Attached please find the electronic copy of Fresno County Probation Department's Probation
Specialized Units (PU) Program application for the grant subaward performance period
beginning October 1, 2022 and ending September 31, 2023.
Due to the meeting schedule and processing requirements for agenda items to reach the Fresno
County Board of Supervisors, it was not possible to secure formal authorization prior to the
submittal of this application.
We expect the application to be submitted to the Board of Supervisors as soon as possible. Upon

Subrecipients agree to adhere to the following and ensure these assurances are passed
down to Second-Tier Subrecipients.
1. Required Audits and Financial Statements (SRH Section 14.005)
Subrecipients expending $750,000 or more in federal funds annually must comply
with the single audit requirement established by the Federal Office of
Management and Budget (OMB) Uniform Guidance 2 CFR Part 200, Subpart F and
arrange for a single audit by an independent Certified Public Accountant (CPA)
firm annually. Audits conducted under this section will be performed using the
guidelines established by the American Institute of Certified Public Accountants
(AICPA) for such audits.

2. Requirements of the Award; Remedies for Non-compliance or for Materially False
Statements
The conditions of this award are material requirements of the award. Compliance
with any assurances or certifications submitted by or on behalf of the Subrecipient
that relate to conduct during the period of performance also is a material
requirement of this award.
By signing and accepting this award on behalf of the Subrecipient, the authorized
Subrecipient official accepts all material requirements of the award, and specifically
adopts, as if personally executed by the authorized Subrecipient official, all
assurances or certifications submitted by or on behalf of the Subrecipient that relate
to conduct during the period of performance.

Failure to comply with any one or more of these award requirements -- whether a
condition set out in full below, a condition incorporated by reference below, or an
assurance or certification related to conduct during the award period -- may result
in the Office on Violence Against Women (OVW) taking appropriate action with
respect to the recipient and the award. Among other things, OVW may withhold
award funds, disallow costs, or suspend or terminate the award. DOJ, including
OVW, also may take other legal action as appropriate.
Any materially false, fictitious, or fraudulent statement to the federal government
related to this award (or concealment or omission of a material fact) may be the
subject of criminal prosecution (including under 18 U.S.C. 1001 and/or 1621 , and/or
34 U.S.C. 10271-10273), and also may lead to imposition of civil penalties and
administrative remedies for false claims or otherwise (including under 31 U.S.C. 3729-
3730 and 3801-3812).
Should any provision of a requirement of this award be held to be invalid or
unenforceable by its terms, that provision shall first be applied with a limited
construction so as to give it the maximum effect permitted by law. Should it be held,
instead, that the provision is utterly invalid or-unenforceable, such provision shall be
deemed severable from this award.
3. Applicability of Part 200 Uniform Requirements and DOJ Grants Financial Guide
The Uniform Administrative Requirements, Cost Principles, and Audit Requirements in
2 C.F.R. Part 200, as adopted and supplemented by the DOJ in 2 C.F.R. Part 2800
(together, the "Part 200 Uniform Requirements") and the current edition of the DOJ
Grants Financial Guide as posted on the OVW website, including any updated
version that may be posted during the period of performance apply to this Grant
Subaward.
The Subrecipient also agrees that all financial records pertinent to this award,
including the general accounting ledger and all supporting documents, are subject
to Cal OES's review throughout the life of the award, during the close-out process,
and for three years after submission of the final Federal Financial Report (SF-425) or
as long as the records are retained, whichever is longer, pursuant to 2 C.F.R. 200.334,
200.337.

4. Requirements Related to System for Award Management and Unique Entity Identifier
Subrecipients (and any Second-Tier Subrecipients) must comply with applicable
requirements regarding the System for Award Management (SAM), currently
accessible at https://www.sam.gov/. This includes applicable requirements

