FIRST AMENDMENT TO AGREEMENT FOR ENGINEERING CONSUL TANT
SERVICES
THIS FIRST AMENDMENT TO AGREEMENT FOR ENGINEERING
4 CONSULTANT SERVICES (Agreement No. 13-557, hereinafter called "the
5 AGREEMENT"), is made and entered into this _______ day of
6 ________ , 2018, by and between the County of Fresno, a political subdivision
7 of the State of California (hereinafter called "the COUNTY"), and Cornerstone Structural
e Engineering Group, Inc., (a California Corporation), 986 West Alluvial, Suite 201, Fresno,
9 CA 93711 (hereinafter called "the CONSUL TANT").
10 RECITALS
11 WHEREAS, the CONSUL TANT has been selected to prepare Plans,
12 Specifications, Engineer's Estimate, and to provide other engineering and environmental
13 services required for the design and California Environmental Quality Act and National
14 Environmental Policy Act approval of the Outside Canal Bridge Replacement Project on
15 Russell Avenue, hereinafter referred to as "the PROJECT"; and
16 WHEREAS, the CONSULTANT has been selected in accordance with the
17 COUNTY's Ordinance Code Chapter 4.10 on the selection of architects, engineers, and
18 other professionals to provide the engineering services necessary for the PROJECT.
19 WHEREAS, the AGREEMENT has been extended twice in writing and is currently
20 set to expire by its terms on September 10, 2018; and
21 WHEREAS, completion of the PROJECT has been delayed due to the length of
22 time required to complete the environmental process and right of way acquisition for the
23 PROJECT; and
24 WHEREAS, said delay was not caused by the CONSUL TANT; and
25 WHEREAS, it is in the best interest of the COUNTY to retain the services of the
26 CONSUL TANT to maintain continuity of the design of the PROJECT; and
27 NOW, THEREFORE, the CONSUL TANT and the COUNTY hereby agree to
28 amend the AGREEMENT for the PROJECT as follows:

1 1.Article IV, Section A of the AGREEMENT is hereby deleted and replaced
2 with the following:
3 "A. This First Amendment to the AGREEMENT shall go into effect
4 immediately upon execution by the COUNTY. As hereby amended, the term of the
5 AGREEMENT is hereby further extended by an additional three years and therefore shall
6 expire on September 10, 2021, unless prior to its expiration the term of the
7 AGREEMENT is further extended in writing, for no more than two additional one-year
8 terms, by mutual consent of the Department of Public Works and Planning Director or
9 designee and the CONSUL TANT."
10 2.Article I, Section C of the AGREEMENT is hereby deleted and replaced
11 with the following:
12 "C. The Contract Manager for the COUNTY is Joseph Harrell, Senior
13 Engineer, whose contact information is 2220 Tulare Street, Suite 600, Fresno, CA,
14 93721, 559-600-4534, jharrell@fresnocountyca.gov. From time to time as may be
15 necessary, other COUNTY staff may act in the place of the COUNTY's Contract
16 Manager and exercise all of the responsibilities afforded thereto. The Project Manager
17 for the CONSULTANT will be notified of any changes in the COUNTY's Contract
18 Manager. The Project Manager for the CONSULTANT is Todd Goolkasian, Principal
19 whose contact information is 986 West Alluvial, Suite 201, Fresno, CA, 93711, 559-320-
20 3200, tgoolkasian@cseg.com."
21 3.All other terms and conditions contained in the AGREEMENT are
22 unaffected by this First Amendment to the AGREEMENT and shall remain in full force
23 and effect.
