HomeMy WebLinkAboutM-23-023 - FSO-DSS CalAIM-JI Data Sharing MOU.pdf M-23-023 10.24.2022 version 1 INTER-DEPARTMENTAL A G R E E M E N T 2 THIS INTER-DEPARTMENTAL AGREEMENT is made and entered into this 1s' day of January, 3 2023, by and between the COUNTY OF FRESNO, DEPARTMENT OF SOCIAL SERVICES, hereinafter 4 referred to as "DSS", and the COUNTY OF FRESNO, SHERIFF-CORONER'S OFFICE. hereinafter 5 referred to as "FSO." 6 WITNESSETH: 7 WHEREAS, California Advancing and Innovating Medi-Cal (CaIAIM) is a long-term commitment to 8 transform and strengthen Medi-Cal, offering Californians a more equitable, coordinated, person-centered 9 approach to maximizing health: and 10 WHEREAS, California has received targeted expenditure authority through "Providing Access and 11 Transforming Health" (PATH) as part of its CaIAIM section 1115 demonstration to support programs 12 including the implementation of statewide justice-involved initiatives, and 13 WHEREAS, California statue (AB-133 Health; Chapter 143) mandates all counties implement pre- 14 release Medi-Cal enrollment and suspension processes by January 1, 2023 as part of the PATH Justice- 15 Involved Capacity Building Program. 16 NOW, THEREFORE, in consideration of their mutual covenants and conditions, the parties hereto 17 agree as follows: 18 1. SERVICES 19 A. FSO shall perform all services and fulfill all responsibilities as identified in Exhibit 20 A, under the heading "FSO Responsibilities". incorporated herein by reference and made part of this 21 Agreement. 22 B. DSS shall provide all services and fulfill all responsibilities as identified in Exhibit 23 A under the heading "DSS Responsibilities". 24 2. TERM 25 A. This Inter-Departmental Agreement shall be effective as of the 1" day of January 26 2023 and shall terminate on the 315' day of December 2024, 27 B. This agreement shall automatically be extended for two (2) additional twelve (12) 28 month periods upon the same terms and conditions set forth unless written notice of non-renewal is -1- 10.24.2022 version 1 given by either party no later than thirty (30) days prior to the renewal period. 2 3. TERMINATION 3 This Inter-Departmental Agreement may be terminated by either party upon the giving of 4 thirty (30) days advance written notice of an intention to terminate. However, termination of this Inter- 5 Departmental Agreement shall not affect any pending activities, which shall be handled to their 6 conclusion by either DSS and/or FSO. 7 4. MODIFICATION 8 A. Any matters of this Inter-Departmental Agreement may be modified from time to 9 time by the written consent of DSS and FSO without, in any way. affecting the remainder. 10 S. ASSIGNMENT AND SUBCONTRACTS 11 Neither party shall assign, transfer, or subcontract this Inter-Departmental Agreement nor 12 their rights or duties under this Agreement without the prior written consent of the other party. 13 6. RELATIONSHIP OF PARTIES 14 It is understood that this is an Inter-departmental Agreement by and between two (2) 15 separate departments of the County of Fresno and is not intended to and shall not be construed to 16 create a relationship of agent, servant, employee, partnership, joint venture, or association. 17 7. DATA SECURITY 18 For the purpose of preventing the potential loss, misappropriation or inadvertent 19 disclosure of FSO data including sensitive or personal client information; abuse of County resources; 20 and/or disruption to County operations, DSS must employ adequate data security measures to protect 21 the confidential information provided to the DSS by FSO, for the purpose of providing services under 22 this Inter-Departmental Agreement as required by the County Administrative Office Management 23 Directives, Chapter 1300, Information Services. 24 8. CONFIDENTIALITY AND MEDI-CAL PRIVACY 25 All service performed by DSS and FSO under this Inter-Departmental Agreement shall be 26 in strict conformance with all applicable Federal, State of California. and/or local laws and regulations 27 relating to confidentiality including, but not limited to: California Welfare and Institutions Code Sections 28 10850 and 14100.2, the CDSS Manual of Policies and Procedures, Division 19-000. and the California -2- 10.24.2022 version 1 Department of Health Care Services (DHCS) Medi-Cal Eligibility Procedures Manual. Section 2H. In 2 addition, all services performed by DSS and FSO under this Agreement shall also be in conformance 3 with the Medi-Cal Data Privacy and Security Agreement between DHCS and the County of Fresno 4 hereinafter referred to as the °Medi-Cal Data Agreement") that is then in effect, which is by this 5 reference incorporated herein. The current Medi-Cal Data Agreement is available upon request or can 6 be viewed at: http://www.fresnocountyca.qov/MediCalPrivacy. The purpose of this section is to assure 7 that all applications and records concerning program recipients shall be kept confidential and shall not 8 be opened to examination, publicized, disclosed, or used for any purpose not directly connected with the 9 administration of the program. DSS and FSO shall inform all of its employees, agents, officers, and 10 subcontractors of this provision; and that any person knowingly and intentionally violating this provision 11 is guilty of a misdemeanor. 