HomeMy WebLinkAboutAgreement A-15-374-1 with FGPPD.pdf1 2 3 4 5 6 7 8 9 AMENDMENT I TO AG R E E M E NT THIS Amendment I to AGREEMENT (hereinafter "Amendment") is made and entered into this __ day of , 2016 by and between the COUNTY OF FRESNO, a political subdivision of the State of California, hereinafter referred to as "COUNTY", and the FIG GARDEN POLICE PROTECTION DISTRICT, a police protection district formed pursuant to Health and Safety code section 20300 et seq., hereinafter referred to as "DISTRICT". WITNESSETH: WHEREAS, COUNTY and DISTRICT entered into Agreement number 15-374, dated 1 o August 11, 2015, (hereinafter "Agreement"), pursuant to which COUNTY agreed to provide law 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 enforcement within DISTRICT'S boundaries by COUNTY through COUNTY's Sheriff's Office and WHEREAS, COUNTY agrees to render such law enforcement services on the terms and conditions hereinafter set forth, and DISTRICT agrees to pay to COUNTY the cost of performing such services within DISTRICT at the rates and under the terms and conditions hereinafter set forth; and WHEREAS, COUNTY and DISTRICT now desire to amend the Agreement in order to amend the term and services. NOW, THEREFORE, in consideration of their mutual covenants and conditions, the parties hereto agree as follows: 1. Section 1 C of the Agreement, beginning on page 2, line 1 with the word "COUNTY's" and ending on page 2, line 7 with the word "Agreement" is deleted in its entirety and replaced with the following; "COUNTY's Sheriff shall provide law enforcement services within DISTRICT at a minimum service level of two Deputy Sheriff's for 1,691 hours each during the term of this Agreement, for a total of 3,382 hours of service. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2. 3. additional hours of law enforcement service beyond the minimum service level stated above are appropriate and should COUNTY Sheriffs determine they have sufficient resources to do so, COUNTY's Sheriff will provide overtime law enforcement services in an amount not to exceed 1,560 hours during the term of this Agreement. " Section 3 of the Agreement, beginning on page 3, line 1 and ending on page 3, line 2 is deleted in its entirety and replaced with the following: "This Agreement shall be effective from the 1st day of July, 2015, and shall terminate on the 30th day of June, 2017, unless and until terminated by either party pursuant to section V of this Agreement. " All references to "Exhibit A" shall be replaced with "Amended Exhibit A", which is attached hereto and incorporated herein by reference. This Amendment I will be effective July 1, 2016. COUNTY and DISTRICT agree that upon execution of this Amendment I, the Agreement, and this Amendment I together shall be considered the Agreement. The Agreement, as hereby amended, ratified and continued. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 "Amended Exhibit A" Minimum Service Level: Fig Garden Police District Sheriff, County of Fresno DISTRICT agrees to pay COUNTY for providing law enforcement services at the following service level: A. Two Full-Time Deputies: The Sheriff's Office will assign two full time equivalent Deputy Sheriff Officers (assigned to Area 2) to work various shifts to serve the DISTRICT. The staffing patterns may vary; however, the staffing pattern will equal a minimum of two full-time equivalent Deputy Sheriff positions providing law enforcement services to the DISTRICT every week to ensure the service level is maintained. From July 1, 2015 through June 30, 2016 each of the two Deputy Sheriffs will work 1,700 hours at an hourly rate of $96.78 per Deputy Sheriff. From July 1, 2016 through June 30, 2017 each of the two Deputy Sheriffs will work 1,691 hours total at an hourly rate of $96.78 per Deputy Sheriff. The hourly rate for services provided under this agreement for each Deputy Sheriff represents a rate that recovers the salaries, benefits, radio charges, and fuel. The total cost during the term of this agreement for the two full-time deputes will be $656,362 (1,700 hrs x $96.78 per hour x 2 deputies= $329,052) + (1,691 hrs. x $96.78 per hour x 2 deputies= $327,310). The COUNTY will invoice the DISTRICT a flat monthly rate of $27,421 from July 1, 2015 through June 30, 2016 and a flat monthly rate of $27,275.83 from July 1, 2016 through June 30, 2017 for the services of these two full-time deputies. B. Overtime: Should additional law enforcement services be provided by COUNTY's Sheriff beyond the minimum service level described in paragraph A above, the DISTRICT shall pay for such overtime (work beyond the hours per deputy set forth above) services of Deputy Sheriff's. Overtime services will not exceed a total of 1560 hours during the term of this agreement. Overtime services will be invoiced at $54.94 per hour. Overtime services will not exceed $85,706.40 each FY during the term of this agreement. The COUNTY will invoice the DISTRICT for overtime services on a quarterly basis for overtime services provided during the quarter. C.
