Agreement No . 17-226
AGREEMENT
THIS AGREEMENT ("Agreement'') is made and entered into this 6th day
4 of June , by and between the COUNTY OF FRESNO, a political subdivision of the
5 State of California, hereinafter referred to as "COUNTY'', and Richard A Ciummo and
6 Associates, a professional law corporation, whose address is 123 East Fourth Street ,
7 Madera, CA 93638, hereinafter referred to as "ATTORNEY".

WIT N E S S E T H:
1. DEFINITIONS
A "ATTORNEY'' shall mean Richard A. Ciummo and Associates ,
and includes its staff attorneys, employees, agents , servants , representatives ,
12 assignees and subcontractors.
13 B. "Court" shall mean the Superior Court of California , County of
14 Fresno, including the branch courts and Juvenile Courts of Fresno County, unless
15 otherwise specifically indicated .
16 C. "Glass Wall" shall mean the structure, policies, procedures and
17 practices established by relevant case law, including Castro v. Los Angeles County
18 Board of Supervisors, (1991) 232 Cai.App.3d 1-432 , which shall be implemented herein
19 to ensure that no conflicts of interest shall exist or be possible between the Level One
20 Conflict Office , the Level Two Conflict Office and Wheel Attorneys (as the foregoing
21 terms are defined hereinbelow).
22 D. "Indigent" shall mean a person for whom the Court is required ,
23 by statute or case law, in effect during the term of this Agreement, to appoint counsel at
24 public expense, but f or whom the Public Defender is unable to provide representation
25 by reason of a legal conflict of interest or other reason, and whom the Court has
26 deemed to be an indigent person .
27 E . "Level One Confl ict Office" shall mean that legal office within
28 ATTORNEY that shall handle those cases and/or represent indigent defendants for
which the Public Defender has declared a conflict of interest. Such cases and

1 IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of
2 the day and year first hereinabove written .
