HomeMy WebLinkAboutAgreement A-12-258-1 with King-Sanger LLC.pdf Agreement No. 12-258-1 L-034 Piedra Library King-SangerLLC/Library/7511 1 2 AMENDMENT I TO LEASE AGREEMENT AGT. #12-258 3 This AMENDMENT I TO LEASE AGT. #12-258 ("AMENDMENT I") is made 4 and entered into this 10rh day of January 12017, between KING-SANGER 5 LLC., 1571 N Empire Lane, Clovis, CA 93619 (hereinafter "LESSOR") and the 6 COUNTY OF FRESNO, a political subdivision of the State of California, 333 Pontiac 7 Way, Clovis, CA 93612 (hereinafter "LESSEE"). 8 WHEREAS, LESSOR and LESSEE are Parties to that certain Lease 9 Agreement#12-258, dated June 5, 2012 (hereinafter "LEASE"), for the property at the 10 location commonly known as 25385 Trimmer Springs Road, Sanger, CA 93656, 11 (hereinafter "Premises"); and 12 WHEREAS, LESSEE uses the Premises as library space, and 13 WHEREAS, the LEASE is set to expire on December 18, 2016; and 14 WHEREAS, LESSOR and LESSEE (the "Parties") desire to continue the 15 ,LEASE, making the term month to month, effective December 19, 2016. 16 NOW, THEREFORE, for good and valuable consideration, the receipt and 17 adequacy of which is hereby acknowledged, the Parties agree as follows: 18 1. Section 2, "TERM," of this LEASE, located on page 1, lines 10 through 18, 19 is deleted in its entirety and replaced with the following: 20 "2. TERM — The term of this LEASE shall be twelve (12) months, for the period 21 December 19, 2011 through December 18, 2012. Beginning December 19, 2012, this 22 Lease shall automatically renew for a maximum of four (4) one-year periods, unless 23 one of the parties to this LEASE provides written notice of non-renewal to the other at 24 least one hundred eighty (180) days prior to December 18 of the then-current lease 25 year. As to LESSEE, the Director of Internal Services or the County Librarian, or a 26 designee of one of them, shall be authorized to provide such written notice of non- 27 renewal or written notice to terminate this LEASE as provided hereinbelow. 28 Effective December 19, 2016, this LEASE shall continue on a month to Moir COUNTY OF FRESNO Fresno,Califomia 1 L-034 Piedra Library King-SangerLLC/Library/7511 1 basis upon the terms provided herein, with rent payable monthly at the rate of $900.00 2 per month." 3 The Parties agree that this Amendment I is sufficient to amend the LEASE and 4 that, upon execution of this AMENDMENT I, the LEASE and this AMENDMENT I shall 5 together be considered the LEASE.
