HomeMy WebLinkAboutAgreement A-15-373-1 with Central School District.pdf1 2 3 4 5 6 7 8 9 10 11 12 13 AMENDMENT I TO AG RE E M E NT THIS AMENDMENT I TO AGREEMENT (hereinafter referred to as this "First Amendment") is made and entered into this_ day of __ , 2016, and amends that certain Agreement, identified as County Agreement No. 15-373, entered into August 11, 2015, (the "County Agreement"), by and between the COUNTY OF FRESNO, a political subdivision of the State of California, 2220 Tulare Street, Fresno, CA 93721, hereinafter referred to as "COUNTY", and CENTRAL UNIFIED SCHOOL DISTRICT, 4605 N. Polk Avenue, Fresno CA 93722, hereinafter referred to as "SCHOOL". WHEREAS, the COUNTY through COUNTY's Sheriff's Department provides law enforcement services to the SCHOOL pursuant to the terms of the Agreement; and WHEREAS, the parties wish to modify the Agreement to provide for additional law 14· enforcement services in and around the Central High School West Campus. 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, in consideration of their mutual promises, the parties hereto agree to amend the Agreement as follows: 1. 2. That all references to "Exhibit A" shall be revised to state "Amended Exhibit A", which is attached hereto and incorporated herein by reference. Section V of the Agreement, beginning on page 3, line 9 and ending on page 3, line 10 is deleted in its entirety and replaced with the following: "This Agreement shall be effective from the 12th day of August, 2015, and shall terminate on the 3Qth day of June, 2017, unless and until terminated by either party pursuant to section VI of this Agreement. 1 The Agreement, as hereby amended, ratified and continued. All provisions, terms, 2 covenants and promises contained in the Agreement and not amended herein shall remain in 3 full force and effect. Minimum Annual Service Level, Per Deputy SCHOOL agrees to pay COUNTY for providing minimum service levels as follows: A. One Deputy Sheriff Position at the rate of $96.78 per hour for 1,440 hours ($96.78 x 1,440 hours= $139,363) for the period of August 10, 2016 to June 7, 2017. The cost for the one scheduled Deputy position will be paid monthly, in 10 equal payments of $13,936.32. The COUNTY will invoice the SCHOOL on a monthly basis, August through May. The total amount payable under this agreement shall not exceed $139,363 unless both parties agree on additional services for special events. II. Special Events Levels SCHOOL agrees to pay COUNTY for providing special event service levels as follows: A. $54.94 Per hour, Per Deputy Special Events will be billed as consumed. -4-Amendment Between Countv of Fresno and Central Unified School District for LE Services, FY 2016-17
