AGREEMENT

2 THIS AGREEMENT is made and entered into this 7th day of June , 2016 , by and
3 between the COUNTY OF FRESNO, a political subdivision of the State of California (hereinafter
4 referred to as "COUNTY"), and PROVIDENCE HORTICULTURE , INC ., a California corporation
5 dba TREE DOCTORx, whose address is P.O. Box 7735 , FRESNO, CA 93747 (hereinafter
6 referred to as "CONTRACTOR").
7 WHEREAS, the COUNTY issues Request for Quotation (RFQ) No . 988-5449 , seeking a
8 Pest Control Operator to treat properties for the control of the Glassy-winged Sharpshooter; and
9 WHEREAS, CONTRACTOR submitted a response to RFQ No . 988-5449 , representing
10 that they are qualified to provide such Pest Control Operator services.
11 NOW, THEREFORE , in consideration of their mutual covenants and conditions , the
12 parties hereto agree as follows:
13 1. OBLIGATIONS OF THE CONTRACTOR
14 CONTRACTOR agrees :
15 a. To furnish all personnel , equipment and facilities to apply chemical(s) for the
16 treatment of Glassy Winged Sharpshooter (Application). The treatment crew shall
17 consist of two personnel and two application vehicles or one application vehicle with
18 two tanks with a minimum tank capacity of 250 gallons .
19 b . No homeowner owned equipment is to be used.
20 c . To identify an individual who will be the CONTRACTOR 's representative . Th is
21 person will have responsibility for maintaining liaison with the Fresno County
22 Agricultural Commissioner (CAC) and assuring that the terms of the contract are
23 met.
24 d. To maintain all equipment in good working order.
25 e . To comply with all appl icable federal , state, and local rules , regulations , and laws .
26 f . To ensure that Appl ications are made in accordance with applicable laws and
27 regulations concerning pesticide applications in the State of California .

1 IN WITNESS WHEREOF , the parties hereto have executed this Agreement as of the
2 day and year first hereinabove written .
