Retroactively approve and authorize the Department of Public Health's previous submittal of a grant application to the Regents of the University of California's Davis Campus School of Veterinary Medicine for animal shelter assistance grant funds ($200,000); 2. Approve and authorize the Chairman to execute an Agreement with the Regents of the University of California for the animal shelter assistance grant effective July 1,2024 through June 30, 2025,total not to exceed $200,000; and 3. Approve and authorize the Director of the Department of Public Health, or designee, to be the signatory on behalf of the Board of Supervisors on associated grant agreement documents, expenditure forms and reports. Approval of the first recommended action will authorize the retroactive submission of a grant application to the Regents of the University of California's Davis Campus School of Veterinary Medicine (UC Davis)for grant funds to expand spay and neuter services in the County. It should be noted that the Department of Public Health (Department) learned of this grant opportunity on October 26, 2023. To meet the grant application deadline of November 9, 2023,the Department submitted the application on November 9, 2023 contingent upon your Board's approval. Approval of the second recommended action will allow the County,through the Department, to utilize the grant funding to purchase the necessary equipment and supplies to perform spay and neuter services in the existing exam room at the County animal shelter and subsidize existing spay and neuter services. Approval of the third recommended action will allow the Department of Public Health Director, or designee, to submit required grant items and reports, excluding budget or contract amendments, on behalf of the County. Although the animal shelter is located in District 1, this item is countywide. ALTERNATIVE ACTION(S): There are no viable alternative actions. If your Board does not approve the recommended actions, the County will not be able to utilize awarded grant funds to improve access to spay and neuter services in the County. The grant award will provide$200,000 from July 1, 2024 through June 30, 2025 (FY 2024-25). The grant is non-competitive, and the County is not required to provide matching funds. Sufficient appropriations and estimated revenues will be included in the Department's Org 5620 FY 2024-25 Recommended Budget. DISCUSSION: The Department currently oversees the County's animal control program, which includes operations at the County's animal shelter located at 1510 W. Dan Ronquillo Drive in Fresno, California. When the animal shelter site was constructed, County staff had the foresight to include an exam room in the North building on the property("Building 3")with the intent to provide in-house veterinary services. To provide veterinary medicine, including spay and neuter services, the exam room in Building 3 must meet the requirements outlined in Title 16 of the California Code of Regulations, Section 2030- Minimum Standards- Fixed Veterinary Premises. On October 26, 2023, Department staff received notification from UC Davis regarding the grant opportunity and submitted the application on November 9, 2023. At the time of submission, the application proposed funding a low-cost spay and neuter pilot project and subsidizing the spay and neuter costs incurred by the County's animal control services vendor, Fresno Humane Animal Services (FHAS), for the shelter population. Since November 9, 2023, the County has entered into an agreement with the Kirkland Foundation for a low-cost spay and neuter pilot project, and the Department is working with the County Administrative Office to identify any gaps in funding provided to FHAS. UC Davis is amenable to how the County decides to spend the grant funding, so long as the efforts support spay and neuter services. On February 14, 2024, UC Davis notified the Department of the grant award and requested information to complete the grant agreement. The Department received the first draft of the grant agreement on February 16, 2024, and returned it to UC Davis with edits. The revised agreement was sent to the Department on March 7, 2024. Additional clarification regarding the agreement language was requested from UC Davis and the final piece of information was provided on May 21, 2024. During this time, Department staff met internally and consulted with industry experts to determine the most effective and sustainable use of funds, considering current resources, industrywide challenges, and local needs. The recommended revenue agreement varies from County standard language in that the County agrees to indemnify, defend, and save harmless UC Davis; the County agrees to waive all claims and recourse against UC Davis for all matters, except when caused by or the result of negligent or intentional acts or omissions, connected with or incident to this recommended agreement. If approved by your Board, grant funds will be used to subsidizing existing spay and neuter services, purchase the equipment and supplies necessary to comply with Section 2030 of the California Code of Regulations and secure a premise permit to provide veterinary medicine at the County animal shelter. Construction costs are not an allowable cost under this grant; therefore, the Department will explore other grants and funding options for any construction costs. Currently, the Department is aware of one project that involves constructing a wall in the exam room pursuant to California Code of Regulations, Section 2030(g)(1), which is required to perform spay and neuter services. Alexander, Jr. County of Fresno Page 3 File Number.24-0318 Agreement No. 24-325 UC Davis Agreement#UCDP000033147 SHELTER SERVICES AGREEMENT (County of Fresno) THIS SHELTER SERVICES AGREEMENT("Agreement") is made and entered into as of the date last signed below by and between THE REGENTS OF THE UNIVERSITY OF CALIFORNIA ("University") on behalf of its Davis Campus School of Veterinary Medicine on behalf of its Koret Shelter Medicine Program ("Facility") and COUNTY OF FRESNO ("Shelter") in connection with the California for All Animals statewide animal shelter assistance program ("Program"). The parties agree as follows: 1. Shelter Services. Shelter shall adhere to the scope of work described in "Exhibit A", attached hereto and by this reference made a part hereof(collectively the "Services"). University shall reimburse Shelter for costs ("Expenses") pursuant to Section 2 below and as outlined in Exhibit A. "Deliverables" shall consist of report(s) and photographs, as applicable, as more fully described in Exhibit A. Additional work shall be performed only if authorized in advance by written amendment to this Agreement executed by both parties. To the extent that any provision of Exhibit A is inconsistent with this Agreement,this Agreement shall take precedence. 2. Payment by University. In consideration of Shelter's Expenses as described in Exhibit A,Facility shall pay Shelter an amount not to exceed$200,000 upon invoice from Shelter and final signature of this Agreement. Services shall be rendered from July 1,2024 through June 30, 2025. 4. Endorsement Disclaimer. Nothing in this agreement shall be interpreted to indicate, imply, or otherwise suggest(i) that University supports, endorses, favors, or advances, any product or service offered, connected, or affiliated with Shelter; or(ii)that University endorses, favors, supports, or opposes, any proposal,measure,program of action, campaign, or public appeal that is advocated,promoted, advanced, or opposed by any other person or entity with respect to the subject matter presented by Shelter. 5. Amendment. This Agreement may be amended at any time by amendment in writing and signed by the parties, and no other change in any term or condition shall be valid or binding unless made by amendment. 6. Mutual Indemnification. The parties agree to defend, indemnify and hold one another harmless from and against any and all liability, loss, expense, attorneys' fees, or claims for injury or damages arising from the performance of this agreement, but only in proportion to and to the extent such liability, loss, expense, attorneys' fees, or claims for injury or damages UCD#UCDP000033147 1 of are caused by or result from the negligent or intentional acts or omissions of the indemnifying party, its officers, agents, students, or employees. 7. Insurance. The parties at their own respective costs shall carry sufficient insurance, or programs of self-insurance (general liability, workers' compensation, and auto liability), adequate to cover any claims arising from their respective activities under this Agreement. 8. Force Majeure. Neither party shall be liable for damages suffered by the other party because of University's or Shelter's failure to perform if failure is due to any cause beyond that party's control. 9. Relationship of the Parties. The parties to this Agreement shall be and remain at all times independent contractors, neither being the employee, agent, or representative of the other in their relationship under this Agreement. 10. Use of University's Name. Shelter shall not use the name or mark of University in any form or manner in advertisements, reports, or other information released to the public without the prior written approval of University. 11. Contract Compliance. As applicable, if this Agreement is funded wholly or in part with by a grant or contract from an agency of any state or federal government, Shelter shall comply with all terms and conditions applicable to recipients of such funds and their contractors. 12. Notice. University's Right to Use Data. Shelter warrants that it is not excluded from participation in any governmental sponsored program, including,without limitation,the Medicare, Medicaid, or Champus programs (http://exclusions.oig.hhs.gov/search.htmi)and the Federal Procurement and Nonprocurement Programs (https://www.Sam.gov/index.htm1/##11#1). This agreement shall be subject to immediate termination in the event that Shelter is excluded from participation in any federal healthcare or procurement program. 16.Audit Requirements. The Agreement, and any pertinent records involving activities related to the services provided pursuant to the terms and conditions of this Agreement, shall be subject to the examination and audit of the California State Auditor and any other duly authorized agents of the State of California for a period of three(3) years after the date of final payment hereunder. Shelter hereby agrees to make all such records available during normal business hours to inspection,audit and reproduction by University and any duly authorized local, state and/or federal agencies. Any and all examinations and audits conducted hereunder shall be strictly confined to those matters connected with the performance of this Agreement, including,without limitation,the costs associated with the administration of this Agreement. 17.Termination. University may terminate this Agreement at any time by giving Shelter thirty (30) calendar days' written notice of such action. If this Agreement is terminated, Shelter shall retain any funds expended or committed for the purposes of this Agreement and will return any unexpended funds. 18. Entire Agreement. This Agreement constitutes the entire understanding of the parties respecting the subject matter hereof and supersedes any prior understanding or agreement between them, written or oral, regarding the same subject matter. Purpose of the work: County of Fresno will receive funding for subsidized spay/neuter. 