1 AMENDMENT II TO AGREEMENT
2 THIS AMENDMENT II TO AGREEMENT, ("Amendment II"), is made this 25th day of
3 October , 2022 ("Effective Date"), by and between the COUNTY OF FRESNO, a political
4 subdivision of the State of California ("County"), and the CITY OF SELMA ("City").
5 WITNESSETH
6 WHEREAS, the County has been designated as the sponsoring agency to administer and
7 implement the Community Development Block Grant (CDBG) Program activities of the County,
8 and its participating cities, in accordance with the provisions of Title I of the Housing and
9 Community Development Act of 1974, as amended, and the laws of the State of California; and
10 WHEREAS, on September 1, 2020, the County and the City entered into Agreement 20-
11 328, ("Agreement"), whereby $204,791 in CDBG funds were made available to the City for the
12 Selma Sidewalk ADA Improvements, Project No. 20651 ("Project"); and
13 WHEREAS, on November 2, 2021, the County and the City entered into Amendment I to
14 the Agreement, ("Amendment I"), whereby an additional $311,021 in CDBG funds were made
15 available to the City for the Project to reduce its local fund contribution; and
16 WHEREAS, the City now has an additional $120,847 from its allocation of CDBG funds
17 that may be made available to the Project to further reduce its local fund contribution under the
18 Agreement; and
19 WHEREAS, the City has requested these additional CDBG funds in the amount of
20 $120,847 be made available to the Project for the purposes of this Agreement.
21 NOW THEREFORE, in consideration of their mutual promises as hereinafter set forth, the
22 City and the County agree to amend the Agreement as follows:
23 1. Page 1, Lines 14-18, which was amended by Amendment 1, is further amended to
24 read:
25 "WHEREAS, the City has estimated that total cost of the Project is$636,659, and is in need
26 of$636,659 in CDBG funding to complete the Project; and
27 WHEREAS, the County can provide $636,659 in CDBG funds needed for the Project from
28 the City's 2020-2021 CDBG allocation ($204,791), from the City's 2021-2022 CDBG allocation

1 ($274,774), from the City's 2022-2023 CDBG allocation ($120,847), and from the City's remaining
2 balance of CDBG funds ($36,247)"; and
3 2. The proposed Project budget on Page 2, Lines 18 through 21, is amended to read:
4 "Construction $506,659
Design & Construction Engineering $ 55,000
5 Contingency, Permits & Misc. $ 75,000
Total $636,659"

7 3. The proposed funding summary for the Project on Page 2, Lines 27 and 28, which
8 was amended by Amendment I, is further amended to read:
9 "CDBG $636,659
Local Financial Contribution $ 0
10 Total $636,659"
11 4. That the dollar figure set forth on Page 2, Line 24; Page 3, Line 12; and Page 4,
12 Line 16, which was amended by Amendment I, is further amended in each such place to read
13 "$636,659".
14 County and City agree that this Amendment II is sufficient to further amend the
15 Agreement, and that upon execution of this Amendment II, the Agreement, Amendment I, and this
16 Amendment II together shall be considered the Agreement.
17 The Agreement, as hereby amended, is ratified and continued. All remaining provisions,
18 terms, covenants, conditions, and promises contained in the Agreement shall remain in full force
19 and effect.
