1 AMENDMENT ITO AGREEMENT
2 THIS AMENDMENT I TO AGREEMENT, ("Amendment I"), is made this 25t" day of
3 October , 2022 ("Effective Date"), by and between the COUNTY OF FRESNO, a political
4 subdivision of the State of California ("County"), and the CITY OF SELMA ("City").
5 WITNESSETH
6 WHEREAS, the County has been designated as the sponsoring agency to administer and
7 implement the Community Development Block Grant (CDBG) Program activities of the County,
8 and its participating cities, in accordance with the provisions of Title I of the Housing and
9 Community Development Act of 1974, as amended, and the laws of the State of California; and
10 WHEREAS, on November 19, 2019, the County and the City entered into Agreement 19-
11 595 ("Agreement"), whereby $229,198 in CDBG funds were made available to the City for the
12 Selma Sidewalk Connectivity, Project No. 19651 ("Project"); and
13 WHEREAS, the City now has an additional $88,065 from its allocation of CDBG funds that
14 may be made available to the Project to reduce its local fund contribution under the Agreement;
15 and
16 WHEREAS, the City has requested these additional CDBG funds in the amount of$88,065
17 be made available to the Project for the purposes of this Agreement.
18 NOW THEREFORE, in consideration of their mutual promises as hereinafter set forth, the
19 City and the County agree to amend the Agreement as follows:
20 1. Page 1, Lines 15-20, is amended to read:
21 "WHEREAS, the City has estimated that total cost of the Project is $349,585, and the City
22 has committed local funds to the Project in the amount of $32,322, and is in need of $317,263 in
23 CDBG funding to complete the Project; and
24 WHEREAS, the County can provide $317,263 in CDBG funds needed for the Project from
25 the City's 2019-2020 CDBG allocation ($218,555), from the City's 2022-2023 CDBG allocation
26 ($88,065), and from the City's remaining balance of CDBG funds ($16,679)"; and
27 2. The proposed Project budget on Page 2, Lines 23 through 25, is amended to read:

Contingency, Permits & Misc. 22,500
3 Total $349,585"
4 3. The proposed funding summary for the Project on Page 3, Lines 3 and 4, is
5 amended to read:
6 "CDBG $317,263
Local Financial Contribution 32,322
7 Total $349,585"
8 4. That the dollar figure set forth on Page 2, Line 28, Page 3, Line 16, and Page 4,
9 Line 20, is amended in each such place to read 1317,263".
10 County and City agree that this Amendment I is sufficient to amend the Agreement,
11 and that upon execution of this Amendment I, the Agreement and this Amendment I together shall
12 be considered the Agreement.
13 The Agreement, as hereby amended, is ratified and continued. All remaining provisions,
14 terms, covenants, conditions, and promises contained in the Agreement shall remain in full force
15 and effect.
