HomeMy WebLinkAboutAgreement A-10-517-1 with Sunnyside Square Investments Inc..pdf Agreement No. 10-517-1 L-083 SunnysideLibrary SunnysideSquare/Library/7511 1 AMENDMENT I TO LEASE AGREEMENT AGT. #10-517 2 AMENDMENT I TO LEASE AGT. #10-517 (hereinafter "AMENDMENT I") is 3 made and entered into this day of 2015, between 4 SUNNYSIDE SQUARE INVESTMENTS, INC., (Correction, was LLC.), 2141 5 Tuolumne, Suite K, Fresno, CA 93721 (hereinafter "LESSOR") and the COUNTY OF 6 FRESNO, a political subdivision of the State of California, 2220 Tulare St., Suite 2100, 7 Room 2101, Fresno, California 93721-2106 (hereinafter "LESSEE"). 8 WHEREAS, LESSOR and LESSEE are Parties to that certain Lease 9 Agreement #10-517, dated September 21, 2010 (hereinafter "LEASE"), for the 10 property at the location commonly known as 5566 E. Kings Canyon, Fresno, CA 11 93727, (hereinafter "Premises"); and 12 WHEREAS, LESSEE uses the Premises as library space; and 13 WHEREAS, the LEASE is set to expire on October 20, 2015; and 14 WHEREAS, LESSOR and LESSEE (hereinafter the "Parties") desire to extend 15 the lease term, making the term month to month, effective October 21, 2015. 16 NOW, THEREFORE, for good and valuable consideration, the receipt and 17 adequacy of which is hereby acknowledged, the Parties agree as follows: 18 Section 2, "TERM," of this LEASE, located on page 1, lines 12 through 17, is 19 deleted in its entirety and replaced with the following: 20 "2. TERM - The initial term of this LEASE shall be for the period of October 21, 21 2010 through October 20, 2015. Effective October 21, 2015, notwithstanding any 22 other provisions of this LEASE, this LEASE will continue month to month, subject to all 23 the terms and conditions herein, until either party to this LEASE provides thirty (30) 24 days prior written notice to terminate this LEASE. Further, as to the County, the 25 County Librarian, or the Director of Internal Services/Chief Information Officer, or a 26 designee of one of them, is authorized to terminate this LEASE and to provide written 27 notice to terminate this LEASE." 28 The Parties agree that this Amendment 1 is sufficient to amend the LEASE and COUNTY OF FRESNO Fresno,California 1 L-083 SunnysideLibrary Sun nysideSquare/Library/7511 1 agree that this AMENDMENT I is sufficient to amend the LEASE and that, upon 2 execution of this AMENDMENT I, the LEASE and this AMENDMENT I shall together 3 be considered the LEASE.
