Services.pdfMEMORANDUMOFUNDERSTANDINGBetweenFresnoRegionalWorkforceDevelopmentBoardAndFresnoCountyDepartmentofSocialServicesInaccordancewiththeWorkforceInnovationandOpportunitiesActof2014,PublicLaw113-128,29U.S.C.3101,etseq.,asamended(hereafterreferredtoas"WIOA"),theFresnoRegionalWorkforceDevelopmentBoard(hereinafterreferredtoasthe"WDB")shalldevelopalocalplan,andenterintoaMemorandumofUnderstanding("MOU")withlocalAmerica’sJobCenterOne-StopPartners(asdefinedinSectionIV(B)below)regardingtheoperationofthelocalAmerica’sJobCenterOne-StopSystemofservicedelivery(the"localOne-StopSystem")andtheperformanceofthefunctionsdescribedinSection121(e)(1)oftheWIOA.MOUsmustbeexecutedbetweentheWDBandtheAmerica’sJobCenterOne-StopPartners,withtheagreementoftheChiefLocalElectedOfficial.TheChiefLocalElectedOfficialintheWDB’sLocalWorkforceDevelopmentArea(collectively,theCityandCountyofFresno)hasdelegatedtotheWDBtheabilitytoexecutethisMOUpursuanttothatcertainJointExerciseofPowersAgreementdatedMay19,2009,asamended(the“JointPowersAgreement”).I.VISION,MISSIONANDGOALOFTHEFRESNOCOUNTYAMERICA’SJOBCENTEROFCALIFORNIA(AJCC)ONE-STOPSYSTEMA.VisionTofullyengageallavailablepublicandprivateresourcestoensuretheFresnoRegionalWorkforceDevelopmentsystemasthepremiersourceforthehumancapitalneedsofgrowthindustryclusterswithinFresnoCounty.ByintegratingeducationandworkforcepreparationtoassistthebestcompaniesinFresnoCountytoremainandthriveinourlocalcommunity,achievingsustainableeconomicgrowth.Toconcurrentlyassistourunemployedandunderemployedresidentstoachieveahigherqualityoflifebyaccesstosuchcareersingrowthindustrysectors.B.MissionTheFresnoRegionalWorkforceDevelopmentsystem,aJointPowersAuthoritybetweentheCityandCountyofFresno,inpartnershipwithboththepublicandprivatesectors,existsprimarilytoassistlocalbusinessesinmeetingtheirhumancapitalneeds.Inthis,weboth(1)screenandtrainprospectivenewemployeesand(2)assistinupskillingexistingemployees.Byofferingsuchqualityreferralandtrainingservices,directlylinkedtolocalindustryneeds,weareofgreatestbenefittoourunemployedandunderemployedclients.II.PURPOSEOFMEMORANDUMOFUNDERSTANDINGA.Todefine,establish,andreinforcerelationshipsbetweentheWDBandthedesignatedAJCCOne-StopPartners;B.TodefinetherolesandresponsibilitiesoftheseentitiesintheperformanceoftheircombinedgoalofestablishingaworkforcedevelopmentsystemthroughthelocalOne-StopSystemthatis:1718689v1/16988.0001FresnoRegionalWorkforceDevelopmentBoardWIOAPartnerMOUPage1of15 1.Integrated(offeringasmanyemployment,training,andeducationservicesaspossibleforemployersandindividualsseekingjobsorwishingtoenhancetheirskillsandaffordinguniversalaccesstothesystemoverall);2.Comprehensive(offeringtoparticipant/customeralargearrayofusefulinformationwithwideandeasyaccesstoneededservices);3.Participant/customer-focused(providingthemeansforjudgingthequalityofservicesandmakinginformedchoices);and4.Performance-based(basedonclearoutcomestobeachieved,mutuallynegotiatedoutcomesandmethodsformeasurements,andthemeansformeasuringandattainingparticipant/customersatisfaction);andC.TodescribehowcostofservicesandtheoperatingcostofthelocalOne-StopSystemwillbefunded.III.STATEMENTOFISSUEAsapartnerundertheWIOA,FresnoCountyDepartmentofSocialServices(DSS),hereinafterreferredtoasthe“Partner”,entersintoanMOUwiththeWDBregardingthemannerinwhichthePartnerwillparticipateandprovideaccesstotheirservicesthroughthelocalOne-StopSystem.IV.DEFINITIONSThefollowingdefinitionsapplytothisMOU:A.AJCCOne-StopOperator:TheWDBsub-contractedentityorentitiesdesignatedtooperatethelocalOne-StopSystem,provideBasicCareerServices(asdefinedinSectionIV(D)below),andtocoordinateserviceswithinthelocalOne-StopSystemundertheWIOA.Sometimesalsoreferredtohereinasthe"One-StopOperator"B.AJCCOne-StopPartner:Anentitythatcarriesoutoneormoreprogramsoractivitiesdescribedherein,makesthoseprogramsoractivitiesavailabletoparticipantsthroughthelocalOne-StopSystem,andparticipatesintheoperationofthelocalOne-StopSystemconsistentwiththetermsofthisMOUandwiththerequirementsoftheirAuthorizingLaw(asdefinedinSectionIV(C)below)bywhichtheprogramsoractivitiesareauthorizedundertheWIOA.Sometimesalsoreferredtohereinas"Partner"C.AuthorizingLaw:ReferstoeachrespectivePartner'slegalauthoritytoengageinthespecificprogramsoractivitiesthatthePartnerwillprovideinconnectionwithWIOAauthorizedprograms,activities,orservices.D.BasicCareerServices:ServicesandresourcesavailabletothegeneralpublicwithoutenrollmentintotheWIOAprogramoranyPartner’sprogram.TheseservicesareoverseenbytheAJCCOne-StopOperator.Theseservicesincludebutarenotlimitedtothefollowing1718689v1/16988.0001FresnoRegionalWorkforceDevelopmentBoardWIOAPartnerMOUPage2of15 services,andareprovidedeitherbytheWDBorbythePartners,asappropriate,applicableandallowable:1.DeterminationofeligibilitytoreceiveWIOA-enrolledservices.2.Outreach,intake,andorientationtotheservicesavailablethroughtheOne-StopSystem.3.Initialassessmentofskilllevels(includingliteracy,numeracy,andEnglishlanguageproficiency),aptitudes,abilities(includingskillsgaps),andsupportiveserviceneeds.4.Laborexchangeservices,includingthefollowing:a.Jobsearch,placementassistance,andcareercounseling,includinginformationonin-demandindustrysectorsandoccupationsaswellasnontraditionalemployment.b.Recruitmentandotherbusinessservicesonbehalfofemployersinthelocalarea,suchasinformationandreferraltospecializedbusinessservicesnottraditionallyofferedthroughthelocalOne-StopSystem.5.Referralsto,andcoordinationofactivitieswith,otherprogramsandservices,includingprogramsandserviceswithinthelocalOne-StopSystemandotherworkforcedevelopmentprograms.6.Workforceandlabormarketemploymentstatisticsinformation,includinginformationrelatingtolocal,regional,andnationallabormarketareas,includingthefollowing:a.Jobvacancylistingsandthejobskillsnecessarytoobtainthem.b.Informationonlocalin-demandoccupationsandtheearnings,skillrequirements,andopportunitiesforadvancementthataccompanythem.7.Informationonperformanceandprogramcostofeligibleprovidersoftrainingservices,youthworkforcedevelopmentactivities,adulteducation,careerandtechnicaleducationactivitiesatthepostsecondarylevel,careerandtechnicaleducationactivitiesavailabletoschooldropouts,andvocationalrehabilitationservices.8.InformationregardinghowthelocalareaisperformingonthelocalperformanceaccountabilitymeasuresandanyadditionalperformanceinformationwithrespecttothelocalOne-StopSystem.9.Informationon,andreferralto,supportiveservicesorassistance,includingthefollowing:a.Childcare,childsupport,medicalorchildhealthassistanceundertitleXIXorXXIoftheSocialSecurityAct.b.BenefitsunderthesupplementalnutritionassistanceprogramestablishedundertheFoodandNutritionActof2008.c.Assistancethroughtheearnedincometaxcreditundersection32oftheInternalRevenueCodeof1986.d.AssistanceunderastateprogramfortemporaryassistanceforneedyfamiliesfundedunderpartAofTitleIVoftheSocialSecurityAct.e.Othersupportiveservicesandtransportationavailableinthelocalarea.1718689v1/16988.0001FresnoRegionalWorkforceDevelopmentBoardWIOAPartnerMOUPage3of15 