2 This Amendment No. 2 to Service Agreement (Amendment No. 2) is dated December 12,2o23and is
3 between the COUNTY OF FRESNO, a Political Subdivision of the State of California, hereinafter
4 referred to as "COUNTY', and each CONTRACTOR, listed in Exhibit A"List of Contractors", attached
5 hereto and by this reference incorporated herein, and collectively hereinafter referred to as
6 "CONTRACTOR(S)", and such additional CONTRACTOR(S) as may, from time to time during the term of
7 this Agreement, be added by COUNTY. Reference in this Agreement to "parties" shall be understood to
8 refer to COUNTY and each individual CONTRACTOR, unless otherwise specified.
9 WHEREAS, the parties entered into that certain Agreement, identified as COUNTY Agreement
10 No. P-20-382, effective October 1, 2020, as amended by Extension Letter P-20-382-1, dated May 31,
11 2023, whereby CONTRACTOR(S) agreed to provide psychiatric evaluation and court testimony
12 services for Lanterman-Petris-Short (LPS) Act Conservatees as defined by the Welfare and Insititutions
13 Code Section 5350, and reports for individuals deemed to be mentally incompetent to stand trial (IST)
14 as defined by Penal Code Section 1368, as well as additional services required by COUNTY as stated
15 herein; and
16 WHEREAS, the COUNTY now desires to add CONTRACTOR Starfish Psychology Services to
17 the Agreement; and
18 WHEREAS, the COUNTY and CONTRACTOR(S) desire to remove IST evaluations from the
19 scope of services because DBH is no longer required to provide those evaluations; and
20 WHEREAS, the COUNTY and CONTRACTOR(S) desire to add court testimony to the scope of
21 services for LPS Act Conservatees who challenge the conservatorship recommendation; and
22 WHEREAS, CONTRACTOR(S) is qualified and willing to provide licensed staff needed by the
23 COUNTY according to the terms and conditions of this Agreement.
24 NOW, THEREFORE, the parties agree to amend the Agreement as follows:
25 1. That the COUNTY Agreement No. 20-382, Section One (1) "SERVICES', on Page One
26 (1), beginning on Line Twenty-Two (22) with the letter "A" and ending on Page Three (3) Line Three (3)
2 7 with the word "restoration" be deleted and that the following be inserted in its place:

I "A. LPS Conservatorship Evaluation and Court Testimony - CONTRACTOR(S) shall have
2 licensed staff provide psychiatric (M.D.) and psychological (Ph.D. and Psy.D.) evaluation and court
3 testimony services for LPS Act Conservatees as defined by the Welfare and Instittuions Code section
4 5350. CONTRACTOR(S)'s licensed staff providing these services shall be licensed psychiatrists or
5 psychologists with at least five (5) years post-doctoral experience. CONTRACTOR(S) shall perform
6 evaluations for grave disability, including review of patient records, and provide declarations to the
7 probate court. Such evaluations shall be performed in an outpatient office-based setting, jail setting, or
8 treatment facility as needed, i.e., Adult Psychiatric Health Facility. CONTRACTOR shall testify in court
9 about patient's diagnosis, grave disability, and placement of LPS conservatees. CONTRACTOR shall
10 work with the COUNTY's Conservatorship Team and treatment facilities in obtaining information for
11 testifying, writing reports and treating the patient.
12 B. LPS Conservatorship Court Testimony- CONTRACTOR(S) shall have licensed staff
13 provide psychiatric (M.D.) and psychological (Ph.D. and Psy.D.) court testimony services for proposed
14 or current LPS Act Conservatees who contest the need for conservatorship as defined by the Welfare
15 and Institutions Code section 5350(d)(1). CONTRACTOR(S)'s licensed staff providing these services
16 shall be licensed psychiatrists or psychologists with at least five (5) years post-doctoral experience.
17 CONTRACTOR shall testify in court about patient's diagnosis, grave disability, and placement of LPS
18 conservatees. CONTRACTOR shall work with the COUNTY's Conservatorship Team and treatment
19 facilities in obtaining information for testifying."
20 2. That all references in existing COUNTY Agreement No P-20-382 to Exhibit A shall be
21 deemed references to "Revised Exhibit A," which is attached and incorporated by this reference.
22 3. That all references in existing COUNTY Agreement No P-20-382 to Exhibit C-1, et seq
23 shall be deemed references to each CONTRACTOR'S respective Exhibit C, as indicated on Revised
24 Exhibit A.
25 4. The parties agree that upon execution of this Amendment No. 2, COUNTY Agreement
26 No. P-20-382 is further revised, updated and amended to add CONTRACTOR Starfish Psychology

1 5. The parties agree that this Amendment No. 2 is sufficient to amend the Agreement; and
2 that upon execution of this Amendment No. 2, the Agreement, Amendment No. 1, and Amendment No.
3 2 shall be considered the Agreement.
4 6. The Agreement, as hereby amended, effective upon execution, is ratified and continued.
5 All provisions, terms, covenants, conditions, and promises contained in the Agreement and not
6 amended herein shall remain in full force and effect.

8 IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the day and
9 year first hereinabove written.