regarding registration with SAM, as well as maintaining the currency of information in
SAM.
Subrecipients also must comply with applicable restrictions for Second-Tier
Subawards, including restrictions on Grant Subawards to entities that do not acquire
and provide (to Subrecipients) the unique entity identifier required for SAM
registration.
The details of the Subrecipients' obligations related to SAM and to unique entity
identifiers are posted on the OVW website at https://www.justice.gov/ovw/award-
conditions (Award Condition: Requirements related to System for Award
Management (SAM) and unique entity identifiers), and are incorporated by
reference here.
5. Requirement to Report Actual or Imminent Breach of Personally Identifiable
Information
Subrecipients (and any Second-Tier Subrecipients) must have written procedures in
place to respond in the event of an actual or imminent "breach" (OMB M-17-12) if
they:
• Create, collect, use, process, store, maintain, disseminate, disclose, or dispose of
"Personally Identifiable Information (PII)" (2 CFR 200.1) within the scope of an OVW
grant-funded program or activity, or
• Use or operate a "Federal information system" (OMB Circular A-130).
Subrecipients (and any Second-Tier Subrecipients) must have breach procedures
that must include a requirement to report actual or imminent breach of PH to
Cal OES no later than 24 hours after an occurrence of an actual breach, or the
detection of an imminent breach.
6. Requirements Pertaining to Prohibited Conduct Related to Trafficking in Persons
(including reporting requirements and OVW Authority to Terminate Grant Subaward)
Subrecipients (and any Second-Tier Subrecipients) must comply with all applicable
requirements (including requirements to report allegations) pertaining to prohibited
conduct related to the trafficking of persons, whether on the part of Subrecipients
(and any Second-Tier Subrecipients), or individuals defined (for purposes of this
condition) as "employees" of Subrecipients (and any Second-Tier Subrecipients).
The details of the Subrecipients' obligations related to prohibited conduct related to
trafficking in persons are posted on the OVW website at
https://www.justice.gov/ovw/award-conditions (Award Condition: Prohibited
conduct by Subrecipients related to trafficking in persons (including reporting

7. Determination of Suitability to Interact with Participating Minors
This condition applies to the Grant Subaward (if it is indicated) when some or all of
the activities to be carried out under the Grant Subaward (whether by Subrecipients,
or Second-Tier Subrecipients) is to benefit a set of individuals under 18 years of age.
Subrecipients (and any Second-Tier Subrecipients) must make determinations of
suitability before certain individuals may interact with participating minors. This
requirement applies regardless of an individual's employment status.

8. Compliance with Applicable Rules Regarding Approval, Planning, and Reporting of
Conferences, Meetings, Trainings, and Other Events
Subrecipients (and any Second-Tier Subrecipients) must comply with all applicable
laws, regulations, policies, and official DOJ guidance (including specific cost limits,
prior approval and reporting requirements, where applicable) governing the use of
federal funds for expenses related to conferences (as that term is defined by DOJ),
including the provision of food and/or beverages at such conferences, and costs of
attendance at such conferences.

to this Grant Subaward appears on the OVW website at

9. OVW Training Guiding Principles
Subrecipients (and any Second-Tier Subrecipients) agree that they will adhere to the
OVW Training Guiding Principle for Grantee and Subgrantees (available at
https://www.justice.gov/ovw/resources-and-fags-grantees#Discretionary) for all
training or training materials developed or delivered with these funds.
10. Potential Imposition of Additional Requirements
Subrecipients (and any Second-Tier Subrecipients) agree to comply with any
additional requirements that may be imposed by the DOJ awarding agency (OJP or
OVW, as appropriate) during the period of performance for this Grant Subaward, if
Subrecipients are designated as "high-risk" for purposes of the DOJ high-risk grantee
list.

11. Compliance with DOJ Regulations Pertaining to Civil Rights and Nondiscrimination -
28 C.F.R. Part 42
Subrecipients (and any Second-Tier Subrecipients) must comply with all applicable
requirements of 28 C.F.R. Part 42, specifically including any applicable requirements
in Subpart E of 28 C.F.R. Part 42 that relate to an equal employment opportunity
program.
12. Compliance with DOJ Regulations Pertaining to Civil Rights and Nondiscrimination -
28 C.F.R. Part 38
Subrecipients (and any Second-Tier Subrecipients) must comply with all applicable
requirements of 28 C.F.R. Part 38.
Currently, among other things, 28 C.F.R. Part 38 includes rules that prohibit specific
forms of discrimination on the basis of religion, a religious belief, a refusal to hold a
religious belief, or refusal to attend or participate in a religious practice. Part 38,
currently, also sets out rules and requirements that pertain to Subrecipient
organizations (and any Second-Tier Subrecipient organizations) that engage in or
conduct explicitly religious activities, as well as rules and requirements that pertain to
Subrecipients (and any Second-Tier Subrecipients) that are faith-based or religious
organizations.
13. Compliance with DOJ Regulations Pertaining to Civil Rights and Nondiscrimination -
28 C.F.R. Part 54
Subrecipients (and any Second-Tier Subrecipients) must comply with all applicable
requirements of 28 C.F.R. Part 54, that relate to nondiscrimination on the basis of sex
in certain "educational programs."
14. Restrictions on 'lobbying" and Policy Development
In general, as a matter of federal law, federal funds awarded by OVW may not be
used by Subrecipients (and any Second-Tier Subrecipients), either directly or
indirectly, to support the enactment, repeal, modification, or adoption of any law,
regulation, or policy, at any level of government, in order to avoid violation of 18
U.S.C. 1913. Subrecipients (or any Second-Tier Subrecipients) may, however, use
federal funds to collaborate with and provide information to federal, state, local,
tribal and territorial public officials and agencies to develop and implement policies
and develop and promote state, local, or tribal legislation or model codes designed
to reduce or eliminate domestic violence, dating violence, sexual assault, and
stalking (as those terms are defined in 34 U.S.C. 12291 (a)) when such collaboration
and provision of information is consistent with the activities otherwise authorized