10.Informationandassistanceregardingfilingclaimsforunemploymentcompensation.11.AssistanceinestablishingeligibilityforprogramsoffinancialaidassistancefortrainingandeducationprogramsthatarenotfundedunderWIOA.E.BusinessServices:Theterms“BusinessServices”meansservicesandresourcesavailabletoemployersinthelocalareaandareprovidedbyPartnersandsub-contractedprovidersofservices,withoversightbyWDBstaff,whereapplicable,appropriateandallowable.Theseservicesinclude,butarenotlimitedto:1.Laborexchangeactivitiesandlabormarketinformation;2.Customizedscreeningandreferralofqualifiedparticipantsintrainingservicestoemployers;3.Customizedservicestoemployers,employerassociations,orothersuchorganizations,onemployment-relatedissues;4.Customizedrecruitmenteventsandrelatedservicesforemployersincludingtargetedjobfairs;5.Humanresourceconsultationservices,includingbutnotlimitedtoassistancewith:a.Writing/reviewingjobdescriptionsandemployeehandbooks;b.Developingperformanceevaluationandpersonnelpolicies;c.Creatingorientationsessionsfornewworkers;d.Honingjobinterviewtechniquesforefficiencyandcompliance;e.Analyzingemployeeturnover;orf.Explaininglaborlawstohelpemployerscomplywithwage/hourandsafety/healthregulations;6.Customizedlabormarketinformationforspecificemployers,sectors,industriesorclusters;7.RapidResponseandlay-offaversion;and8.Othersimilarcustomizedservices.F.IndividualizedCareerServices:ThetermIndividualizedCareerServicesmeansservicesavailabletopersonswhomeettheeligibilityrequirementsasdefinedintheWIOAandsubsequentregulations.TheseservicesareprovidedbytheWDB’ssubcontractedserviceprovidersandPartners,whereapplicable,appropriateandallowable.Theseservicesaresubjecttopriorityofserviceandinclude,butarenotlimitedto:1.Comprehensiveandspecializedassessmentsoftheskilllevelsandserviceneedsofadultsanddislocatedworkers,whichmayincludethefollowing:a.Diagnostictestinganduseofotherassessmenttools.b.In-depthinterviewingandevaluationtoidentifyemploymentbarriersandappropriateemploymentgoals.1718689v1/16988.0001FresnoRegionalWorkforceDevelopmentBoardWIOAPartnerMOUPage4of15 2.Developmentofanindividualemploymentplantoidentifytheemploymentgoals,appropriateachievementobjectives,andappropriatecombinationofservicesfortheparticipanttoachievetheemploymentgoals,includingprovidinginformationoneligibleprovidersoftrainingservicesandcareerpathwaystoattaincareerobjectives.3.Groupcounseling.4.Individualcounseling.5.Careerplanning.6.Short-termprevocationalservices,includingdevelopmentoflearningskills,communicationskills,interviewingskills,punctuality,personalmaintenanceskills,andprofessionalconduct,toprepareindividualsforunsubsidizedemploymentortraining.7.Internshipsandworkexperienceslinkedtocareers.8.Workforcepreparationactivities.9.Financialliteracyservices.10.Out-of-areajobsearchassistanceandrelocationassistance.11.Englishlanguageacquisitionandintegratededucationandtrainingprograms.G.AJCCPartnerServices:ThetermAJCCPartnerServicesmeansthoseservicesdescribedinSectionIX,DescriptionofServicesToBeProvidedByPartner,ofthisMOUcarriedoutunderthePartner'sAuthorizingLaw.H.Participant/customer:Thetermparticipant/customerisdefinedasapersonorpersonsreceivingintegratedlocalOne-StopSystememployment,training,educationalservices,and/orbusinessservicesforemployersfromanyAJCCpartner.I.TrainingServices:ThetermTrainingServicesmeansservicesavailabletopersonswhomeettheeligibilityrequirementsasdefinedintheWIOA,subsequentregulations,andlocally-definedprerequisites.TheseservicesareprovidedbytheWDB’ssubcontractedserviceprovidersandPartners,whereapplicable,appropriateandallowable.Theseservicesaresubjecttopriorityofserviceandinclude,butarenotlimitedto:1.Occupationalskillstraining,includingtrainingfornontraditionalemployment.2.On-the-jobtraining.3.Incumbentworkertraining.4.Programsthatcombineworkplacetrainingwithrelatedinstruction,whichmayincludecooperativeeducationprograms.5.Trainingprogramsoperatedbytheprivatesector.6.Skillupgradingandretraining.7.Pre-ApprenticeshipandApprenticeshiptraining1718689v1/16988.0001FresnoRegionalWorkforceDevelopmentBoardWIOAPartnerMOUPage5of15 8.Entrepreneurialtraining.9.Transitionaljobs(WorkExperience).10.Jobreadinesstrainingprovidedincombinationwithanothertrainingservice.11.Adulteducationandliteracyactivities,includingactivitiesofEnglishlanguageacquisitionandintegratededucationandtrainingprograms,providedconcurrentlyorincombinationwithanothertrainingservice.12.Customizedtrainingconductedwithacommitmentbyanemployerorgroupofemployerstoemployanindividualuponsuccessfulcompletionofthetraining.13.OthersimilartrainingservicesV.AJCCONE-STOPPARTNERPARTICIPATIONPartneragreestoparticipateinajointplanningprocesswhichresultsinthedevelopmentofthelocalandregionalStrategicPlansubmittedtotheStateinaccordancewithissuedWIOAguidelines(the"StrategicPlan").Partnersagreetoengageinplanning,plandevelopment,andactivities,toresultin:A.ContinuouspartnershipbuildingbetweenallpartiestothisMOU;B.ContinuouspartnershipbuildingandplanningresponsivetoStaterequirements;C.ContinuouspartnershipbetweenStateandlocalrepresentativesengagedinWIOAactivitiesandrelatedworkforcepreparationanddevelopment;D.Responsivetospecificlocalandeconomicconditions,includingemployerneeds;E.AdherencetostrategicplanningprinciplesadoptedbytheWIOAforlongrangeplanning,includingtherequirementforcontinuousimprovement;F.Adherencetocommondatacollectionandreporting,includingneedsformodificationorchange;G.Diligenceindevelopingcoordinatedlocalleadershipinworkforcedevelopmentthrough:H.Responsivenesstoparticipant/customerneeds;I.Maintenanceofsysteminfrastructure;J.Sharedtechnologyandinformation;K.PerformancemanagementtomeasurethesuccessofthelocalOne-StopSystemoverallandtoenhanceperformanceinaspiritofqualitymanagementandcontinuousimprovement.L.IdentificationofeachPartner’sappropriatecontributiontomeetingtheperformancestandardsnegotiatedbetweentheStateofCaliforniaandWDB.1718689v1/16988.0001FresnoRegionalWorkforceDevelopmentBoardWIOAPartnerMOUPage6of15 