1 FIRST AMENDMENT TO AGREEMENT
2 THIS FIRST AMENDMENT TO AGREEMENT ("Amendment") is made and entered into this
3 6th day of August, 2019, by and between COUNTY OF FRESNO, a political subdivision of the State
4 of California, Fresno, California ("COUNTY"), and FRESNO ECONOMIC OPPORTUNITIES
5 COMMISSION, a California non-profit corporation, whose address is 1920 Mariposa Mall, Suite#300,
6 Fresno, CA 93721 ("CONTRACTOR").
7 WITNESSETH:
8 WHEREAS, COUNTY and CONTRACTOR entered into Agreement number A-18-117, dated
9 March 20, 2018 ("Agreement"), pursuant to which CONTRACTOR agreed to provide a construction
10 apprenticeship program for adult offenders to COUNTY; and
11 WHEREAS, COUNTY and CONTRACTOR now desire to amend the Agreement in order to
12 include language allowing for adjustments to the line item budget of up to 10% of the annual maximum
13 compensation.
14 NOW, THEREFORE, for good and valuable consideration, the receipt and adequacy of which
15 is hereby acknowledged, COUNTY and CONTRACTOR agree as follows:
16 1. The following language will be added beginning at Section Five of the Agreement,
17 located on page three, line seven:
18 "Changes to line items in the program budget which do not exceed ten percent(10%) of
19 the annual maximum compensation payable to CONTRACTOR may be made with the written approval
20 of both COUNTY's Chief Probation Officer or designee and CONTRACTOR, as long as these changes
21 do not result in a change to the total annual not to exceed amount of the Agreement."
22 COUNTY and CONTRACTOR agree that this Amendment is sufficient to amend the
23 Agreement, and that upon execution of this Amendment, the Agreement and this Amendment together
24 shall be considered the Agreement.
25 The Agreement, as hereby amended, is ratified and continued. All provisions, terms,
26 covenants, conditions and promises contained in the Agreement and not amended herein shall remain
27 in full force and effect.