Another federal law generally prohibits federal funds awarded by OVW from being
used by Subrecipients (and any Second-Tier Subrecipients), to pay any person to
influence (or attempt to influence) a federal agency, a Member of Congress, or
Congress (or an official or employee of any of them) with respect to the awarding of
a federal grant or cooperative agreement, subgrant, contract, subcontract, or loan,
or with respect to actions such as renewing, extending, or modifying any such
award. See 31 U.S.C. 1352. Certain exceptions to this law apply, including an
exception that applies to Indian tribes and tribal organizations.
Should any question arise as to whether a particular use of federal funds by a
Subrecipient (or any Second-Tier Subrecipient) would or might fall within the scope
of these prohibitions, the Subrecipient is to contact Cal OES for guidance, and may

15. Compliance with General Appropriations-law Restrictions on the use of Federal
Funds
Subrecipients (and any Second-Tier Subrecipients) must comply with all applicable
restrictions on the use of federal funds set out in federal appropriations statutes.

by reference here.

16. Reporting Potential Fraud, Waste, and Abuse, and Similar Misconduct
Subrecipients (and any Second-Tier Subrecipients) must promptly refer to Cal OES
any credible evidence that a principal, employee, agent, Subrecipient, contractor,
subcontractor, or other person has, in connection with funds under this Grant
Subaward-- (1 ) submitted a claim that violates the False Claims Act; or
(2) committed a criminal or civil violation of laws pertaining to fraud, conflict of
interest, bribery, gratuity, or similar misconduct.
Potential fraud, waste, abuse, or misconduct involving or relating to funds under this
Grant Subaward should must also be reported to Cal OES. Additional information is

17. Restrictions and Certifications Regarding Non-disclosure Agreements and Related
Matters

No Subrecipients (and any Second-Tier Subrecipients) under this Grant Subaward, or
entity that receives a procurement contract or subcontract with any funds under this
Grant Subaward, may require any employee or contractor to sign an internal
confidentiality agreement or statement that prohibits or otherwise restricts, or
purports to prohibit or restrict, the reporting (in accordance with law) of waste, fraud,
or abuse to an investigative or law enforcement representative of a federal
department or agency authorized to receive such information.
The foregoing is not intended, and shall not be understood by the agency making
this Grant Subaward, to contravene requirements applicable to Standard Form 312
(which relates to classified information), Form 4414 (which relates to sensitive
compartmented information), or any other form issued by a federal department or
agency governing the nondisclosure of classified information.
a. In accepting this Grant Subaward, Subrecipients (and any Second-Tier
Subrecipients):
1 ) Represent that they neither require, nor have required, internal confidentiality
agreements or statements from employees or contractors that currently
prohibit or otherwise currently restrict (or purport to prohibit or restrict)
employees or contractors from reporting waste, fraud, or abuse as described

obligations only if expressly authorized to do so by Cal OES.
b. If Subrecipients are authorized under this award to make Second-Tier Subawards,
procurement contracts, or both:
1 ) Subrecipients represent that:
a) No other entity (whether through a Second-Tier Subaward ("subgrant"),
procurement contract, or subcontract under a procurement contract) that
they pass funds to either requires or has required internal confidentiality
agreements or statements from employees or contractors that currently
prohibit or otherwise currently restrict (or purport to prohibit or restrict)
employees or contractors from reporting waste, fraud, or abuse as
described above; and
b) Appropriate inquiry has been made, or otherwise Subrecipients have an
adequate factual basis, to support this representation; and