VI.THECUSTOMERSTOBESERVEDTheAJCCOne-StopCenterwillserve:A.ThoseFresnoCountyresidents,whoareseekingemployment,needguidanceonhowtomakecareerchoices,andbuildingbasiceducationaloroccupationalskills.1.PriorityofServicewillbegiventothosewhoare(inorderofpriority):a.Veteransandeligiblespouseswhoarealsorecipientsofpublicassistance,otherlowincomeindividuals,orindividualswhoarebasicskillsdeficient;b.Individualswhoarerecipientsofpublicassistance,otherlowincomeindividuals,orindividualswhoarebasicskillsdeficient;c.VeteransandeligiblespouseswhoarenotincludedinWIOA’sprioritygroups.d.OtherindividualsnotincludedinWIOA’sprioritygroups.B.Thosebusinesseswhoareseekingaskilledandstableworkforce;needguidanceinvariousbusinessoperationsorinneedofassistanceincaseofreductionsinforce.C.AllAJCCOne-StopCenterServicesandPartnerserviceswillbeavailabletoalleligibleresidentsnomattertheirEnglishlanguageproficiencyandphysicalabilities.VII.AMERICAN’SWITHDISABILITIESACTCOMPLIANCEPartneragreestoensurethatthepoliciesandproceduresaswellastheprogramsandservicesprovidedattheAJCCandPartner’sfacilitiesareincompliancewiththeAmericanswithDisabilitiesActanditsamendments.Additionally,partnersagreetofullycomplywiththeprovisionsofWIOA,TitleVIIofthecivilRightsactof1964,theAgeDecimationActof1975,TitleIXoftheEducationAmendmentsof1972,29CRFPart37andallotherregulationsimplementingtheaforementionedlaws.VIII.NON-DISCRIMINATIONANDEQUALOPPORTUNITYA.Partneragreesthatnopersonshall,becauseofethnicgroupidentification,age,sex,genderidentification,sexualorientation,color,disability,medicalcondition,nationalorigin,race,ancestry,maritalstatus,religion,religiouscreed,orpoliticalbeliefbeexcludedfromparticipation,bedeniedbenefitsof,orbesubjecttodiscriminationunderanyprogramoractivityreceivingstateorfederalassistance.Suchpracticesincluderetirement,recruitmentadvertising,hiring,layoff,termination,upgrading,demotion,transfer,ratesofpayorotherformsofcompensation,useoffacilities,andothertermsandconditionsofemployment.B.PartnerassurescompliancewiththeAmericanswithDisabilitiesAct(ADA)of1990,whichprohibitsdiscriminationonthebasisofdisability,aswellasapplicableregulationsandguidelinesissuedpursuanttotheADA.IX.DESCRIPTIONOFSERVICESTOBEPROVIDEDBYTHEPARTNERPartneragreesthattheywillprovideaccesstoalltheservicesdescribedbelowatthedesignatedAJCCOne-Stopandanyothersatellitelocationdeemedappropriatebythe1718689v1/16988.0001FresnoRegionalWorkforceDevelopmentBoardWIOAPartnerMOUPage7of15 Partner.PartnerwillparticipateinthecreationofthelocalOne-StopSystemwhichprovidesforuniversalaccessandenablescustomerstobecomeself-sufficient.Partnerwillensurethatservicesareprovidedeitherby(i)assigningstafftothelocalAJCCOne-Stop(s);(ii)usingamutuallydevelopedreferralprocess;(iii)trainingtheOne-StopOperatorandotherPartnerstafftodeliverinformationabouttheservicesavailabletoeligibleindividuals;and/or(iv)usingtechnologytoprovideservicestoparticipants/customers,exceptasnotedbelow.Partnerwillensurethattheneedsofworkersandyouth,andindividualswithbarrierstoemployment,includingbutnotlimitedtoindividualswithdisabilitiesandlimitedEnglishproficientindividuals,areprovidednecessaryandappropriateaccesstoservices,includingaccesstotechnologyandmaterials,availablethroughthelocalOne-StopSystem.AnyPartnerfundedbyWagner-Peyserisrequiredtobeco-locatedintheComprehensiveAmerica'sJobCenterOne-StopCenter(asdefinedandidentifiedinSectionXI(A)below).A.PartneragreesthatitwillprovideOne-StopPartnerCoreServicestoparticipants/customersandsupportlocalOne-StopSystemactivitiesasdefinedinAttachment1.X.WDBRESPONSIBILITIESAsauthorizedundertheWIOA,