RECOMMENDED ACTION(S):
1. Approve and authorize the Chairman to execute Amendment No. 19-10323, A01 with the
California Department of Public Health Nutrition Education and Obesity Prevention Branch
Supplemental Nutrition Assistance Program-Education,for the CalFresh Healthy Living
Program, extending the term by one year from October 1, 2022 to September 30, 2023 and
increasing the maximum by$1,786,482 to a total of$7,145,928;
2. Approve and authorize the Chairman to execute Amendment No. 5 to Agreement with Fresno

There is no increase in Net County Cost associated with the recommended actions as the costs are fully
funded by the Nutrition Education and Obesity Prevention (NEOP) Branch Supplemental Nutrition
Assistance Program-Education (SNAP-Ed)grant provided by the California Department of Public Health
(CDPH).Approval of the first recommended action will extend the term of the CalFresh Healthy Living
Program (CalFresh)grant by one year with additional funding to allow the CalFresh program to continue
providing nutrition education activities and interventions to low-income County residents. Approval of the
second recommended action will extend the term by one year and increase the maximum to allow Fresno
County Superintendent of Schools (FCSS)to continue providing school wellness activities through FFY
2022-23. Approval of the third recommended action with California Health Collaborative (CHC)will extend
the term by one year and modify the budget to add a new bilingual part-time staff position, with no change to
the maximum compensation. Approval of the last recommended action with California State University
(CSU), Fresno Foundation through its Central Valley Health Policy Institute will extend the term by one year
to allow CSU Fresno Foundation to continue providing comprehensive evaluation education and obesity
prevention services for the NEOP CalFresh Program, with no change to the maximum compensation. This

ALTERNATIVE ACTION(S):
Should your Board not approve the recommended actions, the Department would be unable to fund the
NEOP Program and its related subcontracts for the additional extension year which could impact the
completion of required CalFresh grant activities and put the program at risk for non-compliance with the
CDPH.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended actions. The first recommended
action will increase the NEOP CalFresh grant maximum by$1,786,482 for FFY beginning October 1, 2022
through September 30, 2023; $7,145,928 for the term. This increase will cover contractual costs, staffing,
services, and supplies in support of program activities and interventions. The total cost for the second
recommended action with FCSS is $336,500 for FFY 2022-23; $2,229,000 for the term. The total cost for
the third recommended action with CHC is $311,603 for FFY 2022-23; $1,558,015 for the term. The total
cost for the fourth recommended action with CSU Fresno Foundation is $108,000 for FFY 2022-23;
$540,000 for the term. Sufficient appropriations and estimated revenues are included in the Department's
Org 5620 FY 2022-23 Adopted Budget.
DISCUSSION:
On September 24, 2019, your Board approved the 2019-2022 NEOP SNAP-Ed CalFresh revenue
agreement to allow the Department to support nutrition education and obesity prevention activities and
interventions for low-income County residents.Approval of the first recommended action will extend the term
of the NEOP CalFresh grant agreement one year with additional funding to ensure that by September 30,
2023, Fresno NEOP will have:
• Provided individual direct educational strategies to promote healthy eating, food resource
management, and/or physical activity to 15,246 CalFresh eligible residents in Fresno;
• Work with and/or support 43 partners and 7 coalitions in support of increased healthy eating and
physical activity behavior and access;
• Work in 30 sites to engage the CalFresh community in program planning and implementation, and
15 sites will put sustainability measures in place to ensure changes to support healthy eating and
physical activity are continued.
On December 13, 2016, your Board approved Agreement No. 16-698 with FCSS to provide nutrition
education activities in classrooms and afterschool programs in targeted low-income County communities.
On June 20, 2017, your Board approved First Amendment No. 16-698-1 to increase the maximum to expand
the school wellness services. On May 12, 2020, your Board approved Second Amendment No. 16-698-2 to
revise the scope of work to increase community training events and redistribute budget line items to
correspond with the revised scope of work. On August 10, 2021, your Board approved Third Amendment
No.16-698-3 to extend the term and increase the maximum by$336,500 to continue providing the school
wellness activities during COVID-19 pandemic. On December 14, 2021, your Board approved Forth
Amendment No.A-21-543 to revise the budget to offset FCSS salary increases without increasing the
maximum compensation.Approval of the second recommended action will extend the term by one year and
increase the funding to ensure FCSS will continue to provide and complete the same school wellness
activities that were delayed due to the COVID-19 pandemic closures to public schools that started in March
2020.
On September 24, 2019, your Board approved Agreement No. A-19-473 with CHC for healthy retail, and
healthcare clinic and hospital obesity prevention services. Approval of the third recommended action will
allow CHC to continue to provide the healthy retail activities with local retail vendors and complete the

obesity prevention activities with local healthcare clinics and hospitals that were delayed due to COVID-19
business closures and the restrictions on how businesses could operate moving forward.
On February 26, 2019, your Board approved Agreement No.A-19-099 with CSU, Fresno Foundation,for
required evaluation education and obesity prevention services for the Department's NEOP CalFresh
program.Approval of the fourth recommended action will ensure CSU, Fresno Foundation can continue to
provide the evaluation activities in the targeted communities in the County that were delayed or restricted
from occurring as a result of the COVID-19 pandemic.
It is the intention of the funder, that this extra year will provide the time needed to complete any activities that
the COVID-19 pandemic may have interrupted and continue providing the same services from the FFY 2023
Integrated Work Plan.

