HomeMy WebLinkAboutAgreement A-14-118-3 with Corizon Health Inc..pdfAgreement No . 14-118-3 1 AMENDMENT III TO AGREEMENT 2 THIS AMENDMENT, hereinafter referred to as "Amendment III ", is made and entered into 3 this __IDb_ day of _ _:A-"u=g=u=st:.___, 2017 , by and between the COUNTY OF FRESNO, a Political 4 Subdivision ofthe State of California, hereinafter referred to as "COUNTY", and CORIZON 5 HEALTH, INC., a Delaware for-profit corporation , whose address is 103 Powell Court, Brentwood , 6 Tennessee 37027, hereinafter referred to as "CONTRACTOR" (collectively the "parties "). 7 WHEREAS, the parties entered into that certain Agreement, identified as COUNTY Agreement 8 No. A-14-118 , effective June 23 ,2014 , and Amendment I, identified as COUNTY Amendment No. 9 A-14-118-1 , effective July 14 , 2015 , and Amendment II , identified as COUNTY Amendment No. A- 1 0 14-118-2, effective December 6, 2016, hereinafter collectively referred to as the "Agreement", 11 whereby CONTRACTOR agreed to provide comprehensive medical and behavioral health care 12 services , on behalfofthe COUNTY's Department ofPublic Health (DPH) and the COUNTY 's 13 Department of Behavioral Health (DBH), to the adult inmates detained in COUNTY 's Sheriff's Office 14 ("SHERIFF ") Adult Detention Facilities ("JAIL ") and youth detained in COUNTY's Probation 15 Department ("PROBATION") Juvenile Justice Campus ("JJC"), hereinafter collectively referred to as 1 6 COUNTY 's Detention Facilities; and 1 7 WHEREAS , the parties now desire to amend the Agreement to allow CONTRACTOR to utilize 18 COUNTY DBH-provided second-generation long-acting injectable psychotropic medications to 19 inmates and youths , and restate the Agreement in its entirety . 20 NOW , THEREFORE, in consideration oftheir mutual promises, covenants and conditions, 2 1 hereinafter set forth , the sufficiency of which is hereby acknowledged , the parties agree as follows : 22 I. That the following subsection be inserted into Section Two (2) of the existing COUNTY 2 3 Agreement No. A-14-118 , at Page Fourteen (14), Line Seventeen (17): 24 "G. Long-Acting Injectable Psychotropic Medications 2 5 COUNTY will contract with a pharmacy to provide second-generation long- 2 6 acting injectable psychotropic medications (hereinafter "LAI Medications") for use within the 27 COUNTY 's Detention Facilities by CONTRACTOR, at no cost to CONTRACTOR. 2 8 CONTRACTOR's psychiatrists will maintain sole responsibility for prescribing -1 -COUNTY OF FRESNO Fresno , CA COUNTY OF FRESNO Fresno, CA - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 said LAI medications, as clinically indicated. CONTRACTOR shall bridge medication, as indicated in Exhibit A3, for individuals who enter the facility currently on prescribed psychiatric medications. Specifically, CONTRACTOR shall verify prescription medications and CONTRACTOR’s psychiatrists shall prescribe the same medication to maintain individuals on a stable dosage, if clinically appropriate. Within seven (7) days of bridging medications, said individuals shall receive a face-to-face evaluation by CONTRACTOR’s psychiatrists who may then choose to continue said prescription, change prescription, and/or initiate usage of LAI medications, as clinically appropriate. At any time during incarceration, CONTRACTOR’s psychiatrists may initiate the use of LAI medications, as clinically indicated. When LAI medications are prescribed, CONTRACTOR will email COUNTY’S DBH subcontracted pharmacy all required prescription information, including client name, JID (jail identification) number, social security number, type of medication, dosage/instructions, and prescribing doctor. COUNTY’s DBH will ensure the contracted pharmacy will coordinate with CONTRACTOR for the delivery of said LAI medications. COUNTY’s DBH will be solely responsible for the cost of said LAI medications utilized by CONTRACTOR. H. Contract Administration SHERIFF shall be responsible for contract administration, evaluation, and oversight of the daily medical and behavioral health programs and operational services provided by CONTRACTOR within the JAIL detention facilities in close coordination with an interdisciplinary team from SHERIFF, DPH, and DBH, as applicable. SHERIFF will lead coordination efforts with CONTRACTOR to establish standardized procedures in compliance with the Remedial Plan, identified in Exhibit A3.” 2. The identified changes hereinabove shall not provide CONTRACTOR with any additional monetary consideration for the services mentioned within this Amendment III. 3. Except as otherwise provided in this Amendment III, all other provisions of the Agreement remain unchanged and in full force and effect.