andpursuanttotheJointPowersAgreement,theWDBwillestablishpoliciesnecessaryforimplementationoftheWIOAinthelocalareaandshall:A.DevelopandsubmitalocalplantotheGovernor;B.CollaboratewithotherWorkforceDevelopmentBoardstodevelopaRegionalPlanC.IdentifyeligibleAJCCOne-StopOperatorsbyawardinggrantsorcontractsonacompetitivebasis;D.ConductprogrammaticandfiscalreviewsoftheWIOAservicesprovidedbysub¬contractedprogramprovidersofservices,trainingservicesprovidersandreporttotheWDBtheresultsofthosereviews.E.Identifyeligibleprovidersofyouthactivitiesinthelocalareabyawardinggrantsorcontractsonacompetitivebasisbasedontherecommendationsofthelocalyouthcouncil;F.Identifyeligibleprovidersoftrainingservicesinthelocalareabyawardinggrantsorcontractsonacompetitivebasis;G.IdentifyeligibleprovidersofIndividualizedCareerServicesinthelocalareabyawardinggrantsorcontractsonacompetitivebasis;1718689v1/16988.0001FresnoRegionalWorkforceDevelopmentBoardWIOAPartnerMOUPage8of15 H.ProvideadequatefacilitiesforthePartnersasneededandasfundingallows;I.DevelopalocalOne-StopSystembudgetforthepurposeofcarryingoutthedutiesoftheWDB;J.SolicitandacceptgrantsanddonationsfromsourcesotherthanfederalfundsmadeavailableunderWIOA;K.Conductregularprogramandphysicalplantassessmentsforcompliancetofederal,stateandlocalEqualOpportunityandAmericanswithDisabilitiesActregulationsasrequiredbylaw.L.Negotiatelocalperformancemeasures;M.Coordinatetheworkforcedevelopmentactivitiescarriedoutinthelocalareawitheconomicdevelopmentstrategiesanddevelopotheremployerlinkageswithsuchactivities;N.Promoteparticipationbyprivatesectoremployersinthestatewideworkforcedevelopmentsystemandhelpsuchemployersmeettheirhiringneedsusingthesystembyprovidingconnecting,brokering,andcoachingactivitiestotheemployers;O.Makeavailabletothepublic,onaregularbasisthroughopenmeetingsand/orthroughpublicationsonline,informationregardingtheactivitiesoftheWDB,includinginformationregardingtheStrategicPlanpriortosubmissionoftheStrategicPlan,membership,thedesignationandcertificationofAJCCOne-StopOperator(s),theawardofgrantsorcontractstoeligibleprovidersofyouthactivities,and,onrequest,minutesofformalmeetingsoftheWDB;P.NegotiateandenterintoanMOUwitheachAJCCOne-StopPartnerwhichmeettherequirementsoftheWIOAandsetsforththeirrespectiveresponsibilitiesformakingafullrangeofservicesavailablethroughthelocalOne-StopSystem;andshallmodifythisMOUtoaddadditionalPartnersasneededforthebenefitofthecommunityandsystem.XI.LOCATIONOFAMERICA’SJOBCENTERONE-STOPSITESA.TheWDBwillestablishaminimumofonephysicallocationcalledthe"ComprehensiveAJCC"withintheworkforcedevelopmentareainwhichallAJCCOne-StopPartnerswillprovideaccesstotheservicesprovidedundertheWIOA.ThepartiesagreethattheComprehensiveAJCCshallbelocatedattheManchesterShoppingCenter,3302N.BlackstoneAvenue,Fresno,California93726.ThislocationmaybechangedbytheWDBduringthetermofthisMOUuponthirty(30)daysadvancenoticeofsuchchangetothePartners.EachPartneragreesthatitwillprovideaccesstotheservicesdescribedinthisMOUatsuchlocationandanyothersatellitelocationdeemedappropriatebyeachPartner,withconcurrenceoftheWDB.B.IftheWDBestablishesadditionalAJCCOne-StopCenterswithinitslocalworkforcedevelopmentarea,eachPartnerwilldeterminetheextentandmannerinwhichit1718689v1/16988.0001FresnoRegionalWorkforceDevelopmentBoardWIOAPartnerMOUPage9of15