2) If learned or notified that any Second-Tier Subrecipient, contractor, or
subcontractor entity that receives funds under this Grant Subaward is, or has

reporting of waste, fraud, or abuse as described above, they will immediately
stop any further obligations of Grant Subaward funds to or by that entity, will
provide prompt written notification to Cal OES, and will resume (or permit
resumption of) such obligations only if expressly authorized to do so by
Cal OES.
18. Compliance with 41 U.S.C. 4712 (including prohibitions on reprisal; notice to
employees)
Subrecipients (and any Second-Tier Subrecipients) must comply with, and are
subject to, all applicable provisions of 41 U.S.C. 4712, including all applicable
provisions that prohibit, under specified circumstances, discrimination against an
employee as reprisal for the employee's disclosure of information related to gross
mismanagement of a federal grant, a gross waste of federal funds, an abuse of
authority relating to a federal grant, a substantial and specific danger to public
health or safety, or a violation of law, rule, or regulation related to a federal grant.
Subrecipients (and any Second-Tier Subrecipients) also must inform their employees,
in writing (and in the predominant native language of the workforce), of employee
rights and remedies under 41 U.S.C. 4712.
19. Encouragement of Policies to Ban Text Messaging while Driving
Pursuant to Executive Order 13513, "Federal Leadership on Reducing Text Messaging
While Driving," 74 Fed. Reg. 51225 (October 1 , 2009), the DOJ encourages
Subrecipients (and any Second-Tier Subrecipients) to adopt and enforce policies
banning employees from text messaging while driving any vehicle during the course
of performing work funded by this Grant Subaward, and to establish workplace
safety policies and conduct education, awareness, and other outreach to decrease
crashes caused by distracted drivers.
20. Compliance with Statutory and Regulatory Requirements
Subrecipients (and any Second-Tier Subrecipients) agree to comply with all relevant
statutory and regulatory requirements, which may include, among other relevant
authorities, the Violence Against Women Act of 1994, P.L. 103-322, the Violence
Against Women Act of 2000, P.L. 106-386, the Violence Against Women and
Department of Justice Reauthorization Act of 2005, P.L. 109-162, the Violence
Against Women Reauthorization Act of 2013, P.L. 1 13-4, the Omnibus Crime Control
and Safe Streets Act of 1968, 34 U.S.C. 10101 et seq., and OVW's implementing
regulations at 28 C.F.R. Part 90.

21. VAWA 2013 Nondiscrimination Condition
Subrecipients (and any Second-Tier Subrecipients) acknowledge that 34 U.S.C.
12291 (b)(13) prohibits Subrecipients of OVW awards from excluding, denying
benefits to, or discriminating against any person on the basis of actual or perceived
race, color, religion, national origin, sex, gender identity, sexual orientation, or
disability in any program or activity funded in whole or in part by OVW. Subrecipients
may provide sex-segregated or sex-specific programming if doing so is necessary to
the essential operations of the program, so long as the Subrecipient provides
comparable services to those who cannot be provided with the sex-segregated or
sex-specific programming. The Subrecipient (and any Second-Tier Subrecipient)
agrees that it will comply with this provision.
22. Misuse of Award Funds
Subrecipients (and any Second-Tier Subrecipients) understand and agree that
misuse of award funds may result in a range of penalties, including suspension of
current and future funds, suspension or debarment from federal grants, recoupment
of monies provided under an award, and civil and/or criminal penalties.
23. Confidentiality and Information Sharing
Subrecipients (and any Second-Tier Subrecipients) agrees to comply with the
provisions of 34 U.S.C. 12291 (b)(2), nondisclosure of confidential or private
information, which includes creating and maintaining documentation of
compliance, such as policies and procedures for release of victim information.
Subrecipients (and any Second-Tier Subrecipients) also agree to comply with the
regulations implementing this provision at 28 CFR 90.4(b) and "Frequently Asked
Questions (FAQs) on the VAWA Confidentiality Provision (34 U.S.C. 12291 (b)(2))" on
the OVW website at https://www.justice.gov/ovw/resources-and-fags-grantees.
24. Activities that Compromise Victim Safety and Recovery or Undermine Offender
Accountability
Subrecipients (and any Second-Tier Subrecipients) agree that Grant Subaward funds
will not support activities that compromise victim safety and recovery or undermine
offender accountability, such as: procedures or policies that exclude victims from
receiving safe shelter, advocacy services, counseling, and other assistance based
on their actual or perceived sex, age, immigration status, race, religion, sexual
orientation, gender identity, mental health condition, physical health condition,
criminal record, work in the sex industry, or the age and/or sex of their children;
procedures or policies that compromise the confidentiality of information and
privacy of persons receiving OVW-funded services; procedures or policies that
impose requirements on victims in order to receive services (e.g., seek an order of
protection, receive counseling, participate in couples' counseling or mediation,
report to law enforcement, seek civil or criminal remedies, etc.); procedures or

