages at such conferences, and costs of
attendance at such conferences.

11. Requirement for Data on Performance and Effectiveness under the Grant Subaward
Subrecipients (and any Second-Tier Subrecipients) must collect and maintain data
that measure the performance and effectiveness of work under this Grant
Subaward. Subrecipients (and any Second-Tier Subrecipients) must provide data
(within the required timeframes) to OJP via the Performance Measurement Tool
(PMT).

12. Determination of Suitability to Interact with Participating Minors
This condition applies to the Grant Subaward (if it is indicated) when some or all of
the activities to be carried out under the Grant Subaward (whether by Subrecipients,
or Second-Tier Subrecipients) is to benefit a set of individuals under 18 years of age.
Subrecipients (and any Second-Tier Subrecipients) must make determinations of
suitability before certain individuals may interact with participating minors. This
requirement applies regardless of an individual's employment status.

13. Compliance with DOJ Grants Financial Guide

"DOJ Grants Financial Guide" available at
https://ojp.gov/financialguide/DOJ/index.htm), including any updated version that
may be posted during the period of performance. Subrecipients agree to comply
with the DOJ Grants Financial Guide.
14. Encouragement of Policies to Ban Text Messaging while Driving
Pursuant to Executive Order 13513, "Federal Leadership on Reducing Text Messaging
While Driving," 74 Fed. Reg. 51225 (October 1, 2009), the DOJ encourages
Subrecipients (and any Second-Tier Subrecipients) to adopt and enforce policies
banning employees from text messaging while driving any vehicle during the course
of performing work funded by this Grant Subaward, and to establish workplace
safety policies and conduct education, awareness, and other outreach to decrease
crashes caused by distracted drivers.
15. Potential Imposition of Additional Requirements
Subrecipients (and any Second-Tier Subrecipients) agree to comply with any
additional requirements that may be imposed by the DOJ awarding agency (OJP or
OVW, as appropriate) during the period of performance for this Grant Subaward, if
Subrecipients are designated as "high-risk" for purposes of the DOJ high-risk grantee
list.

16. Employment Eligibility Verification for Hiring under the Grant Subaward
a. Subrecipients (and any Second-Tier Subrecipients) must:
1 ) Ensure that, as part of the hiring process for any position within the United
States that is or will be funded (in whole or in part) with Grant Subaward funds,
Subrecipients (and any Second-Tier Subrecipients) properly verify the
employment eligibility of the individual who is being hired, consistent with the
provisions of 8 U.S.C. 1324a(a)(1 ).
2) Notify all persons associated with Subrecipients (or any Second-Tier
Subrecipients) who are or will be involved in activities under this Grant
Subaward of both:
a) This Grant Subaward requirement for verification of employment eligibility,
and
b) The associated provisions in 8 U.S.C. 1324a(a)(1 ) that, generally speaking,
make it unlawful, in the United States, to hire (or recruit for employment)
certain aliens.
3) Provide training (to the extent necessary) to those persons required by this
condition to be notified of the Grant Subaward requirement for employment
eligibility verification and of the associated provisions of 8 U.S.C. 1324a(a)(1 ).
4) As part of the recordkeeping for the Grant Subaward (including pursuant to
the Part 200 Uniform Requirements), maintain records of all employment
eligibility verifications pertinent to compliance with this Grant Subaward
condition in accordance with Form 1-9 record retention requirements, as well
as records of all pertinent notifications and trainings.
b. Monitoring
Subrecipients' monitoring responsibilities include monitoring Second-Tier
Subrecipients' compliance with this condition.
c. Allowable costs
To the extent that such costs are not reimbursed under any other federal
program, Grant Subaward funds may be obligated for the reasonable,
necessary, and allocable costs (if any) of actions designed to ensure compliance
with this condition.

For purposes of this condition, persons "who are or will be involved in activities

2) Employment eligibility confirmation with E-Verify
For purposes of satisfying the requirement of this condition regarding
verification of employment eligibility, Subrecipients (and any Second-Tier
Subrecipients) may choose to participate in, and use, E-Verify (www.e-
verify.gov), provided an appropriate person authorized to act on behalf of the
Subrecipient (and any Second-Tier Subrecipient) uses E-Verify (and follows the
proper E-Verify procedures, including in the event of a "Tentative
Nonconfirmation" or a "Final Nonconfirmation") to confirm employment
eligibility for each hiring for a position in the United States that is or will be
funded (in whole or in part) with Grant Subaward funds.
3) "United States" specifically includes the District of Columbia, Puerto Rico,
Guam, the Virgin Islands of the United States, and the Commonwealth of the
Northern Mariana Islands.
4) Nothing in this condition shall be understood to authorize or require
Subrecipients (and any Second-Tier Subrecipients), or any person or other
entity, to violate any federal law, including any applicable civil rights or
nondiscrimination law.
5) Nothing in this condition, including in paragraph 4.B., shall be understood to
relieve Subrecipients (and any Second-Tier Subrecipients) or any person or
other entity, of any obligation otherwise imposed by law, including 8 U.S.C.
1324a(a)(1 ).

