HomeMy WebLinkAbout15287 AGT.# 06- 00 Z ! 1 AMENDMENT I TO AGREEMENT 2 3 THIS AMENDMENT I TO AGREEMENT No. 04-387, hereinafter referred to as 4 Amendment I, made this 1 ©}h day of 1 c�n�c�cam, 2005, by and between the 5 COUNTY OF FRESNO, a political subdivision of the State of California, hereinafter 6 referred to as the "County", and the CITY OF MENDOTA, hereinafter referred to as the 7 "City" 8 WITNESSETH 9 WHEREAS, the County has been designated as the sponsoring agency to 10 administer and implement the Community Development Block Grant (CDBG) Program 11 activities of the County and its participating cities, in accordance with the provisions of 12 Title I of the Housing and Community Development Act of 1974, as amended, and the 13 laws of the State of California; and 14 WHEREAS, on August 24, 2004, the County and the City entered into an 15 Agreement, hereinafter referred to as the "Agreement", whereby CDBG funds were 16 made available to the City for the Mendota Street, Sidewalks, Curbs, Gutters and 17 Lighting Project No. 04116, located in the City of Mendota; and 18 WHEREAS, additional funds are needed to offset anticipated increases in 19 construction costs; and 20 WHEREAS, the City has requested that the project budget be increased from 21 $211,231 to $235,287; and 22 WHEREAS, the City now has $24,056 of unprogrammed funds available from 23 completed projects, which can be made available to the Mendota Street, Sidewalks, 24 Curbs, Gutters and Lighting Project No. 04116, and the City desires to utilize these 25 funds for this project. 26 NOW THEREFORE, in consideration of their mutual promises as hereinafter set 27 forth, the County and the City agree to amend the Agreement as follows: 2$ 1. That the sum of $211,231 set forth on Page 1, lines 17 and 18; and Page 1 1 3, Lines 8 and 19, be amended to read "235,287". 2 2. That the project budget summary set forth on Page 3, Lines 3 through 5 3 be amended to read: 4 "Construction $184,856 5 Design & Construction Engineering 32,000 6 Contingency & Permits 18,431 TOTAL $235,287" 7 8 3. That the funding source summary set forth on Page 3, Lines 10 through 9 12 be amended to read: 10 "CDBG $235,287 11 Local -0- 12 Total $235,287" 13 4. That the deadline to file the Notice of Project Completion for the project 14 set forth on Page 12, Line 11 , be amended to read "December 31, 2005". 15 County and City agree that this Amendment I is sufficient to amend the 16 Agreement and, that upon execution of this Amendment I, the Agreement and this 17 Amendment I together shall be considered the Agreement. 18 The Agreement, as hereby amended, is ratified and continued.
