HomeMy WebLinkAboutAgreement A-12-141-2 with FMAAA Foundation - L-290.pdf2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 Agreement No. 12-141-2 SECOND AMENDMENT TO LEASE AGREEMENT 12-141/L-290 T his Second Amendment to Lease Agreeme nt 12-141/L-290 ("A m e ndment II ") is made and entered into this JD+h day of -~-S,,._1...,'4""""'!e--' 2018, by and between th e County of Fresno, a political subdivision of the State of California , Fresno , California ("LESSEE"}, and the FMAAA FOUNDATION , 3837 North C lark Street , Fresno , CA 93726 ("LE SSOR"). WITNESSETH: W H EREAS, LESSOR and L ESSEE are Parties to that certain Lease Agreem ent 12-141/L-290 ("L EASE"}, dated March 27, 2012, for lease of two (2) office spaces (a total of 2 ,134 square f eet) at the locati on commonly known as the Sierra Building , 2025 E . Dakota Avenue, Fresno, CA 93726 (the "Premises"); and W HEREAS, the LEASE was first amended on Oct o ber 15, 2015 to amend the term of the L EASE and the rent provisions (Amend m ent I); and WHEREAS , L ESSOR and LESSEE desire to revise the provisions of the LEASE pertaining to janitorial servi ces a nd secu r ity services and to modify the monthly rent. NOW, THEREFORE , for good a nd va lu able consideration , the recei pt and adequacy of wh ich is hereby acknowledged, the Parties agree as fo ll ows: 1. Section 3 . "RENT" of this LEASE is deleted in its entire ty and replaced with th e following : "3. RENT: L ESSEE agrees to pay rent t o LESSOR for the Premises , on or about t he first of each month, in the amou nt of $1 ,813.90." 2 . Section 8 "MAINTENANCE" of this LEASE is deleted in its entirety a nd repla ced with the following : "8 . MAINTENANCE-All exterior and interior m a inte n a nce, and repair of air conditioning , heating units , plumbing syst ems, electri cal systems, light ing , landscape, parking lot, park ing lot li ghti ng , roof and other com mon area maintenance is to be the responsibility of the LESSOR. LESSOR covena nts th at th e building will a lways be maintained in a condi tion acceptable for the LESSEE's intended u se of the Premises.
