1 AMENDMENT I TO AGREEMENT
2 THIS AMENDMENT, hereinafter referred to as "Amendment 1", is made and entered into this
3 24th day of May , 201§., by and between the COUNTY OF FRESNO, a Political Subdivision
4 ofthe State of California, hereinafter referred to as "COUNTY", and EACH Provider listed in
5 Attachment A, attached hereto and by this reference incorporated herein, collectively hereinafter
6 referred to as "PROVIDER(S)", and such additional PROVIDER(S) as may, from time to time during
7 this term of this Agreement, be added by COUNTY. Reference in this Agreement to "party" or
8 "parties" shall be understood to refer to COUNTY and each PROVIDER, unless otherwise specified.
9 WHEREAS the parties entered into that certain Agreement, identified as COUNTY Agreement
10 No. 15-245, effective July 1, 2015, hereinafter referred to as "Agreement", whereby PROVIDER
11 agreed to provide residential detoxification and stabilization services to COUNTY's Department of
12 Behavioral Health Substance Use Disorder Services clients; and
13 WHEREAS the parties now desire to amend the Agreement regarding changes as stated below
14 and restate the Agreement in its entirety.
15 NOW, THEREFORE, in consideration of their mutual promises, covenants and conditions,
16 hereinafter set forth, the sufficiency of which is hereby acknowledged, the parties agree as follows :
17 1. That the existing COUNTY Agreement No . 15-245, Page Thirty-Seven (37), Line One
18 (I) beginning with the word "CONTRACTOR(S)" and ending on Line Sixteen (16) with the word
19 "years." be deleted in its entirety.
20 2. That the existing COUNTY Agreement No. 15-245, Page Forty ( 40), beginning with
21 Paragraph Forty-Four ( 44), Line One (I), with the word "SINGLE." and ending on Page Forty-One
2 2 ( 41 ), Line Five (5), with the word "later." be deleted and the following inserted in its place:
23 "44. SINGLE AUDIT CLAUSE
24 A. If CONTRACTOR expends Seven Hundred Fifty Thousand Dollars ($750,000.00) or more in
2 5 Federal and Federal flow-through monies, CONTRACTOR agrees to conduct an annual audit in
2 6 accordance with the requirements of the Single Audit Standards as set forth in Office of Management
27 and Budget (OMB) Circular A-133 . CONTRACTOR shall submit said audit and management letter
2 8 to COUNTY. The audit must include a statement of findings or a statement that there were no