policies that fail to ensure service providers conduct safety planning with victims;
project design and budgets that fail to account for the access needs of participants
with disabilities and participants who have limited English proficiency or are Deaf or
hard of hearing; or any other activities outlined in the solicitation or companion
guide under which the application was submitted.
25. Policy for Response to Workplace-related Incidents of Sexual Misconduct, Domestic
Violence, and Dating Violence
Subrecipients (and any Second-Tier Subrecipients) must have a policy, or issue a
policy within 270 days of the award date, to address workplace-related incidents of
sexual misconduct, domestic violence, and dating violence involving an employee,
volunteer, consultant, or contractor. The details of this requirement are posted on
the OVW website at https://www.justice.gov/ovw/award-conditions (Award
Condition: Policy for response to workplace-related sexual misconduct, domestic
violence, and dating violence), and are incorporated by reference here.
26. Performance Progress Reports and Final Report Submission
Subrecipients agree to submit an annual report that includes: a) an assessment of
whether stated goals and objectives were achieved; b) information on the
effectiveness of activities carried out with grant funds, including the number of
persons served and the number of persons seeking services who could not be
served; and c) such other information as OVW may prescribe. Subrecipients must use
the designated forms and/or systems made available by OVW for performance
reporting, which identify the information that Subrecipients must collect and report
as a condition of receiving funding under this award
27. Publications Disclaimer for STOP Formula Subrecipients
Subrecipients (and any Second-Tier Subrecipients) agree that all materials and
publications (written, web-based, audio-visual, or any other format) resulting from
subaward activities shall contain the following statement: "This project was
supported by Subgrant No. Pu22 01 0100 awarded by the state administering
office for the Office on Violence Against Women, U.S. Department of Justice's STOP
Formula Grant Program. The opinions, findings, conclusions, and recommendations
expressed in this publication/program/exhibition are those of the author(s) and do
not necessarily reflect the views of the state or the U.S. Department of Justice."
28. Copyrighted Works
Pursuant to 2 C.F.R. 200.315(b), Subrecipients (and any Second-Tier Subrecipients)
may copyright any work that is subject to copyright and was developed, or for
which ownership was acquired, under this award. OVW reserves a royalty-free,
nonexclusive, and irrevocable right to reproduce, publish, or otherwise use the work,
in whole or in part (including in the creation of derivative works), for federal

purposes, and to authorize others to do so.
OVW also reserves a royalty-free, nonexclusive, and irrevocable right to reproduce,

of this award, for federal purposes, and to authorize others to do so.
In addition, Subrecipients (and any Second-Tier Subrecipients or contractors) must
obtain advance written approval from Cal OES, and must comply with all conditions
specified by Cal OES in connection with that approval, before: 1) using award funds

29. Ongoing Compliance with Statutory Certifications
Subrecipients (and any Second-Tier Subrecipients) agree that compliance with the
statutory certification requirements is an ongoing responsibility during the award
period and that, at a minimum, a hold may be placed on the Subrecipient's funds
for noncompliance with any of the requirements of 34 U.S.C. 10449 (regarding rape
exam payments), 34 U.S.C. 10449(e) (regarding judicial notification), 34 U.S.C. 10450
(regarding certain fees and costs), and 34 U.S.C. 10451 (regarding polygraphing of
sexual assault victims). Non-compliance with any of the foregoing may also result in
termination or suspension of the grant or other remedial measures, in accordance
with applicable laws and regulations.
30. Requirements for Subrecipients Providing Legal Assistance
Subrecipients (and any Second-Tier Subrecipients) agree that the legal assistance
eligibility requirements, as set forth below, are a continuing obligation on the part of
Subrecipients (and any Second-Tier Subrecipients).
a. The legal assistance eligibility requirements are:
1 ) any person providing legal assistance through a program funded under this
grant program
a) has demonstrated expertise in providing legal assistance to victims of
domestic violence, dating violence, sexual assault, or stalking in the
targeted population; or

