1 AMENDMENT ITO AGREEMENT
2 THIS AMENDMENT I TO AGREEMENT 20-082, ("Amendment I"), is made this 8th day
3 of August , 2023 ("Effective Date"), by and between the COUNTY OF FRESNO, a
4 political subdivision of the State of California ("County"), and the SIERRA UNIFIED SCHOOL
5 DISTRICT ("District").
6 WITNESSETH
7 WHEREAS, the County has been designated as the sponsoring agency to administer and
8 implement the Community Development Block Grant (CDBG) Program activities of the County,
9 and its participating cities, in accordance with the provisions of Title I of the Housing and
10 Community Development Act of 1974, as amended, and the laws of the State of California; and
11 WHEREAS, on February 25, 2020, the County and the District entered into Agreement No.
12 20-082 ("Agreement"), whereby $158,220 in CDBG funds were made available to the District for
13 the Sierra Oaks Solar, Roofing, and ADA Improvements, Project No. 18011 ("Project"); and
14 WHEREAS, on May 10, 2023, the District informed the County that the total estimated cost
15 of the Project has increased from $158,220 to $242,086 due to increased construction costs; and
16 WHEREAS, the District is in need of $83,866 in additional CDBG funding to complete the
17 Project; and
18 WHEREAS, there is $83,866 in additional CDBG funds that can be made available to the
19 District for the Project this fiscal year.
20 NOW THEREFORE, in consideration of their mutual promises as hereinafter set forth, the
21 County and District agree to amend the Agreement as follows:
22 1. That Section I, subsections D, E, and F, beginning on Page 2, Line 14 and ending
23 on Page 2, Line 24 are replaced in their entirety with the following:
24 "D. The Project budget is estimated by the District as follows:
25 Construction $176,113
26 Design & Construction Engineering $ 43,966
27 Contingency, Permits & Misc. $ 22,007
28 Total $242,086

1 E. Notwithstanding District's estimates described in the Project budget above,
2 payments for the Project from CDBG funds will be limited to the District's actual costs and shall
3 not exceed the total amount of$242,086.
4 F. The proposed funding for the Project will be provided from the following
5 sources:
6 CDBG $242,086
7 Local Financial Contribution $0
8 Total $242,086"
9 2. That the dollar figure set forth on Page 3, Line 8; and Page 4, Line 14, is amended
10 in each such place to read "$242,086."
11 Both the County and District agree that this Amendment I is sufficient to amend the
12 Agreement, and that upon execution of this Amendment 1, the Agreement and this Amendment 1
13 together shall be considered the Agreement.
14 The Agreement, as hereby amended, is ratified and continued. All remaining provisions,
15 terms, covenants, conditions, and promises contained in the Agreement shall remain in full force
16 and effect.
