1 AMENDMENT II TO AGREEMENT
2 THIS AMENDMENT is made and entered into this 24th day of May , 2016,
3 by and between the COUNTY OF FRESNO, a political subdivision of the State of California,
4 hereinafter referred to as "COUNTY", and BAART BEHAVIORAL HEALTH, INC., whose remit to
5 and mailing address is 1111 Market Street, San Francisco, CA 941 03, hereinafter referred to as
6 "CONTRACTOR" (collectively the "parties").
7 WHEREAS, the parties entered into that certain Agreement, identified as COUNTY Agreement
8 No. 13-492, effective July 1, 2013, as amended by Amendment I, identified as County Agreement No.
9 13-492-1 effective September 23, 2014, hereafter referred to collectively as the Agreement; and
10 WHEREAS, CONTRACTOR has agreed to provide Narcotic Treatment Program (NTP) services
11 for the COUNTY'S Detention Facilities, and for certain clients at COUNTY's contracted residential
12 substance use disorder treatment facilities; and
13 WHEREAS the parties desire to amend the Agreement, regarding changes as stated below and
14 restate the Agreement in its entirety.
15 NOW, THEREFORE, in consideration oftheir mutual promises, covenants and conditions,
16 hereinafter set forth, the sufficiency of which is acknowledged, the parties agree as follows:
1 7 1. That the following text in the Agreement, Page Twenty-Six (26), beginning with
18 Paragraph Twenty-Two (22), Section A, Line Nineteen (19), with the word "CONTRACTOR" and
19 ending on Line Twenty-Two (22) with the word "COUNTY" be deleted in its entirety. The remaining
2 0 Sections (Section B through Section D) in the Agreement shall be re-lettered sequentially to read as
21 Sections A through C.
22 2. That the following text in the Agreement, Page Three (3), beginning with Paragraph Four
23 (4), Section D, Line Fourteen (14), with the word "In" and ending on Line Sixteen (16) with the word
2 4 "Agreement" be deleted and the following inserted in its place:

26 1) Fiscal Years 2013-14 through 2014-15-In no event shall the total
2 7 compensation for actual services performed under this Agreement be in excess of Eighty-Four Thousand
28 and No/100 Dollars ($84,000.00) for each twelve (12) month period from July 1, 2013 through June 30,