17. Restrictions and Certifications Regarding Non-disclosure Agreements and Related
Matters

entity that receives a procurement contract or subcontract with any funds under this
Grant Subaward, may require any employee or contractor to sign an internal
confidentiality agreement or statement that prohibits or otherwise restricts, or
purports to prohibit or restrict, the reporting (in accordance with law) of waste, fraud,
or abuse to an investigative or law enforcement representative of a federal
department or agency authorized to receive such information.
The foregoing is not intended, and shall not be understood by the agency making

this Grant Subaward, to contravene requirements applicable to Standard Form 312
(which relates to classified information), Form 4414 (which relates to sensitive
compartmented information), or any other form issued by a federal department or

a. In accepting this Grant Subaward, Subrecipients (and any Second-Tier
Subrecipients):
1 ) Represent that they neither require, nor have required, internal confidentiality
agreements or statements from employees or contractors that currently
prohibit or otherwise currently restrict (or purport to prohibit or restrict)
employees or contractors from reporting waste, fraud, or abuse as described
above; and
2) Certify that, if they learn, or are notified, that they have, or have been,

considers a "Grant Subaward" (and therefore does not consider a procurement
"contract").

19. Requirements Related to System for Award Management and Universal Identifier
Requirements

accessible at https://www.sam.gov/. This includes applicable requirements
regarding registration with SAM, as well as maintaining the currency of information in
SAM.
Subrecipients also must comply with applicable restrictions for Second-Tier
Subawards, including restrictions on Grant Subawards to entities that do not acquire
and provide (to Subrecipients) the unique entity identifier required for SAM
registration.

This condition does not apply to a Grant Subaward to an individual who received

20. Restrictions on "Lobbying"
In general, as a matter of federal law, federal funds awarded by OJP may not be
used by Subrecipients (and any Second-Tier Subrecipients), either directly or
indirectly, to support or oppose the enactment, repeal, modification, or adoption of
any law, regulation, or policy, at any level of government. See 18 U.S.C. 1913. (There
may be exceptions if an applicable federal statute specifically authorizes certain
activities that otherwise would be barred by law.)
Another federal law generally prohibits federal funds awarded by OJP from being
used by Subrecipients (and any Second-Tier Subrecipients), to pay any person to
influence (or attempt to influence) a federal agency, a Member of Congress, or
Congress (or an official or employee of any of them) with respect to the awarding of

a) How the line items on the Grant Subaward Budget Pages (Cal OES Form
2-106a) support the objectives and activities?
The Victim/Witness Advocate positions will provide case management
services as well as the thirteen mandatory and all ten optional services outlined in
Penal Code Section 13835 to the identified population of this grant. In addition,
the Advocates will provide training to law enforcement agencies within Fresno
County regarding the available services provided by this grant and how to
access the services. These services, which are also provided to victim family
members and witnesses of crimes include: advising participants of the program
services and outreach activities, referring program participants to professional
care providers, explaining the process of the criminal justice system,
accompanying victims, family members, and witnesses to court and related
hearings, and assisting participants with claim applications.
The Deputy Probation Officer will conduct follow-ups with identified
victims, review the orders of the court, the offender's case file, serve as a liaison
with the District Attorney's Office, and guide the victim through the court process
regarding matters of restitution. This position will be specific to the XC Grant
program.

Problem Statement:
Priority for funding continues to be enhancing services to crime victims in the rural
communities of Fresno County through more efficient and effective services
including immediate and extended (emergency) housing, transportation, and
restitution assistance, as previously identified by the Fresno County Victims
Services Steering committee (VSSC). The focus will have an immediate impact in
terms of providing more efficient, effective, and valuable services and be an
important step in minimizing harm to all crime victims.
Plan:

Gap Number 1 : Services to Rural Crime Victims
The need for services to rural communities continues. Some areas of
Fresno County are located an hour from the City of Fresno where the
majority of social services and justice programs are located. Enhanced
services to rural communities and towns will allow victim advocates to
facilitate mandated and optional services pursuant to PC Section 13835
and provide more efficient processing of CalVCB applications and services.

