1 INTER-DEPARTMENTAL A G R E E M E N T
2 THIS INTER-DEPARTMENTAL AGREEMENT is made and entered into this 1s`day of January,
3 2023, by and between the COUNTY OF FRESNO, DEPARTMENT OF SOCIAL SERVICES, hereinafter
4 referred to as"DSS", and the COUNTY OF FRESNO, PROBATION DEPARTMENT, hereinafter referred
5 to as "PROBATION".
6 WITNESSETH:
7 WHEREAS, California Advancing and Innovating Medi-Cal (CaIAIM) is a long-term commitment to
8 transform and strengthen Medi-Cal, offering Californians a more equitable, coordinated, person-centered
9 approach to maximizing health; and
10 WHEREAS, California has received targeted expenditure authority through "Providing Access and
11 Transforming Health" (PATH) as part of its CaIAIM section 1115 demonstration to support programs
12 including the implementation of statewide justice-involved initiatives; and
13 WHEREAS, California statue (AB-133 Health; Chapter 143)mandates all counties implement pre-
14 release Medi-Cal enrollment and suspension processes by January 1, 2023 as part of the PATH Justice-
15 Involved Capacity Building Program.
16 NOW, THEREFORE, in consideration of their mutual covenants and conditions,the parties hereto
17 agree as follows:
18 1 SERVICES
19 A. PROBATION shall perform all services and fulfill all responsibilities as identified in
20 Exhibit A, under the heading "PROBATION Responsibilities", incorporated herein by reference and
21 made part of this Agreement.
22 B. DSS shall provide all services and fulfill all responsibilities as identified in Exhibit
23 A under the heading "DSS Responsibilities".
24 2. TERM
25 A. This Inter-Departmental Agreement shall be effective as of the 11t day of January
26 2023 and shall terminate on the 31st day of December 2024.
27 B. This agreement shall automatically be extended for two (2) additional twelve (12)
28 month periods upon the same terms and conditions set forth unless written notice of non-renewal is

1 given by either party no later than thirty (30) days prior to the renewal period.
2 3. TERMINATION
3 This Inter-Departmental Agreement may be terminated by either party upon the giving of
4 thirty (30) days advance written notice of an intention to terminate. However, termination of this Inter-
5 Departmental Agreement shall not affect any pending activities, which shall be handled to their
6 conclusion by either DSS and/or PROBATION.
7 4. MODIFICATION
8 A. Any matters of this Inter-Departmental Agreement may be modified from time to
9 time by the mutual written consent of DSS and PROBATION without, in any way, affecting the
10 remainder.
11 5. ASSIGNMENT AND SUBCONTRACTS
12 Neither party shall assign, transfer, or subcontract this Inter-Departmental Agreement nor
13 their rights or duties under this Agreement without the prior written consent of the other party.
14 6. RELATIONSHIP OF PARTIES
15 It is understood that this is an Inter-departmental Agreement by and between two (2)
16 separate departments of the County of Fresno and is not intended to and shall not be construed to
17 create a relationship of agent, servant, employee, partnership,joint venture, or association.
18 7. DATA SECURITY
19 For the purpose of preventing the potential loss, misappropriation or inadvertent
20 disclosure of PROBATION data including sensitive or personal client information; abuse of County
21 resources; and/or disruption to County operations, DSS must employ adequate data security measures
22 to protect the confidential information provided to the DSS by PROBATION, for the purpose of providing
23 services under this Inter-Departmental Agreement as required by the County Administrative Office
24 Management Directives, Chapter 1300, Information Services.
25 8. CONFIDENTIALITY AND MEDI-CAL PRIVACY
26 All services performed by DSS and PROBATION underthis Inter-Departmental
27 Agreement shall be in strict conformance with all applicable Federal, State of California, and/or local
28 laws and regulations relating to confidentiality including, but not limited to: California Welfare and

1 Institutions Code Sections 10850 and 14100.2, the CDSS Manual of Policies and Procedures, Division
2 19-000, and the California Department of Health Care Services (DHCS) Medi-Cal Eligibility Procedures
3 Manual, Section 2H. In addition, all services performed by DSS and PROBATION under this Agreement
4 shall also be in conformance with the Medi-Cal Data Privacy and Security Agreement between DHCS
5 and the County of Fresno (hereinafter referred to as the "Medi-Cal Data Agreement") that is then in
6 effect, which is by this reference incorporated herein. The current Medi-Cal Data Agreement is available
7 upon request or can be viewed at: http://www.fresngcountyca.gov/MediCa]Privacy. The purpose of this
8 section is to assure that all applications and records concerning program recipients shall be kept
9 confidential and shall not be opened to examination, publicized, disclosed, or used for any purpose not
10 directly connected with the administration of the program. DSS and PROBATION shall inform all of its
11 employees, agents, officers, and subcontractors of this provision; and that any person knowingly and
12 intentionally violating this provision is guilty of a misdemeanor.
13 9. GOVERNING LAW
14 The rights and obligations of the parties and all interpretation and performances of this
15 Inter-Departmental Agreement shall be governed in all respects by all Federal, State, and local statutes
16 and regulations.
17 10. ENTIRE AGREEMENT
18 This Inter-Departmental Agreement, including all Exhibits, constitutes the entire Inter-
19 Departmental Agreement between PROBATION and DSS with respect to the subject matter hereof, and
20 supersedes all previous agreements, negotiations, proposals, commitments, writings, advertisements,
21 publications, and understandings of any nature whatsoever unless expressly included in this Inter-
22 Departmental Agreement.

SUMMARY OF SERVICES
ORGANIZATIONS: Department of Social Services and Probation Department
SERVICE: CaIAIM-Justice Involved Medi-Cal Pre-release Enrollment
CONTRACT PERIOD: January 1, 2023— December 31, 2026
PROJECT DESCRIPTION:
The County of Fresno Probation Department and the County of Fresno Department of Social
Services (DSS) shall exchange information necessary to implement the California State
mandated Medi-Cal pre-release enrollment and suspend/unsuspend benefits processes for the
Fresno County Probation Department juvenile justice-involved population.
PROBATION RESPONSIBILITIES:
DSS will be provided access to an electronic roster which will include names of recently
detained juveniles, recently incarcerated juveniles with a known release date, and
juveniles released the prior week.
o Demographics for each listed juvenile to include:
✓ Date of birth
✓ Social security number
✓ Release date
✓ Address
✓ Mother's name, phone number, address, primary language
✓ Father's name, phone number, address, primary language
✓ Guardian's name, phone number, address, primary language
• Submit to DSS via a secure method mutually agreed upon by PROBATION and DSS,
pre-release Medi-Cal applications completed on behalf of juvenile wards.
• For youth housed in the Juvenile Justice Campus (JJC) for 30 days or more, Probation
will provide Medi-Cal pre-release application services to youth and/or youth's families.
DSS RESPONSIBILITIES:
a Access the electronic rosters maintained by PROBATION on a weekly basis:
o Screen individuals for Medi-Cal coverage.
o Suspend Medi-Cal benefits of incarcerated individuals.
o Unsuspend Medi-Cal benefits of individuals upon notification of release from
incarceration from PROBATION.
• Receive and process individual Medi-Cal applications consistent with applicable laws,
regulations, and time frames.
• Provide initial and ongoing Medi-Cal application training and assistance to PROBATION
staff as needed.
® Provide to PROBATION Medi-Cal information and messaging relevant to the juvenile
justice-involved population in the form of fliers, posters, and various other media.
• For youth housed in the JJC for less than 30 days, DSS will provide Medi-Cal pre-
release application services to youth/families