b) is partnered with an entity or person that has demonstrated expertise
described in subparagraph (a); and
c) has completed or will complete training in connection with domestic
violence, dating violence, stalking, or sexual assault and related legal

dating violence homicide;
2) any training program conducted in satisfaction of the requirement of
paragraph (1) has been or will be developed with input from and in
collaboration with a state, local, territorial, or tribal domestic violence, dating
violence, sexual assault, or stalking victim service provider or coalition, as well
as appropriate state, local, territorial, and tribal law enforcement officials;
3) any person or organization providing legal assistance through this grant
program has informed and will continue to inform state, local, territorial, or
tribal domestic violence, dating violence, stalking, or sexual assault programs
and coalitions, as well as appropriate state and local law enforcement
officials of their work; and
4) Subrecipients' (and any Second-Tier Subrecipients') organizational policies do
not require mediation or counseling involving offenders and victims physically
together, in cases where sexual assault, dating violence, domestic violence, or
child sexual abuse is an issue. Subrecipients also agrees to ensure that any
Second-Tier Subrecipient will comply with this condition.

The County of Fresno is applying to Cal OES for a competitive $100,000
Probation Specialized Units Program. If awarded, the $100,000 Cal OES grant
funds will provide: the full salary ($49,884) and benefits ($39,738) for one full-time
Victim-Witness Advocate (VWA) and a portion of the salary ($10,378) for one full-
time Deputy Probation Officer (PDO) assigned to VOISE. The salary range does
not include any mid-year adjustments. These charges are subject to actual
charges and/or mid grant year adjustments. The Probation Department will
provide in our budget for other costs associated with the VOISE program that
are not covered by the grant funds, and the required match. Costs to be
charged to the Department's budget are: the remaining salary and benefits of
the DPO position and the VOISE program's total operating expenses. This
includes risk management charges; communication charges; travel/per diem
for staff attendance at mandatory Cal OES meetings; use of a Probation
vehicle; other administrative salaries related to the VOISE program: include the
Domestic Violence Assistant Deputy Chief Probation Officer (ADC) as Program

Center; and business and office support personnel. There will be no
subcontracts and no unusual expenses are expected.
The PM will have administrative responsibility for implementing and
overseeing the day-to-day operations of the VOISE program; while the FO will
review forms for compliance with regulations and procedures regarding all
financial matters, ensuring the appropriate expenditure of Cal OES grant funds.
The DPO position will be responsible for intensely supervising high-risk offenders
who are on probation for Domestic Violence, Sexual Assault, Dating Violence,
and/or Stalking. The DPO will be responsible for the level of supervision
described in this proposal. The VWA will collaborate with the DPO to meet the
needs and concerns of victims of offenders enrolled in the VOISE program. The
VWA will be responsible for all victim services and collaborative activities
described in this proposal. Within the Probation Department's organizational
chart, the VOISE Program is placed in the Domestic Violence/Sex
Offender/Child Abuse/Elder Abuse Unit of the Adult Division. It will operate as a
separate specialized function under the authority of the PM. All staff assigned to
the VOISE Program will be committed to the stated goals and objectives of the
VOISE Program, regardless of funding streams.

PROBLEM STATEMENT
Fresno County is the sixth largest, of 58 California counties, covering 6,017 square
miles supporting rural and urban lifestyles in a variety of landscapes. According to
the California Department of Finance, Fresno is the tenth most populated county
with more than 1 million residents. Sixty-five percent of the County's population
resides near the center of the county in the densely populated, adjoining cities of
Fresno and Clovis. The balance resides in suburban, rural, and agricultural areas
of Fresno County, which encompasses 13 small cities, 42 towns, and many remote
settlements that offer limited or no direct services to residents. Between 2005 and
2015, Fresno County's population increased by 10.4%, nearly twice the statewide
growth rate of 5.6%. Fresno County is home to 112 distinct cultural groups with
extensive diversity in language, customs, and norms. Fresno County faces to
providing services to a growing population with limited resources, victims'
reluctance to reporting crimes against women and seeking help from outsiders
due to a lack of trust, as well as having effective communication -requiring
translation services and written materials with limited resources. In 2020, domestic
violence cases in Fresno increased 17%, while domestic violence calls to the
Fresno Police Department spiked 173% in January 2021 . Fresno County currently
utilizes the Violent Offender Intensive Supervision Endeavor (VOISE) program