12 9. GOVERNING LAW 13 The rights and obligations of the parties and all interpretation and performances of this 14 Inter-Departmental Agreement shall be governed in all respects by all Federal, State. and local statutes 15 and regulations. 16 10. ENTIRE AGREEMENT 17 This Inter-Departmental Agreement, including all Exhibits, constitutes the entire Inter- 18 Departmental Agreement between FSO and DSS with respect to the subject matter hereof, and 19 supersedes all previous agreements, negotiations, proposals, commitments, writings, advertisements, 20 publications, and understandings of any nature whatsoever unless expressly included in this Inter- 21 Departmental Agreement. 22 23 24 25 26 27 28 -3- 10.24.2022 version 1 The parties are executing this Agreement on the date stated in the introductory clause. 2 3 ATTEST: 4 COUNTY OF FRESNO COUNTY OF FRESNO DEPARTMENT OF SOCIAL SERVICES SHERIFF'S DEPARTMENT 5 6 7 By: By: Sa ja B ay, Dire for ohn o�id resno Sheriff-Coroner 8 �— — Date; � 3 Date: � Z� ?� `- 9 —� 10 11 12 13 SB:ja 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 -4- Exhibit A Page 1 of 2 SUMMARY OF SERVICES ORGANIZATIONS: Department of Social Services and Sheriff-Coroner's Office SERVICE: CaIAIM-Justice Involved Medi-Cal Pre-release Enrollment CONTRACT PERIOD: January 1, 2023 — December 31, 2026 PROJECT DESCRIPTION: The County of Fresno Sheriff-Coroner's Office (FSO) and the County of Fresno Department of Social Services (DSS) shall exchange information necessary to implement the California State mandated Medi-Cal pre-release enrollment and suspend/unsuspend benefits processes for the Fresno County Jail justice-involved population. FSO RESPONSIBILITIES: • Provide ongoing access to and training for use of the FSO CaIAIMs App to select DSS staff for the purpose of obtaining/providing individual Medi-Cal eligibility/coverage status. • Provide to DSS the name of a designated contact for all communication, actions, and issues related to DSS' access to the FSO CaIAIMs App. • Indicate incarceration/sentencing information and release date for each individual included in the FSO CaIAIMs App. • Assist individuals with completion of Medi-Cal applications. • Transmit completed applications electronically to a secure location to be mutually agreed upon by FSO and DSS. Each application is to include a cover letter. • Make available through the use of fliers, posters, and video, Medi-Cal information and messaging relevant to the justice-involved population. DSS RESPONSIBILITIES: • Access the FSO CaIAIMs App for the purpose of obtaining/providing individual Medi-Cal eligibility/coverage status and incarceration/release dates. o DSS users are required to complete the appropriate level of training (currently Security Awareness Training, Level 2) through CJISOnline.com before being granted access to the FSO CaIAIMs App. o DSS will provide to FSO the name of a designated contact for all communications, actions, and issues related to DSS' access to the FSO CaIAIMs App. o The DSS designated CaIAIMs App contact will: ➢ facilitate the training of DSS staff in the use of the CaIAIMs App through the CJISOnline.com website; ➢ submit request for new user access to the FSO CaIAIMs App through the FSO Help Desk web based ticket system; ➢ notify FSO immediately when a DSS staff member no longer requires access to the FSO CaIAIMs App; and ➢ review the list of DSS staff granted access to the FSO CalAIMs App on an annual, or as needed basis, and provide updates to any necessary changes. • At regularly occurring intervals, access the Fresno County Jail roster through the FSO CaIAIMs App to: o Screen individuals for Medi-Cal coverage. Exhibit A Page 2 of 2 o Flag individuals without Medi-Cal coverage. o Suspend Medi-Cal benefits of individuals incarcerated beyond 28 days. o Unsuspend Medi-Cal benefits of individuals upon notification of release from Fresno County Jail. For those released to another facility, other actions may be required. • Receive and process individual Medi-Cal applications consistent with applicable laws, regulations, and time frames. • Provide to Fresno County Jail Medi-Cal information and messaging relevant to the justice-involved population in the form of fliers, posters, and various other media. MUTUAL RESPONSIBILITIES: • Meet quarterly, or at another frequency as mutually determined, to review processes and provisions contained within this MOU.
