PART V: ADJUST COMPENSATION FOR THE CALIFORNIA STATEWIDE CRUDE OIL PRICE
INDEX FLUCTUATION
This compensation adjustment was requested by the engineer.
Adjust compensate per the methods established in the Standard Specifications and Special Provisions
Section 9-1.07 for fluctuations greater than or less than five percent in the California Statewide Crude
Oil Price Index for the month the material was placed, when compared to the index published for the
month of the bid opening. The California Statewide Crude Oil Price Index for the bid opening month,
October 2022, was 497.40. The index was 446.1 in May 2023, which applies to the Pay Estimate No. 5
for the quantity of asphalt in the HMA.
The asphalt content in the1/2-inch HMA mix from the Calaveras Materials, Inc. plant was 5.07 percent.
The percent was reduced to 4.29 percent to account for the 15 percent reclaimed asphalt pavement
(RAP). The adjustment applies to 582 tons of 1/2-inch HMA placed in May 2023. The asphalt content in
the 3/8-inch HMA dike mix from Vulcan-Ashlan plant was 6.40 percent. The adjustment applies to 11.96
tons of 3/8-inch HMA placed in May 2023.
The total adjustment compensation for price index fluctuation is being made at an agreed price in
accordance with Section 9-1.03, "Payment Scope" of the Special Provisions, resulting in a decrease of
$736.17. This amount will be deducted from the monies due to the contractor.
This change did not impact the critical path for the project, so additional contract time was not warranted.
