2 THIS FIRST AMENDMENT TO AGREEMENT (First Amendment) is made and entered
3 into this ___ day of _______ _, 2019, by and between the County of Fresno
4 (OWNER or COUNTY) and Durham Construction Company, Inc. (CONTRACTOR).
5 WI T N E S S ET H:
6 WHEREAS, the COUNTY and CONTRACTOR entered into an Agreement dated
7 August 7, 2018 identified as Contract Agreement No. 18-J-01, incorporated herein by reference
8 (the Agreement), for CONTRACTOR to provide job order contract services; and
9 WHEREAS, OWNER and CONTRACTOR desire to increase the maximum
1 O compensation payable under the Agreement by an additional $3,400,000 to provide sufficient
11 funds to complete currently needed projects which may be undertaken by CONTRACTOR, as
12 well as any other work orders issued to CONTRACTOR prior to August 7, 2019, pursuant to
13 the Agreement.
14 NOW, THEREFORE, OWNER and CONTRACTOR, agree to amend the Agreement as
15 follows:
16 1.The third sentence of that paragraph of Article IV. "COMPENSATION," on page
17 2, lines 25-30 of the Agreement, beginning with the word ''The" on line 25 and ending with the
18 dollar figure "$1,500,000" on line 30, is hereby deleted in its entirety and replaced with the
19 following sentence:
20 "The Maximum Contract Value is $4,900,000".
21 All other terms, conditions, mutual covenants, and promises contained in the
22 Agreement, shall remain in full force and effect, except as hereinabove amended by this First
23 Amendment. Upon execution of this First Amendment, the Agreement and this First
24 Amendment shall together be considered the Agreement.