2. Roles and responsibilities of each party: County of Fresno will provide historical data from 2019 to 2023, and annual data through 2026 to UC Davis Koret Shelter Medicine Program in support of the California for All Animals (CA4AA)program. KSMP will support the shelter to comply with data requirements. No University equipment will be used. 3. Dates and times will the work be completed: Work will be completed during the contract period of July 1, 2024 through June 30, 2025. 4. Location where work will be performed: 1510 W. Dan Ronquillo Drive, Fresno, 93706 5. Required deliverables: One final report will be required upon completion of the program. Additional touch points during the grant will be discussed with project officer. UCD#UCDP000033147 4 of 4 FOR ACCOUNTING USE ONLY: Acct: 3530 Fund: 0080 Org: 1156 Subclass: 17356 The Regents of the University of California Davis Campus School of Veterinary Medicine Shelter Assistance Program Grant Application for Fresno County Summarize the Project or Program Fresno County Department of Public Health, in partnership with community-based organization(s), will coordinate a low-cost spay and neuter pilot project for cats and dogs in the small communities and unincorporated areas in Fresno County. The Department of Public Health (DPH) will provide project oversight, coordinate with the selected community-based organization(s) and compile outcomes data. This additional funding will be utilized by the County of Fresno to supplement the activities of our Animal Control Services vendor, Fresno Humane Animal Services (FHAS). The lack of affordable spay/neuter services for our small communities and unincorporated areas has created an over population of cats and dogs. This crisis is countywide and needs to be addressed by multiple avenues so that this issue may be addressed. The over population of cats and dogs in these communities and unincorporated areas is problematic since it creates numerous issues such as copious amounts of dogs at large and many homeless pets. The over population of animals puts an extreme amount of pressure on the services that can be provided by our Animal Control vendor, FHAS, and the Fresno County Animal Shelter that must maintain crucial space for sick and injured animals. The Objective • Need #1: Reduce pet overpopulation. • Need #2: Spay and neuter services to residents of rural County communities and unincorporated areas. • Need #3: Affordable rabies vaccinations. The Opportunity • Goal #1: Offer low-cost spay and neuter services to residents of rural communities and unincorporated areas of the County. • Goal #2: Increase access to spay and neuter services for residents of rural County communities and unincorporated areas. • Goal #3: Provide low-cost rabies vaccines. The Solution • Recommendation #1: Coordinate with a community-based organization(s) to fulfill project goals, with DPH's oversight. • Recommendation #2: The community-based organization(s) will be required to arrange transportation for rural County residents who are unable to transport their pet to and from the veterinarian's office — OR— subcontract with veterinarians in rural County communities. • Recommendation #3: Rabies vaccinations will be administered during the spay or neuter visit for dogs at least 4 months of age and cats at least 3 months of age. Describe how your request increases capacity for spay/neuter in your community or region and explain who qualifies for services, cost of services and frequency. The County of Fresno contracts with Fresno Humane Animal Services (FHAS) to provide Animal Control Services and animal sheltering. The contract provides $50,000.00 per year for spay and neuter services. FHAS has been fortunate to obtain several grants to supplement the contracted funding amounts; however, the need for low cost spay/neuter services far exceeds the amount of financial resources available. The requested funding amount for the County of Fresno will greatly enhance the spay/neuter financial assistance that will be made available to our small communities and unincorporated areas where many low-income residents live. Transportation to veterinary facilities for these animals will also be offered by community-based organization(s) which will provide this much-needed assistance for rural communities and unincorporated areas that do not have local veterinary services. The transportation of pets from each rural community and other unincorporated areas will be offered at a minimum of one time per month as determined by need. The projected cost for low- income residents for feline spay/neuter services is $20.00 and $40.00 for canine spay/neuter services. What partner/stakeholders are you working with or have you identified (if a new program) Optional We hope to collaborate with the Kirkland Foundation who affiliates with Fresno TNR, Cat House on the Kings, Dogwood Animal Rescue, PetSmart Charities, Petco Foundation, and the Fresno Chafee Zoo. What are your proposed or estimated outcomes (number of surgeries, number of trainings. Etc.)? We propose to Spay/neuter and vaccinate for rabies 6,660 felines and 3504 canines within a two-year time frame. Fresno county plans to establish working relationships with local nonprofit organizations and veterinary practices so that high volume, low cost spay/neuter services for rural County communities and unincorporated areas is readily available. We will also continue to explore additional funding sources so that financial assistance for County communities and unincorporated areas may be maintained and increased as the cost for these services will most likely escalate.
