Dear Mr. Babcock:
This letter shall serve as Notice to Proceed No. 9 for Extra Services, designated as Task 17 as
delineated in a January 8, 2020 proposal received from you and is enclosed for your reference.
These services are to include activities related to reviewing and commenting on the RWQCB
and DTSC versions of the Blue Hills 2H2019 I Annual DMR. The amount for Task 17 is not-to-
exceed $3,200.00. These Tasks are to be in accord with Agreement 17-144. The individual
task budgets are listed in the aforementioned response thusly:

The total project fee is not-to-exceed $90,690.00 based on criteria set forth in the February 23,
2018 through January 8, 2020 proposals from you. Additional fees or expenses will not be
allowed without prior written approval from the Department of Public Works and Planning. The
authorization for this work will follow the conditions outlined in On-Call Specialized Professional
Environmental Consultant Services Agreement between your firm and the County, Agreement
17-144.
When invoicing for Tasks as approved in this notice, please note Agreement number 17-144,

Subject: Proposal-RWQCB DMR & DTSC Second Half 2019 DMR Reviews-Strategic
Compliance Consulting for the Blue Hills Disposal Facility, Fresno County,
California
Dear Mr. Larkin:
At your request, James W. Babcock, Consulting Geologist (Babcock) is pleased to
provide a cost proposal for extra services in support of Resources Division of Fresno
County Public Works & Planning in their regulatory compliance for the Blue Hills Disposal
Facility (BHDF), Fresno County, California.
SCOPE OF WORK
Dr. Babcock, will provide Extra Services to Resources Division staff in review of the two
draft detection monitoring reports (DMRs) being prepared by Stantec Consulting
Services, Inc. (Stantec). There are two separate second half of 2019 DMRs for BHDF
because Department of Toxic Substances Control (DTSC) accepted the new version of
the Groundwater Monitoring Plan (GWMP) I Sampling and Analysis Plan (SAP) with new
reporting requirements, whereas the Regional Water Quality Control Board (RWQCB)
has not accepted the new GWMPISAP and requires the DMR to adhere to the older
GWMPISAP . These different requirements resulted in issuing two separate and distinct
DMRs until the RWQCB prepares updated waste discharge requirements (WDRs).
Babcock reviewed the first half 2019 DMRs and it is assumed that the second half DMRs
will only require limited reviews. This proposal is based on that assumption.
Task 17.1: Extra Services-Review RWQCB 2H 2019 DMR
Babcock will review Stantec's draft RWQCB 2H 2019 DMR and suggest edits and I or
clarifications. I understand that this DMR will follow the guidance and requirements of the
Sampling and Analysis Plan for Corrective Action dated July 2007 prepared by SECOR
and amended in August 2014 by Stantec. The 2014 Amended SAP is the last BHDF
GWMP I SAP approved by the RWQCB. I understand that the draft RWQCB 2H 2019
will be essentially the same as the 1 H 2019 DMR.
Task 17.2: Extra Services-Review DTSC 2H 2019 DMR
Babcock will review Stantec's draft DTSC 2H 2019 DMR and suggest edits and I or
clarifications. I understand that this DMR will follow the guidance and requirements of the

Revised Updated Groundwater Monitoring I Sampling and Analysis Plan for Corrective
Action, dated March 18, 2019 approved by DTSC. I understand that the draft DTSC 2H
2019 will be essentially the same as the 1 H 2019 DMR.
Task 17.3: Project Management and Strategic Consulting
Babcock, will provide on-going project management during the Project, wh ich includes
but is not limited to documentation of project completion, invoicing requirements, and
budget status .
On an as-requested basis, Babcock will provide strategic consulting to assist Resources
Division in managing the regulatory compliance issues at BHDF.
SCHEDULE
We understand that the draft reports need to be finalized and submitted to the RWQCB
and DTSC prior to February 28, 2020. Babcock can complete the reviews by February
14, 2020 if provided draft copies to initiate my reviews by February 7, 2020.
COST ESTIMATE
Babcock proposes to conduct the scope of work for $3,200.00 as delineated in Table 1 -
Cost Estimate.

compliance issues are based on his professional knowledge as an environmental
consultant, and are intended to provide technical guidance to the County of Fresno .
Nothing in this proposal or the resulting reports by Babcock is to be construed as
Babcock providing legal advice or legal opinions. Babcock's comments and
opinions concerning environmental compliance should be reviewed and evaluated
by legal counsel qualified in environmental law. Babcock's comments and opinions
concerning existing or future contracts between County of Fresno and other
individuals I agencies should be reviewed and evaluated by an attorney specializing
in contract law or environmental law, as appropriate.
