Make the following change(s) to the plans and specifications or do work not in the plans and specifications for
this contract. Because of the change(s), ZERO (0) -WORKING DAYS will be added to the contract time.
REPLACE DAMAGED SIGNAL POLE AND FOOTING —ACCIDENTAL WORK
This work was requested by the engineer.
According to Section 5-1.39, "Damage Repair and Restoration," of the Standard Specifications, replace the
damaged traffic signal pole and footing along the southside of Copper Avenue. Perform all work according to
the Plans, and applicable sections of the Project Specifications and Standard Specifications. Compensation
for this work will be made at an agreed price of$79,968.38 in accordance with the Section 9-1.03, "Payment
Scope" of the Special Provisions. This agreed price was a result of a sidebar agreement/settlement between
the contractor(Avison Construction, Inc.) and the public body's (responsible for the damages) insurance
company (Progressive). Progressive issued a check, payable to the County of Fresno for the aforementioned
amount. This check will be deposited into the project account as the supplemental allotment and contractor
will be reimbursed for the full amount as extra work. This agreed price is the full and final compensation for
this work, no additional compensation will be made thereafter.
This work was performed during the suspension of the contract, therefore, granting additional time was not
warranted.

DESCRIPTION:
Replace damaged pole and footing —accidental work.
WHY:
On April 14, 2022, a motorist ran through the intersection and hit the signal pole along the
southside of Copper Avenue and damaged the pole and concrete footing. Therefore, it was
necessary to replace the damaged pole and the footing.
HOW:
The contractor was directed to replace the damaged pole and footing according to Section 5-
1.39, "Damage Repair and Restoration," of the Standard Specifications. Compensation for this
work will be made at an agreed price of$79,968.38 in accordance with the Section 9-1.03,
"Payment Scope," of the Special Provisions. Since the project at the time of the accident was
incomplete and was not accepted by the County, the contractor had the sole responsibility to
protect the installed improvements. This agreed price was a result of a sidebar
agreement/settlement (without any involvement by the County) between the contractor(Avison
Construction, Inc.) and the public body's (responsible for the damages) insurance company
(Progressive). Progressive issued a check, payable to the County of Fresno for the
aforementioned amount. This check will be deposited into the project account as the
supplemental allotment and contractor will be reimbursed for the full amount as extra work.
