HomeMy WebLinkAboutAgreement A-19-009 with City of Firebaugh.pdf1 2 3 4 5 6 7 8 LEASE AGREEMENT THIS LEASE AGREEMENT ("LEASE") is made and entered into this __ day of ____ _ 2019 ("Effective Date"), by and between the CITY OF FIREBAUGH, a municipal corporation, whose address is 1133 P. St, Firebaugh, CA 93622 ("LESSOR"), and the COUNTY OF FRESNO, a political subdivision of the State of California, whose address is 333 Pontiac Way, Clovis, CA 93612 ("LESSEE"). LESSOR and LESSEE shall also be referred to herein singularly as a "Party" and collectively as "Parties." 1.LEASED PREMISES -LESSOR hereby leases to LESSEE approximately 2,090 square feet of space for LESSEE's exclusive use ("LESSEE Exclusive-Use Area") at the former co urthouse 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 located at 1325 0 Street, Firebaugh, California 93622 ("Premises"), plus access to any areas of the Premises that are used non-exclusively and in common by, or for the common benefit of, the LESSOR or the LESSEE ("Common Area"). LESSOR'S Exclusive-Use Area ("LESSOR'S Exclusive-Use Area"), which is attached as Exhibit B and incorporated by this reference, shall include all areas of the Premises, excluding LESSEE'S Exclusive-Use Area and the Common Area. The Common Area shall include: (i) (ii) (iii) (iv) (v) Hallways, stairwells, elevators, escalators, and restrooms that are not located in either LESSOR'S Exclusive-Use Area or LESSEE'S Exclusive-Use Area; Foundations, exterior walls, load-bearing walls, support beams, exterior windows, the roof, and other structural parts of the Premises; Driveways, walkways, and other means of access over and through the Premises, The parking area; and The installed equipment and systems that serve the Premises generally or the Common Area, including but not limited to the software program that is licensed to the LESSEE for the operation of the building equipment ("Building Equipment"), not including the equipment and systems that exclusively serve the Exclusive-Use Area of only one Party, and the utilities services provided to the Premises, including water, sewer, electricity, and -1- 8th January Agreement No. 19-009 1 IN WITNESS WHEREOF, the parties hereto have executed this LEASE as of the day and year first 2 hereinabove written. 3 4 LESSOR 5 6 7 Benjamin Gallegos, City Manager 8 9 133 P.
