Moore Twining Associates, Inc.
1 SECOND AMENDMENT TO AGREEMENT
2 THIS SECOND AMENDMENT TO AGREEMENT is made this~]~ day of
3 t)~ , 2015, by the COUNTY OF FRESNO, a political subdivision of the State of
4 California (COUNTY), and Moore Twining Associates, Inc., a California corporation
5 located at 2527 Fresno Street, Fresno, CA 93721 (CONTRACTOR).
6 RECITALS
7 WHEREAS, the parties entered into an Agreement on April 13, 2010, identified
8 as COUNTY Agreement No. 10-173, for CONTRACTOR to provide analytical testing
9 services for water samples from domestic water and wastewater treatment facilities
10 (Agreement); and
11 WHEREAS, the parties entered into a First Amendment to the Agreement on
12 February 26,2013, identified as COUNTY Agreement No. 10-173-1, (First Amendment);
13 and
14 WHEREAS, the parties desire to further amend the Agreement as stated below.
15 THE PARTIES THEREFORE AGREE AS FOLLOWS:
16 1. Section V, paragraph A, of the Agreement as amended by the First
17 Amendment, is further amended as follows. After the text ending on page 2, line 15, and
18 before the text beginning on page 2, line 16, of the First Amendment, the following text
19 is added:
20 "After December 31, 2015, the CONTRACTOR's compensation shall be
21 further reduced as follows:

Percentage Reduction
Five Percent (5%) reduction from all
test quotes in Exhibit D
25 The actual analytical test costs that reflect the Five Percent (5%) reduction in
26 quotes provided in Exhibit D are attached to the Second Amendment as Exhibit
27 E."