CVAC now has the capability of assisting rural clients remotely to fill out the
State of California Victim Compensation Board (Cal VCB) applications
through the use of their wed-based, secure portals for both victims and
advocates. The portals are utilized to complete the application, track the
status of the claim, and upload needed documents directly to Cal VCB.
This process has increased the efficiency and timeliness of application
submittal.
Gap Number 2: Immediate and Extended (Emergency) Housing
There is a continued need for immediate and extended emergency
housing for victims of domestic violence, sexual assault, and human
trafficking.
Many times, victims lose their homes and possessions as a result of a
crime. The criminal justice system may be an extended process with victims
requiring immediate emergency housing assistance, until a more permanent
solution can be achieved. Through current XC grant funds, CVAC has
developed a housing network throughout the county that allows for victims
to be accommodated for up to 90 days, while permanent plans can be
developed and implemented in conjunction with our community-based
partners. CVAC has developed and implemented a comprehensive

emergency housing process to accommodate the needs of crime victims
who are without shelter or in need of relocation.
In addition, CVAC has established a referral process with three after-
hours crisis service providers in the community that assists victims of domestic
violence, sexual assault, and human trafficking. Should those crisis service
providers be unable to assist with the victims' immediate emergency housing
and/or transportation need, they refer the victim to CVAC, requesting
assistance.
Gap Number 3: Accessible Victim Transportation
There is a continued need for accessible transportation for victims of
domestic violence, sexual assault, and human trafficking. Transportation is a
high priority in terms of safety and security for victims.
The CVAC has developed transportation options consisting of taxicab
services, local public transportation bus passes, as well as utilizing gas gift
cards for crime victims residing in both the metropolitan and rural areas of
Fresno County. This varied approach allows for more options for those in
need than previously available.

3. The plan to sustain and/or integrate these services into the existing victim
services structure beyond the Grant Subaward performance period.
If funding is not available beyond the grant Subaward
performance period, it is likely the clients served by this grant will be
served by the Cal OES Victim Witness Assistance Program, recognizing this
will be difficult since the Victim Witness Assistance Program is already
operating at full capacity. Specialized caseloads dedicated to
address the identified gaps in services will be eliminated. At this
time, no alternative funding source has been identified to continue
providing the services of this grant, however, the Fresno County Probation
Department will continue to search for alternative funding sources.
4. How volunteers will be utilized and in what capacity.
Volunteers are recruited from the community and local colleges to
augment paid staff time and increase services available to victims. The
Fresno County Probation Department completes a background
investigation on each volunteer which includes: application and
background information, DMV check, local criminal record check, and a
LIVESCAN fingerprint check through the Department of Justice. Upon
clearance of the background investigation, each volunteer receives a

Probation Volunteer Identification Badge which authorizes the start of
volunteer service. The CVAC staff provides an initial orientation and assigns
each volunteer to a full-time VWA for ongoing supervision and training.
Volunteers document their hours for each shift worked on the Volunteer
Log, which is signed by the supervising VWA and maintained for audit
purposes. Typical duties of a volunteer include: transportation of police
reports from law enforcement to the VWA, reception duties, assisting the
VWA with completing the Victim Compensation Application process,
assisting at community presentations and events, and other duties
depending on the training and personal abilities of each volunteer.
5. With written consensus from the VSSC, funds may be sub- awarded through
Second Tier Subawards, to other victim service providers. If applicable,
indicate the direct services the Second Tier Subrecipients will provide.

The XC Program provides crime victims with immediate and extended housing,essentials such as food and hygiene items,accessible
transportation throughout Fresno County,and extends services in the rural areas of Fresno County. In addition,after-hours call services are
made available. Services provided by the Victim Witness Advocate include referring to professional care providers and accompanying
victims and family members to court. The Deputy Probation Officer serves as liaison and guides the victims on matters of restitution.
7. Describe practical/logistical obstacles and/or local resource constraints to providing
match:
The County is not yet one year removed from the National Emergency Pandemic Period as the federal
COVID-19 Public Health Emergency (PHE) declaration ended on May 11, 2023. The impact on the local,
state, and national economy remains unknown and may be significant.The unknowns in the current
economy and other contributing outside factors could have a significant impact on local resources.
Waiving the Match would permit the County to make additional funding available to help address any
downturn in revenues resulting from the corona virus and any contributing outside factors that would
impact the next fiscal year.The waiver of the Match would free up funding to help address local
funding constraints resulting from the pandemic.
