HomeMy WebLinkAboutAgreement A-16-506-1 with City of Selma.pdf1 2 AMENDMENT I TO AGREEMENT THIS AMENDMENT I TO AGREEMENT, hereinafter referred to as Amendment I, is made 3 this __ day of _____ _, 2017, by and between the COUNTY OF FRESNO, a political 4 subdivision of the State of California, hereinafter referred to as the "County", and the CITY OF 5 SELMA, hereinafter referred to as the "City". 6 WITNESSETH 7 WHEREAS, the County has been designated as the sponsoring agency to administer and 8 implement the Community Development Block Grant (CDBG) Program activities of the County, 9 and its participating cities, in accordance with the provisions of Title I of the Housing and 1 O Community Development Act of 197 4, as amended, and the laws of the State of California; and 11 WHEREAS, on August 9, 2016, the County and the City entered into Agreement 16-506, 12 hereinafter referred to as the "Agreement", whereby $100,000 in CDBG funds were made available 13 to the City for the Selma Ringo Park Improvements, Project No. 16651, hereinafter referred to as 14 the "Project"; and 15 WHEREAS, the City informed the County that the total estimated cost of the Project has 16 increased from $100,000 to $125,000 due to increased construction costs; and 17 WHEREAS, the City now has an additional $25,000 from its allocation of CDBG funds that 18 may be made available to the Project to accommodate the increased construction costs under the 19 Agreement; and 20 WHEREAS, the City has requested these additional CDBG funds in the amount of $25,000 21 be made available to the Project for the purposes of this Agreement. 22 NOW THEREFORE, in consideration of their mutual promises as hereinafter set forth, the 23 City and the County agree to amend the Agreement as follows: 24 1, 25 read: 26 27 28 That the proposed Project budget on Page 2, Lines 17 through 19 be amended to "Construction Design & Construction Engineering Contingency, Permits & Misc. 1 Total $100,000 15,000 10,000 $125,000"

That the proposed funding summary for the Project on Page 2, Lines 25 and 26 be 2 amended to read: 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 "CDBG Local Financial Contribution Total $125,000 a $125,000" 3. That the dollar figure set forth on Page 1, Lines 16 and 17, Page 2, Line 22, Page 3, Line 12, and Page 4, Line 19, be amended in each such place to read "$125,000". All remaining provisions, terms, covenants, conditions, and promises contained in said Agreement, dated August 9, 2016, shall remain in full force and effect.
