This Memorandum of Understanding (MOU) is made between the County of Fresno,
a political subdivision of the State of California, hereinafter referred to as "COUNTY" and the
United States Customs and Border Protection, hereinafter referred to as the "CBP."
WHEREAS, CBP desires to house federal detainees in the County of Fresno jail; and
WHEREAS, the COUNTY agrees to render such service on the terms and conditions
set forth herein.
NOW, THEREFORE, the parties agree as follows:
1. The COUNTY agrees to provide for the secure custody, safekeeping, housing,
subsistence and care of up to six federal detainees in the Fresno County Jail as set forth in
Exhibit "A", attached hereto and incorporated herein by this reference. At the request of CBP,
COUNTY, through its Sheriff's Office Bureau Commander may agree to provide such services
for up to six federal detainees pursuant to the terms of this Agreement.
2. Term of MOU-This MOU shall become effective when executed by both
17 parties, and shall continue in full force and effect, unless and until terminated by either party
18 upon the giving of thirty (30) days advance written notice.

3. COUNTY shall invoice CBP monthly for the services rendered during the
previous month. Invoices shall be addressed to CBP as follows:

4. Payment shall be made by CBP within thirty(30) days of the invoice date.

The CBP agrees to pay COUNTY the rate of $1 04.00/day per detainee
housed in the Fresno County jail facility. In addition, the CBP shall pay COUNTY at a rate
of $37.00 per hour, per guard (with a two guard minimum) for services rendered in
transporting federal detainees for medical care at an outside medical facility, as well as
guarding federal detainees while at the outside medical facility.
6. Neither party to this MOU, nor its officers and employees, shall assume any
liability for the negligent or wrongful acts or omissions of the other party, its officers or
employee.
7. The rendition of contract services, the standards of performance, the
discipline of officers, and other matters incident to the performance of such services and the
control of personnel so employed, shall remain in the Sheriff's Office. In the event of
dispute between the parties as to the extent and duties and functions to be rendered under
this MOU, or the minimum level or manner of such performance of such services, the
determination made by the Sheriff's Office shall be final and conclusive.
8. This MOU is between CBP and the County and does not create or confer
any rights, privileges, or benefits upon any person, party, or entity.
