Approve and authorize the Chairman to execute a retroactive Second Amendment to Agreement No. 19-121 with Fresno County Superintendent of Schools for the adoption of nutrition and physical activity standards into Early Care and Education sites,to revise the budget, effective upon execution with no change to the term of March 12,2019 through September 29,2023, or compensation maximum of$141,236. 2. Approve and authorize the Chairman to execute a retroactive First Amendment to Agreement No. 19-122 with California Health Collaborative for assisting retail vendors in adopting healthy food service guidelines and the promotion of compliance with Federal lactation accommodation laws in targeted worksites,to revise the budget and work plan, effective upon execution with no change to the term of March 12,2019 through September 29, 2023 or compensation maximum of$136,256. There is no additional Net County Cost associated with the recommended actions. Approval of the first recommended action will shift unspent year two funds in the amount of$13,672 to year three and extend year two timeline to year three to allow Fresno County Superintendent of Schools (FCSS)to complete activities disrupted by COVID19 closures of early care and education (ECE)sites, and sheltering in place orders that restricted all non-essential field work. Approval of the second recommended action will shift unspent year two funds in the amount of$13,960 to year three and extend year two timeline to year three to allow California Health Collaborative (CHC)to increase the number of worksites in compliance with Federal lactation accommodation laws by up to three sites, and assist a small retail vendor in adopting healthy food service guidelines. ALTERNATIVE ACTION(S): Should your Board not approve the recommended amendments, FCSS and CHC will not be fully funded to complete activities for the State Physical Activity and Nutrition (SPAN)Grant program and unable to fulfill contractual obligations. RETROACTIVE AGREEMENT: The recommended amendments are retroactive to September 30, 2019, in order to reallocate year two and year three budgets. The recommended amendments are fully funded with the California Department of Public Health (CDPH) Centers for Disease Control and Prevention (CDC)SPAN grant award. On March 24, 2020, your Board approved a First Amendment No. 19-122-1 for FCSS to revise year one of the budget to actual expenditures ($7,076)and shift unspent funds ($19,424)to year two. If approved,the first recommended action for FCSS will revise year two and year three budgets with no change to the maximum compensation ($141,236)as follows: o Year One (03/19/19-09/29/19) $7,076 (no changes) o Year Two (09/30/19-09/29/20) $34,436 (decreased$13,672) o Year Three (09/30/20-09/29/21) $42,356 (increase of$13,672) o Extension 1 (09/30/21 -09/29/22) $28,684 (no changes) o Extension II (09/30/22-09/29/23) $28,684 (no changes) If approved, the second recommended action for CHC Agreement No. 19-121,will revise year two and year three budgets with no changes to the maximum compensation ($136,256)as follows: o Year One (03/12/19-09/29/19) $12,684(no changes) o Year Two (09/30/19-09/29/20) $23,563(decrease of$13,960) o Year Three (09/30/20-09/29/21) $42,643 (increase of$13,960) o Extension 1 (09/30/21 -09/29/22) $28,683 (no changes) o Extension 1 (09/30/22-09/29/23) $28,683 (no changes) Sufficient appropriations and estimated revenues are included in the Department's Org 5620 FY 2020-21 Adopted Budget and will be included in future budget requests. DISCUSSION: On March 12, 2019, your Board approved a five-year revenue agreement with the CDPH Nutrition Education and Obesity Prevention Branch for the CDC-SPAN grant program. The SPAN program strategy is designed to enhance County implementation of helping small retail vendors in adopting food service guidelines and promoting compliance with federal lactation accommodation laws in targeted worksites; and increasing adoption of nutrition and physical activity standards in ECE sites. On March 12, 2019, your Board also approved a five-year agreement with FCSS, for services to increase nutrition content by adopting nutrition and physical activity standards into ECE site programs, and a five-year agreement with CHC, for services to promote compliance with Federal lactation accommodation laws in targeted worksites and assist small retail vendors in adopting healthy food service guidelines. In addition to completing year two activities virtually with their partnered ECE sites, FCSS will: • Increase the number of ECE programs that have implemented and integrated nutrition and physical activity standards into policies and professional development plans; • Provide nutrition and physical activity technical assistance to one organization, and up to six individual ECE programs to increase their adoption and practice of physical activity and nutrition standards; and • Provide nutrition and physical activity technical assistance to one resource and referral organization, and up to six individual ECE program sites to increase adoption and practice of physical activity and nutrition standards. In addition to completing year two activities CHC will: • Assist one organization (i.e. Parks and Recreation,After School Program or YMCA) in one location in developing healthy food service guidelines; • Support breast feeding interventions adopted and implemented in community and government worksites; and County of Fresno page 2 File Number.20-1162 File Number:20-1162 • Increase the number of worksites in compliance with federal lactation accommodation laws by up to three sites. The Department, FCSS and CHC will continue to collaborate to ensure the completion of work plan activities.