which employs a full-time Deputy Probation Officer IV (DPO) and a full-time
Victim-Witness Advocate (VWA). The goal of this program is to intensely monitor
offenders while minimizing further trauma to victims and families by providing
victim protection and referrals to supportive services and counseling. A specific
protocol of intensive supervision has been developed for this program. The DPO
develops individualized case plans targeting each offender's needs, with
intensive supervision, to encourage the offender to follow the plan. The VWA
enrolls victims in the VOISE program to provide, through referrals, supportive
services, and counseling. DPO caseloads do not exceed 40 probationers to allow
weekly contact for those in community supervision who are in compliance.
Contact will be 40% face-to-face, 40% in the field, and 20% phone contact.
Fresno County Probation's strategy to strengthen supervision of these violent
probationers involves ongoing awareness training, continuing use of the VOISE
program, further developing existing protocols through collaborative efforts, and
continuing development and use of individualized case plans targeting each
offender's needs.

PLAN
1) Describe minimum qualifications of proposed staff:
VOISE is led by the Assistant Deputy Chief Probation Officer (ADC) assigned to
the Domestic Violence (DV) unit and staffed by a full-time DPO and a full-time
VWA.
Minimum qualifications for an ADC include a bachelor's degree and five years
of experience as a sworn peace officer in the Probation Department.
Minimum requirements for the VOISE DPO include a bachelor's degree and at
least one year of experience supervising probationers as a sworn, armed peace
officer.
Minimum requirements for the VOISE VWA:
Option 1 : Possession of a bachelor's degree which is acceptable within the
United States' accredited college or university system in Psychology, Sociology,
Social Work, Criminology, or a closely related field.

OPTION 2:
Completion of sixty (60) semester units of coursework which is acceptable within
the United States from an accredited college or university system. At least
fifteen (15) of the required semester units must be in Psychology, Sociology,
Social Work, Criminology, or a closely related field.
And
Two (2) years of full-time, paid work experience in victim services providing
intake, counseling, and referral services.
2) Describe the criteria for probationer case assignment(s) to the unit:
All new probation felony DV cases will be reviewed by the ADC. Those
representing the greatest risk to reoffend, as well as those who represent the
greatest risk to the victim and/or public, based upon the score calculated from
the screening tool (STRONG-R), will be referred to VOISE. Currently, a majority of
the cases assigned to the VOISE caseload are High-Risk/Violent felony cases.
The following priority is used to accept cases for VOISE. Offenders convicted of:
• A violent felony crime

• A violent misdemeanor crime when the case was originally filed as a
felony
• A misdemeanor crime where there is an established pattern of crime
related to DV, sexual assault, dating violence, and/or stalking
3) Provide projected statistics for the following:
• Number of probationers during the reporting period 62
• Number of field contacts made with victims 30
• Number of in-person office contacts made with victims 25
• Number of telephone contacts made with victims 350
• Number of contacts with victims 400
4) Firearms prohibition:
Automated Firearms System (AFS) will be used to search program-specific
probationers and identify those offenders possessing firearms. Each offender
assigned to the VOISE caseload will generate a search using the firearms
registration databases, including the AFS; thus, facilitating the removal of any
prohibited firearms) from the offender and subsequent violation charges being
filed. The number of program-specific probationers searched using AFS will be
reported. Fresno County anticipate approximately 30 searches will be made by

the VOISE DPO. The results of AFS searches will be kept in the individual VOISE
offender's case file and reported annually to Cal OES.
The VOISE DPO will ensure the following:
• The number of offenders found in possession of firearms will be reported
and, if applicable, the removal of a firearm from a probationer's
possession will be described.
• Each positive result, from an AFS search for weapons registered to a VOISE
probationer, will result in Probation initiating a residence search. Searches
and any resulting confiscated contraband will be noted in VOISE
probationers' case files.
• Each residence search where presence of weapons is suspected will
involve local law enforcement partners, who will confiscate any firearms
and generate new law violation reports, as appropriate.
• All weapons in the possession of, accessible by, or surrendered by VOISE
probationers will be confiscated or received through Probation's
partnership with local law enforcement, in compliance with DOJ
regulations.

