FACILITY USE AGREEMENT WITH CARUTHERS CHAMBER OF COMMERCE
2 THIS FACILITY USE AGREEMENT ("Agreement") is made and entered into this 16th day
3 of May , 2017, by and between the COUNTY OF FRESNO, a political subdivision of
4 the State of California, hereinafter referred to as "COUNTY", and the CARUTHERS CHAMBER
5 OF COMMERCE, a private non-profit organization, with mailing address of P .O. Box 627,
6 Caruthers, California. 93609, hereinafter referred to as "CONTRACTOR" or "CCOC."
7 COUNTY and CCOC may herein be referred to individually as "Party" or collectively as
8 "Parties."
9 RECITALS
10 WHEREAS, CCOC promotes and supports the success ofthe city of Caruthers' economy
11 and business community through effective advocacy, education and relationship building; and
12 WHEREAS, CCOC seeks to periodically host community events ("Events") on the
13 grounds of the Caruthers Branch Library, located at 13382 S. Henderson Road, Caruthers, CA
14 93609 (the "Library"), for the purpose of providing information and resources to the area
15 population on topics such as health, employment, careers and education; and
16 WHEREAS, the Board of Supervisors of COUNTY finds that the foregoing use of
17 COUNTY library facilities by CONTRACTOR to conduct the aforementioned Events will meet
18 the social needs ofthe COUNTY's population, is in the best interest of the COUNTY and will not
19 interfere with the COUNTY's use of such facilities.
20 NOW, THEREFORE, in consideration of their mutual covenants and conditions, the
21 Parties hereto agree as follows.:
22 1. PREMISES
23 Upon the terms and conditions set forth hereinbelow and in Exhibit A, attached
24 hereto and incorporated herein by reference, COUNTY shall make available to CCOC during the
25 Library's regular operating hours, the grounds and parking lot of the Library (the "Premises"),
26 for purposes of conducting outdoor Events .
27 2. TERM AND TERMINATION
28 The term of this Agreement shall be for a period of three (3) years, commencing on