The Department amends this Grant, and the Grantee accepts and agrees to use the Grant
funds as follows:
AUTHORITY: The Department has authority to grant funds for the Project under Health and
Safety Code (HSC), Section 131085(a)(b).
PURPOSE FOR AMENDMENT: The purpose of the Grant amendment is to extend the term
for one year with additional funding to allow the Grantee to continue performing more of the
same services as identified in the Exhibit A.

are shown as strike-through text.
AMENDED GRANT AMOUNT: this amendment is to increase the grant by $1,786,482.00.
The maximum amount payable under this Grant Agreement shall not exceed $5,359,446.-00

AMENDED TERM OF GRANT: The term of this Grant shall be amended to begin October 1 ,
2019 and terminates on September 30, 2023. No funds may be requested or invoiced for work
performed or costs incurred after September 30, 2023.

Either party may make changes to the Project Representatives, or remittance address, by
giving a written notice to the other party, said changes shall not require an amendment to this
agreement but must be maintained as supporting documentation. Note: Remittance address
changes will require the Grantee to submit a completed CDPH 9083 Governmental Entity
Taxpayer ID Form or STD 204 Payee Data Record Form and the STD 205 Payee Data
Supplement which can be requested through the CDPH Project Representatives for
processing.
Note: Once the Grant Agreement has been fully executed, requests for modifications/changes
thereafter to the exciting Exhibit A and/or Exhibit A, Attachment 1, do not require a formal
amendment but must be agreed to in writing by both parties. The CDPH/Grantee Project
Representatives are responsible for keeping records of approval modifications/changes. Such
modifications/changes must be made at least 30 days prior to implementation. A formal
written amendment is required when there is an increase or decrease in funding or a change
in the term of the agreement.
All other terms and conditions of this Grant shall remain the same.

Budget Detail and Payment Provisions
1. Invoicing and Payment
A. Upon completion of project activities as provided in Exhibit A Grant Application, and upon
receipt and approval of the invoices, the State agrees to reimburse the Grantee for activities
performed and expenditures incurred in accordance with the costs specified herein.
B. Invoices shall include the Grant Number and shall be submitted not more frequently than
monthly in arrears to:

C. Invoices shall:
1) Be submitted no more than thirty (30) calendar days following the last day of the
reporting period, with a fifteen (15)-day grace period (45 days total).
2) Be prepared on Grantee letterhead. If invoices are not on produced letterhead, invoices
must be signed by an authorized official, employee, or agent certifying that the expenditures
claimed represent activities performed and are in accordance with Exhibit A Grant
Application under this Grant.
3) Bear the Grantee's name as shown on the Grant.
4) Identify the billing and/or performance period covered by the invoice.
5) Itemize costs for the billing period in the same or greater level of detail as indicated in this
Grant. Subject to the terms of this Grant, reimbursement may only be sought for those costs
and/or cost categories expressly identified as allowable and approved by CDPH.
2. Budget Contingency Clause
A. It is mutually agreed that if the Budget Act of the current year and/or any subsequent years
covered under this Agreement does not appropriate sufficient funds for the program, this
Agreement shall be of no further force and effect. In this event, the State shall have no liability to
pay any funds whatsoever to Grantee or to furnish any other considerations under this
Agreement and Grantee shall not be obligated to fulfill any provisions of this Agreement.
B. If funding for any fiscal year is reduced or deleted by the Budget Act for purposes of this
program, the State shall have the option to either cancel this Agreement with no liability
occurring to the State, or offer an agreement amendment to Grantee to reflect the reduced
amount.
3. Prompt Payment Clause
Payment will be made in accordance with, and within the time specified in, Government Code
Chapter 4.5, commencing with Section 927.
4. Amounts Payable
A. The amounts payable under this Grant shall not exceed $5,359,446. $7,145,928.00.
B. Payment allocations shall be made for allowable expenses up to the amount annually
encumbered commensurate with the state fiscal year in which services are fulfilled and/or goods
are received.

5. Timely Submission of Final Invoice
A. A final undisputed invoice shall be submitted for payment no more than sixty (60) forty-five (45)
calendar days following the expiration or termination date of this Grant, unless a later or
alternate deadline is agreed to in writing by the program grant manager. Said invoice must be
clearly marked "Final Invoice", indicating that all payment obligations of the State under this
Grant have ceased and that no further payments are due or outstanding.
B. The State may, at its discretion, choose not to honor any delinquent final invoice if the Grantee
fails to obtain prior written State approval of an alternate final invoice submission deadline.
6. Travel and Per Diem Reimbursement
Any reimbursement for necessary travel and per diem shall, unless otherwise specified in this
Agreement, be at the rates currently in effect, as established by the California Department of
Human Resources (Cal HR). If the Cal HR rates change during the term of the Agreement, the
new rates shall apply upon their effective date and no amendment to this Agreement shall be
necessary. No travel outside the State of California shall be reimbursed without prior
authorization from the CDPH. Verbal authorization should be confirmed in writing. Written
authorization may be in a form including fax or email confirmation.

When applicable, Per Title 2, Section 8117.5 of the California Code of Regulations requires CDPH will notify the
Department of Fair Employment and Housing, Office of Compliance Programs of this agreement award of$5,000
or more.
When applicable, Military and Veteran Code (MVC) 999.5(d), Government Code (GC) 14841 and California Code
of Regulations (CCR) 1896.78 require that all Prime Contractors that used a Disabled Veteran Business
Enterprise (DVBE)firm to perform an element of work for a given contract to report specific DVBE information,
therefore, if DVBE subcontractors are utilized in performance of this contract/procurement, you must complete
and return the attached CDPH 9095 form and return within 60 days from receipt of final payment by either faxing