• The number of VOISE probationers found in possession of firearms and the
details of removal of firearms will be reported to Cal OES annually.
• Contact probationers on the caseload by telephone or by mail to ensure
each probationer understands the provisions of the firearm prohibitions.
Upon entering Probation, each offender is given "Probation Instructions," which
include prohibition to acquire or possess a firearm, pursuant to Sections 1202. 1
and 29800 of the Penal Code. Each offender must sign, acknowledging that
he/she has received a copy of the conditions of probation. In addition, each
assigned offender will receive an in-person explanation of firearms prohibitions.
The VOISE DPO and VWA will work in partnership with the DOJ to identify and
distribute educational materials on firearms prohibition and confiscation laws to:
victims, probationers, firearms dealers, law enforcement agencies, the courts,
victim advocates, service providers, and victims of DV.
5) Describe the plan for development and implementation of training to ensure
Specialized Unit Probation Officer(s) assigned to the program received required
training:
The Fresno County Probation Department will send the VOISE DPO and/or the
VWA to training when appropriate and as required by Cal OES.

6) Describe how the monthly probation caseload is determined and maintained
at a reduced level:
Cases are assigned to the VOISE caseload by the VOISE ADC. Cases are added
to the caseload due to attrition by the expirations of probation and
probationers that are committed to the California Department of Corrections
and Rehabilitation. At the end of each month, the number of active VOISE
probationers on the caseload will be recorded. Weekly contacts are audited
monthly by the VOISE ADC. The monthly totals will be totaled at the end of the
contract period and divided by 12 to produce the average number on the
caseload. It is anticipated that there will be an average of 30 probationers
intensively supervised under VOISE during the reporting period. Movement of a
VOISE case to inactive status will be considered when, the offender is in custody
for longer than 30 days or has fled with whereabouts unknown for 30 or more
days. At no time shall the number of cases on inactive status exceed 20% of the
overall cases assigned to VOISE. While a case is on inactive status, weekly
contact with the probationer will not be maintained. However, services to the
victim will continue to be provided.

CAPABILITIES
1) Describe the Applicant's ability and experience to provide increased
supervision to probationers of crimes involving domestic violence, sexual assault,
dating violence, and/or stalking.
The primary objective when supervising VOISE probationers is to ensure the safety
of the community, assist them in their rehabilitation, and reduce recidivism. All
offenders will be assessed to identify risk of reoffending and level of supervision
using the STRONG-R assessment tool. The Probation Department will complete
the STR (Static Risk) portion on offenders at the time of the interview for the
Report of the Probation Officer, prior to sentencing. Once the offender is placed
on probation, the DPO will update the STIR. The DPO will then conduct the ONG
(Offender Needs Guide) portion of the assessment for those offenders that have
an STIR rating of High Violent, High Property, High Drug or Moderate.
DPOs provide certification and monitoring of the Department's various 52-week
long Batterers Intervention Programs. They maintain consistent communication
with the probationers, coordinate with other law enforcement agencies,
maintain contact with treatment providers, and maintain weekly contacts with

the probationer either by telephone, in the Probation Office, at the probationer's
home, or out in the community.
2) Describe the Applicant's working relationship between local law enforcement
and victim services providers.
The Domestic Violence Unit works closely with community partners from the
Department of Social Services, Adult Parole, Victim Services, and Family Court
Services. The DPO works closely with the Victim-Witness Advocate to ensure
domestic violence victims continue to have a voice throughout the offender's
probationary period.
3) Describe the training and qualifications of proposed staff who will supervise the
probationers of crimes involving domestic violence, sexual assault, dating
violence, and /or stalking. The supervising VOISE DPO has over 30 years of
probation supervision experience and has been assigned to the VOISE caseload
since 2014. The VOISE DPO is required to attend at least 40 hours of training per
calendar year and has attended training such as: Crisis Intervention and
Behavioral Health, Domestic Violence Offenders: Assessing Risk, Client Family
Dynamics & their Challenges, Motivational Interviewing, Vant4ge Assessment
and Case Plan Training, Vicarious Trauma and Adolescent Brain Development
Leading to Adverse Choices, to name a few.
